WHO NEEDS A<br />

TRADE ASSOCIATION<br />

According to a recent survey, 85<br />

percent <str<strong>on</strong>g>of</str<strong>on</strong>g> all business failures were<br />

A PROFESSIONAL<br />

(a) <str<strong>on</strong>g>of</str<strong>on</strong>g>, relating to, or characteristic<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>.<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al is <strong>on</strong>e who has a particular<br />

state <str<strong>on</strong>g>of</str<strong>on</strong>g> mind. He or she is indeed<br />

a servant <str<strong>on</strong>g>of</str<strong>on</strong>g> the public. He goes,<br />

that extra mile in ensuring that his<br />

clients and the pubhc in general<br />

receive the best level <str<strong>on</strong>g>of</str<strong>on</strong>g> skill that he<br />

can provide. An adequate or mediocre<br />

job is not satisfactory.<br />

A true pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al need not be the<br />

best in his field but he must always<br />

strive to be the best and always <str<strong>on</strong>g>of</str<strong>on</strong>g>fer<br />

his best. That is the true mark <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al pers<strong>on</strong>.<br />

CORRECTING LAND<br />

SURVEYING ERRORS<br />

The subject <str<strong>on</strong>g>of</str<strong>on</strong>g> correcting land<br />

surveying errors is <strong>on</strong>e that requires<br />

an abundance <str<strong>on</strong>g>of</str<strong>on</strong>g> tactfulness. When<br />

your fellow surveyor calls <strong>on</strong> a Friday<br />

afterno<strong>on</strong> and tells you that he found<br />

your weekend is sure to be<br />

c<strong>on</strong>sidered a disaster. Revising your<br />

calculati<strong>on</strong>s, descripti<strong>on</strong>s, and plats<br />

is difficult to explain to your client.<br />

Since becoming registered as a<br />

land surveyor in Arkansas and sixteen<br />

other states, I have become<br />

familiar with the procedures <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

several boards <str<strong>on</strong>g>of</str<strong>on</strong>g> registrati<strong>on</strong>s. One<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the most comm<strong>on</strong> grounds for<br />

revocati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a land surveying license<br />

is the refusal <str<strong>on</strong>g>of</str<strong>on</strong>g> the surveyor to correct<br />

an obvious error.<br />

The original surveyors <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

public lands in the U.S. have been accused<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> making <str<strong>on</strong>g>of</str<strong>on</strong>g>fice surveys, falsifying<br />

field notes, and making gross<br />

errors in measurement. Often, the<br />

surveys were <str<strong>on</strong>g>of</str<strong>on</strong>g> excellent quality,<br />

c<strong>on</strong>sidering the equipment. C<strong>on</strong>sider<br />

the example <str<strong>on</strong>g>of</str<strong>on</strong>g> the original survey <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the New Mexico Principal Meridian.<br />

Both surveyors had worked in the<br />

General Land Office in Arkansas<br />

and were c<strong>on</strong>sidered men <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

highest integrity and ability. The first<br />

108 miles <str<strong>on</strong>g>of</str<strong>on</strong>g> the principal meridian<br />

were measured in error — the handles<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the 66-foot chain were not to be included<br />

in the 66-foot measurement.<br />

Mr. Garrets<strong>on</strong> remeasured and<br />

remarked the entire 108 miles at his<br />

own expense!<br />

Correcti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a land surveying error<br />

is almost always costly, but the<br />

peace <str<strong>on</strong>g>of</str<strong>on</strong>g> mind <strong>on</strong>e has after correcting<br />

the error is well worth the expense.<br />

When dealing with our fellow<br />

surveyor, it is important to<br />

remember what the eighth verse <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Proverbs, chapter two says:<br />

"Reprove not a scorner, lest he hate<br />

thee: then rebuke a wise man, and he<br />

will love thee."<br />

THE ETHICS OF<br />

LINE-FLAGGING<br />

Land Surveyors are occasi<strong>on</strong>ally<br />

asked to "flag" a line to guide timber<br />

cutters. The client will insist that he<br />

does not want a "complete" survey <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the property, nor does he want corners<br />

m<strong>on</strong>umented or lines marked<br />

and painted. He may not want a plat,<br />

and <str<strong>on</strong>g>of</str<strong>on</strong>g> course, no descripti<strong>on</strong> or written<br />

report. In other words, he just<br />

wants an approximate line <str<strong>on</strong>g>of</str<strong>on</strong>g> ribb<strong>on</strong>s.<br />

He w<strong>on</strong>'t pay for any tie lines.<br />

He says you are to run "by his deeds".<br />

And, he wants the job d<strong>on</strong>e<br />

"tomorrow".<br />

Such clients have legitimate need<br />

for this kind <str<strong>on</strong>g>of</str<strong>on</strong>g> service. The<br />

surveyor's questi<strong>on</strong> is, "How can 1<br />

help the client and still be ethical and<br />

meet the law and regulati<strong>on</strong>s?" If the<br />

flagging results in his client being<br />

sued by an adjoiner, can the surveyor<br />

avoid being sued too? Can he keep<br />

his reputati<strong>on</strong> unblemished? If he rejects<br />

the job, some other surveyor<br />

may not <strong>on</strong>ly get this particular job,<br />

but he may lose a permanent client.<br />

The surveyor should explain to the<br />

client that he is normally required to<br />

locate properly lines according to all<br />

deeds that could affect its locati<strong>on</strong><br />

within certain prescribed technical<br />

accuracy, and as a court would<br />

decide if there were a lawsuit. The<br />

surveyor should advise the client thai<br />

if the work is to be d<strong>on</strong>e to his<br />

specificati<strong>on</strong>s, that the surveyor<br />

must prepare a report for him that<br />

discloses fully what the surveyor has<br />

d<strong>on</strong>e, how he did it, the problems he<br />

encountered, the weaknesses and<br />

strengths <str<strong>on</strong>g>of</str<strong>on</strong>g> the work, etc. And that<br />

surveyor is required to keep the adjoiner<br />

informed <str<strong>on</strong>g>of</str<strong>on</strong>g> plans and progress<br />

and resuhs should also be explained.<br />

If the client does not accept<br />

these terms, the commissi<strong>on</strong> should<br />

be rejected.<br />

SMALL CLAIMS COURT;<br />

SATISFACTION OF JUDGMENT<br />

Existing law provides that immediately<br />

up<strong>on</strong> receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> payment<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> judgment, a judgment creditor or<br />

his or her assignee shall file with the<br />

small claims court an acknowledgment<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> satisfacti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> judgment;<br />

and any judgment creditor or assignee<br />

various services relative to the<br />

real property may be barred after 10<br />

does not define the term "substantial<br />

civil engineer <str<strong>on</strong>g>of</str<strong>on</strong>g> the state.<br />

AB #972 would, instead, require that<br />

the county surveyor be a pers<strong>on</strong><br />

authorized to practice land surveying<br />

SURFACE MINING ACT<br />

<str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>man Nick J. Rahall, West<br />

Virginia, introduced a bill <strong>on</strong> June 24<br />

to rectify what he calls the "grave injustice"<br />

that was committed when<br />

land surveyors were not given a lead<br />

role in the Surface Mining C<strong>on</strong>trol<br />

and Reclamati<strong>on</strong> Act <str<strong>on</strong>g>of</str<strong>on</strong>g> 1977.<br />

His bill, HR 4000, will reinstate<br />

land surveyors in their traditi<strong>on</strong>al<br />

role <str<strong>on</strong>g>of</str<strong>on</strong>g> preparing maps and plans for<br />

mining operati<strong>on</strong>s. Co-sp<strong>on</strong>soring<br />

the bill were <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>man Morris K.<br />

Udall, Ariz<strong>on</strong>a; James Santini,<br />

Nevada; Douglas Applegate, Ohio;<br />

Austin J. Murphy, Pennsylvania;<br />

and Carroll A. Campbell, J., South<br />

Carolina. <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>man Udall,<br />

BILL FOR FEDERAL<br />

LAND SURVEY ACT<br />

INTRODUCED IN THE HOUSE<br />

On August 4, 1981, legislati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

major importance to the surveying<br />

and mapping pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>s was introduced<br />

in the House <str<strong>on</strong>g>of</str<strong>on</strong>g> Representatives.<br />

The bill, H.R. 4399, entitled<br />

the Federal Land Survey Act <str<strong>on</strong>g>of</str<strong>on</strong>g> 1981,<br />

was introduced by <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>man<br />

Manuel Lujan <str<strong>on</strong>g>of</str<strong>on</strong>g> New Mexico and<br />

<str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>man John Breaux <str<strong>on</strong>g>of</str<strong>on</strong>g> Louisiana.<br />

The purposes <str<strong>on</strong>g>of</str<strong>on</strong>g> H.R. 4399 are to<br />

encourage the timely c<strong>on</strong>duct and ap-


oval <str<strong>on</strong>g>of</str<strong>on</strong>g> federal land surveys, and<br />

romote cooperati<strong>on</strong> am<strong>on</strong>g private<br />

landholders and the local and federal<br />

governments in the survey <str<strong>on</strong>g>of</str<strong>on</strong>g> public<br />

lands. The bill also is designed to<br />

enhance the stability and permanence<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the nati<strong>on</strong>'s records <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

surveys, provide the basis for a multipurpose<br />

nati<strong>on</strong>al cadastre, and provide<br />

for the maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Public Land Survey System (PLSS).<br />

A significant provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the legislati<strong>on</strong><br />

would provide authority for<br />

the BLM to c<strong>on</strong>duct surveys or<br />

resurveys by c<strong>on</strong>tract with private<br />

sources authorized to perform such<br />

services under applicable State law.<br />

In c<strong>on</strong>tracting for such surveying services,<br />

the BLM would be required to<br />

employ negotiated procurement procedures<br />

that focus <strong>on</strong> the dem<strong>on</strong>strated<br />

competence and qualificati<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>als <str<strong>on</strong>g>of</str<strong>on</strong>g>fering<br />

the services.<br />

Another requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> H.R. 4399<br />

would provide for cooperati<strong>on</strong> between<br />

the BLM and the Interstate<br />

Commerce Commissi<strong>on</strong> in the c<strong>on</strong>uct<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> cadastral surveys and plat<br />

aps necessary to perpetuate the<br />

boundaries <str<strong>on</strong>g>of</str<strong>on</strong>g> lands adjacent to railroad<br />

and utility rights-<str<strong>on</strong>g>of</str<strong>on</strong>g>-way authorized<br />

for aband<strong>on</strong>ment or disc<strong>on</strong>tinuance.<br />

In additi<strong>on</strong>, within three<br />

years, the Secretaries <str<strong>on</strong>g>of</str<strong>on</strong>g> Interior,<br />

Commerce, and Agriculture, in c<strong>on</strong>sulati<strong>on</strong><br />

with all the States' Governors<br />

and the Nati<strong>on</strong>al Academy <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Sciences, would be directed to assess<br />

multi-purpose nati<strong>on</strong>al cadastre informati<strong>on</strong><br />

needs and c<strong>on</strong>duct a feasibility<br />

study for estabhshing a multipurpose<br />

nati<strong>on</strong>al cadastre system.<br />

Similar legislati<strong>on</strong> has been introduced<br />

in the U.S. Senate by<br />

Senator Peter Domenici <str<strong>on</strong>g>of</str<strong>on</strong>g> New<br />

Mexico, The Senate versi<strong>on</strong> S. 706,<br />

however, presently does not c<strong>on</strong>tain<br />

the House bill's requirements that<br />

BLM surveys comply with applicable<br />

State laws and that federal survey<br />

procurements be negotiated.<br />

You are encouraged to c<strong>on</strong>tact the<br />

House Committee <strong>on</strong> Interior and<br />

Insular Affairs and its Subcommittee<br />

<strong>on</strong> Public Lands and Nati<strong>on</strong>al Parks<br />

urge early hearings <strong>on</strong> H.R. 4399 in<br />

A BILL<br />

To establish a nati<strong>on</strong>al policy to<br />

provide for the timely notice, c<strong>on</strong>duct,<br />

approval, and record <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Federal land surveys, and for other<br />

purposes.<br />

Be it enacted by the Senate and<br />

House <str<strong>on</strong>g>of</str<strong>on</strong>g> Represenatives <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

United States <str<strong>on</strong>g>of</str<strong>on</strong>g> America in <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g><br />

assembled, That this Act may<br />

be cited as the "Federal Land Survey<br />

Act <str<strong>on</strong>g>of</str<strong>on</strong>g> 1981".<br />

Sec. 2 (a) The purposes <str<strong>on</strong>g>of</str<strong>on</strong>g> this Act<br />

are —<br />

(1) to declare a nati<strong>on</strong>al policy<br />

which will encourage the timely c<strong>on</strong>duct<br />

and approval <str<strong>on</strong>g>of</str<strong>on</strong>g> Federal land<br />

surveys;<br />

(2) to provide the public with<br />

cooperati<strong>on</strong> with landowners and the<br />

several States in the survey <str<strong>on</strong>g>of</str<strong>on</strong>g> Federal<br />

lands;<br />

(4) to promote the stability and<br />

permanence <str<strong>on</strong>g>of</str<strong>on</strong>g> the Nati<strong>on</strong>'s records<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> survey;<br />

(5) to provide the basis for a multipurpose<br />

nati<strong>on</strong>al land informati<strong>on</strong><br />

system; and<br />

(6) provide for the reestablishment<br />

and maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> the public land<br />

survey system.<br />

(b) The <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>, recognizing the<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>ound impact <str<strong>on</strong>g>of</str<strong>on</strong>g> Federal land<br />

surveys <strong>on</strong> land record stability,<br />

property c<strong>on</strong>veyance, envir<strong>on</strong>mental<br />

quality, and resource productivity<br />

and the critical importance <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Federal land surveys to the ec<strong>on</strong>omic<br />

and social well-being <str<strong>on</strong>g>of</str<strong>on</strong>g> this Nati<strong>on</strong>'s<br />

citizens, declares that it is the c<strong>on</strong>tinuing<br />

policy <str<strong>on</strong>g>of</str<strong>on</strong>g> the Federal Government<br />

to—<br />

(1) coordinate Federal land<br />

surveys with other Federal plans,<br />

functi<strong>on</strong>s, programs, and resources;<br />

(2) protect the b<strong>on</strong>a fide rights or<br />

claims <str<strong>on</strong>g>of</str<strong>on</strong>g> any claimant, entryman, or<br />

owner <str<strong>on</strong>g>of</str<strong>on</strong>g> lands affected by such<br />

Federal land survey, resurvey, or<br />

retracement by complying with the<br />

State statutes regulating land survey<br />

licensure, corner recordati<strong>on</strong>, and<br />

the platting <str<strong>on</strong>g>of</str<strong>on</strong>g> lands when such<br />

Federal land survey affects the b<strong>on</strong>a<br />

fide rights <str<strong>on</strong>g>of</str<strong>on</strong>g> a private owner or is adjacent<br />

to private lands;<br />

(3) cooperate with State and local<br />

governments, and other c<strong>on</strong>cerned<br />

public and private organizati<strong>on</strong>s, in<br />

the timely notice, c<strong>on</strong>duct, and maintenance<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> such Federal land surveys,<br />

resurveys, and retracements; and<br />

(4) provide nati<strong>on</strong>al leadership in<br />

the development <str<strong>on</strong>g>of</str<strong>on</strong>g> a multipurpose<br />

nati<strong>on</strong>al cadastre as a basis for improved<br />

land c<strong>on</strong>veyance procedures,<br />

for equitable taxati<strong>on</strong>, for informed<br />

resource management and envir<strong>on</strong>mental<br />

planning, and to further the<br />

Nati<strong>on</strong>'s ec<strong>on</strong>omic productivity.<br />

Sec. 3. (a) The Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> the Interior<br />

(hereinafter referred to as the<br />

"Secretary") or such agency as the<br />

Secretary may designate, in the<br />

survey or resurvey <str<strong>on</strong>g>of</str<strong>on</strong>g> public lands<br />

made after the date <str<strong>on</strong>g>of</str<strong>on</strong>g> enactment <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

this Act, shall-<br />

(1) provide all affected Federal and<br />

State agencies, local governments,<br />

individual claimants, entrymen,<br />

landowners, and the local public with<br />

notice <str<strong>on</strong>g>of</str<strong>on</strong>g> intent to c<strong>on</strong>duct, certify,<br />

or record a survey or resurvey not less<br />

than thirty days prior to the intended<br />

acti<strong>on</strong>;<br />

(2) initiate any survey or resurvey<br />

within six m<strong>on</strong>ths <str<strong>on</strong>g>of</str<strong>on</strong>g> providing notice<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> intent to c<strong>on</strong>duct such survey or<br />

resurvey;<br />

(3) complete any survey or resurvey<br />

and all necessary m<strong>on</strong>umentati<strong>on</strong>,<br />

plats and notes, affixing a permanent<br />

mark designating the year <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the survey or resurvey <strong>on</strong> each m<strong>on</strong>ument<br />

when established or reestablished,<br />

identifying as temporary<br />

all temporary m<strong>on</strong>uments at the<br />

m<strong>on</strong>ument, and otherwise complying<br />

with all applicable State statutes<br />

regulating land survey licensure, corner<br />

recordati<strong>on</strong>, and platting when<br />

such survey affects the b<strong>on</strong>a fide<br />

rights <str<strong>on</strong>g>of</str<strong>on</strong>g> a private owner or is adjacent<br />

to private lands; and<br />

(4) certify the survey or resurvey in<br />

the appropriate land <str<strong>on</strong>g>of</str<strong>on</strong>g>fice and State<br />

agency within ninety days <str<strong>on</strong>g>of</str<strong>on</strong>g> the date<br />

the survey or resurvey is completed.<br />

(b) When a secti<strong>on</strong> subdivisi<strong>on</strong><br />

survey is c<strong>on</strong>ducted involving both<br />

lands owned by the Federal Government<br />

and n<strong>on</strong>-Federal lands, the secti<strong>on</strong><br />

center corner shall be m<strong>on</strong>umented<br />

and certified in accordance<br />

with subsecti<strong>on</strong> (a) and with all applicable<br />

State statutes regarding the<br />

subdivisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> secti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the public<br />

land survey system.<br />

(c) If the Secretary or the<br />

Secretary's designee fails to certify a<br />

m<strong>on</strong>ument within ninety days as required<br />

in subsecti<strong>on</strong> (a)(4), the temporary<br />

m<strong>on</strong>ument shall be removed<br />

within fifteen days after the ninetyday<br />

period has expired. Notice <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

such removal with reas<strong>on</strong>s for the<br />

removal and notice <str<strong>on</strong>g>of</str<strong>on</strong>g> any plans for<br />

resurvey or retracement shall be published<br />

in a local newspaper and the<br />

Federal Register within thirty days <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

removal.<br />

(d)(1) The Secretary or the Secretary's<br />

designee may c<strong>on</strong>duct the<br />

survey or resurvey <str<strong>on</strong>g>of</str<strong>on</strong>g> public lands<br />

made after the date <str<strong>on</strong>g>of</str<strong>on</strong>g> enactment <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

this Act by c<strong>on</strong>tract with private<br />

sources authorized to perform such<br />

surveying in State or States in which<br />

the survey or resuvey is c<strong>on</strong>ducted.<br />

(2) The Secretary's designee, in<br />

c<strong>on</strong>tracting for such surveying services<br />

as provided in subsecti<strong>on</strong> (1),<br />

shall -<br />

(A) publicly announce all requirements<br />

for surveying and related pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

services <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

dem<strong>on</strong>strated competence and qualificati<strong>on</strong><br />

for the type <str<strong>on</strong>g>of</str<strong>on</strong>g> services required,<br />

and at fair and reas<strong>on</strong>able<br />

prices, and encourage firms engaged<br />

in the lawful practice <str<strong>on</strong>g>of</str<strong>on</strong>g> their pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong><br />

to submit annually a statement<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> qualificati<strong>on</strong>s and performance<br />

data;<br />

(B) provide for establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

selecti<strong>on</strong> committee which shall<br />

evaluate, for each survey or resurvey<br />

c<strong>on</strong>tract, the, current statements <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

qualificati<strong>on</strong>s and performance data<br />

<strong>on</strong> file, together with those that may<br />

be submitted by other firms regarding<br />

the proposed c<strong>on</strong>tract, c<strong>on</strong>duct<br />

discussi<strong>on</strong> with no less than three<br />

firms regarding the c<strong>on</strong>tract and the<br />

relative utility <str<strong>on</strong>g>of</str<strong>on</strong>g> alternative methods<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> approach for furnishing the required<br />

services, and then select from<br />

such firms, in order <str<strong>on</strong>g>of</str<strong>on</strong>g> evaluated<br />

preference, based up<strong>on</strong> criteria<br />

established by the Secretary or the<br />

Secretary's designee, no less than<br />

three <str<strong>on</strong>g>of</str<strong>on</strong>g> the firms found to be most<br />

highly qualified to provide the services<br />

required;<br />

(C) negotiate a c<strong>on</strong>tract with the<br />

highest qualified firm for surveying<br />

services at compensati<strong>on</strong> which the<br />

Secretary or the Secretary's designee<br />

determines is fair and reas<strong>on</strong>able to<br />

the Government, taking into account<br />

the estimated value <str<strong>on</strong>g>of</str<strong>on</strong>g> the services to<br />

be rendered, the scope, complexity,<br />

and pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al nature there<str<strong>on</strong>g>of</str<strong>on</strong>g>. If<br />

the Secretary's designee is unable to<br />

negotiate a satisfactory c<strong>on</strong>tract with<br />

the firm c<strong>on</strong>sidered to be the most<br />

qualified, at a price determined to be<br />

fair and reas<strong>on</strong>able to the Government,<br />

negotiati<strong>on</strong>s with that firm<br />

should be formally terminated, and<br />

negotiati<strong>on</strong>s with the sec<strong>on</strong>d most<br />

qualified firm should be undertaken.<br />

Failing accord with the sec<strong>on</strong>d most<br />

qualified firm, the Secretary's<br />

designee, should terminate negotiati<strong>on</strong>s,<br />

and undertake negotiati<strong>on</strong>s<br />

with the third most qualified firm.<br />

The Secretary's designee, if unable to<br />

negotiate a satisfactory c<strong>on</strong>tract with<br />

any <str<strong>on</strong>g>of</str<strong>on</strong>g> the selected firms, shall select<br />

additi<strong>on</strong>al firms in order <str<strong>on</strong>g>of</str<strong>on</strong>g> their<br />

competence and qualificati<strong>on</strong>s and<br />

c<strong>on</strong>tinue negotiati<strong>on</strong>s in accordance<br />

with this subsecti<strong>on</strong> until an agreement<br />

is reached."<br />

(e) Cooperate with the Interstate<br />

Commerce Commissi<strong>on</strong> to c<strong>on</strong>duct<br />

cadastral surveys and plat maps<br />

necessary to perpetuate the boundaries<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> lands adjacent to rights-<str<strong>on</strong>g>of</str<strong>on</strong>g>way<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> any railroad or utility authorized<br />

for aband<strong>on</strong>ment or disc<strong>on</strong>tinuance<br />

by the Commissi<strong>on</strong> pursuant<br />

to secti<strong>on</strong> 10903 <str<strong>on</strong>g>of</str<strong>on</strong>g> title 49, United<br />

States Code, and require such surveys<br />

to be accomplished and recorded<br />

under the applicable statutes <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the State or States in which the land<br />

and rights-<str<strong>on</strong>g>of</str<strong>on</strong>g>-way are situated.<br />

Sec. 4 (a) The Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> the Interior,<br />

the Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> Commerce<br />

and the Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> Agriculture, in<br />

c<strong>on</strong>sultati<strong>on</strong> with the Governors <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the several States and the President<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the Nati<strong>on</strong>al Academy <str<strong>on</strong>g>of</str<strong>on</strong>g> Sciences,<br />

are authorized and directed to<br />

c<strong>on</strong>duct an assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> multipurpose<br />

nati<strong>on</strong>al cadastre informati<strong>on</strong><br />

needs and develop a feasibility study<br />

for establishing a multipurpose nati<strong>on</strong>al<br />

cadastre system. The Secretary<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the Interior, Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> Commerce<br />

and the Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> Agriculture<br />

shall submit the feasibility<br />

report with recommendati<strong>on</strong>s and<br />

any proposals for legislati<strong>on</strong> to the<br />

majority leader <str<strong>on</strong>g>of</str<strong>on</strong>g> the Senate and the^^<br />

Speaker <str<strong>on</strong>g>of</str<strong>on</strong>g> the House <str<strong>on</strong>g>of</str<strong>on</strong>g> Representa^^<br />

lives within three years <str<strong>on</strong>g>of</str<strong>on</strong>g> the date <str<strong>on</strong>g>of</str<strong>on</strong>g>^^<br />

the enactment <str<strong>on</strong>g>of</str<strong>on</strong>g> this Act.<br />

(b) The recommendati<strong>on</strong>s c<strong>on</strong>tained<br />

in the feasibility study shall be<br />

c<strong>on</strong>sistent with the Forest and<br />

Rangeland Resources Planning Act<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> 1974, the Federal Land Policy and<br />

Management Act <str<strong>on</strong>g>of</str<strong>on</strong>g> 1976, and the<br />

purposes and policies <str<strong>on</strong>g>of</str<strong>on</strong>g> this Act.<br />

ASTERN MASSACHUSETTS<br />

SCHOOL OF SURVEY<br />

The Eastern Massachusetts Associati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> Land Surveyors (EMALS)<br />

is <str<strong>on</strong>g>of</str<strong>on</strong>g>fering a corresp<strong>on</strong>dence school<br />

in surveying. The Associati<strong>on</strong> has<br />

been working <strong>on</strong> this program for ten<br />

years and is still in the process <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

enlarging and improving it.<br />

At present Ihey have a corresp<strong>on</strong>dence<br />

school with about 200 students<br />

and six teachers. The curriculum<br />

c<strong>on</strong>sists <str<strong>on</strong>g>of</str<strong>on</strong>g> 13 courses including seven<br />

in survey math, <strong>on</strong>e in legal aspects,<br />

<strong>on</strong>e in drainage, two in photogrammetry<br />

and two in geodetic surveying.<br />

Each course has nine assignments<br />

and a final exam.<br />

No course is further away than<br />

your mail box, and courses can be<br />

started at any time. A correct answer<br />

and the correct method are requirements<br />

for every assignment, and<br />

papers are returned as many times as<br />

necessary until they are correct.<br />

Through an arrangement with the<br />

University <str<strong>on</strong>g>of</str<strong>on</strong>g> the State <str<strong>on</strong>g>of</str<strong>on</strong>g> New York,<br />

about half <str<strong>on</strong>g>of</str<strong>on</strong>g> their courses are<br />

awarded semester hour credits toward<br />

either an associate or baccalaureate<br />

degree. The University will<br />

supply home study curriculums<br />

through which the balance <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

credits for a full college degree can be<br />

obtained by home study. Also,<br />

CEU's {C<strong>on</strong>tinuing Educati<strong>on</strong> Units)<br />

are given for the successful passing <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

each course.<br />

Courses are graded to all levels<br />

from the greenest rodman to the<br />

experienced pr<str<strong>on</strong>g>of</str<strong>on</strong>g>esi<strong>on</strong>al surveyor,<br />

and many college graduates have<br />

taken the courses. The school does<br />

not aim to take the place <str<strong>on</strong>g>of</str<strong>on</strong>g> computers,<br />

nor do they depend <strong>on</strong> soluti<strong>on</strong>s<br />

by formulae. They stress the<br />

understanding rather the memorizati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> formulae.<br />

All six <str<strong>on</strong>g>of</str<strong>on</strong>g> their staff are college<br />

graduates and four have masters<br />

degrees. Three teach college parttime;<br />

<strong>on</strong>e is a full-time college pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essor;<br />

<strong>on</strong>e is a retired pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essor <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

photogrammetry. All but <strong>on</strong>e is or<br />

has been directly c<strong>on</strong>nected with<br />

practical surveying.<br />

The school sets two goals that each<br />

student can work toward. A Grade 1<br />

C<strong>on</strong>tinuing Survey Educati<strong>on</strong> award<br />

is given for the successful completi<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> 14 CEU credits which includes required<br />

subjects. A Grade H award is<br />

given for the completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> 28 CEU<br />

credits.<br />

Mere acquisiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a license from the<br />

Board <str<strong>on</strong>g>of</str<strong>on</strong>g> Registrati<strong>on</strong> does not make<br />

a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al even though some immediate<br />

resp<strong>on</strong>sibilities and privileges<br />

are created. Neither does a<br />

proclamati<strong>on</strong> by a group <str<strong>on</strong>g>of</str<strong>on</strong>g> licensees.<br />

Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al stature must, instead,<br />

be awarded by other pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>s, and<br />

by the public, as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

average licensed surveyor's c<strong>on</strong>duct,<br />

integrity, h<strong>on</strong>esty and superior<br />

knowledge in land surveying.<br />

To be sure, laws and courtrooms<br />

accord certain status to a surveyor<br />

up<strong>on</strong> receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> a license. Secti<strong>on</strong><br />

8761 <str<strong>on</strong>g>of</str<strong>on</strong>g> the California Land<br />

Surveyor's Act allows <strong>on</strong>ly a licensed<br />

land surveyor or registered civil<br />

engineer t6 take resp<strong>on</strong>sibiHty for<br />

survey maps, plats, descripti<strong>on</strong>s or<br />

other documentary evidence generated<br />

by practicing land surveying.<br />

Legal penalties are attached to unlicensed<br />

or unregistered pers<strong>on</strong>s who<br />

pretend to do, or <str<strong>on</strong>g>of</str<strong>on</strong>g>fer to do, land<br />

surveying. Courts recognize the<br />

Land Surveyor as a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al both<br />

as an "expert witness' and by holding<br />

the Land Surveyor resp<strong>on</strong>sible for<br />

exercising "average skill" and care.<br />

While these are pro<str<strong>on</strong>g>of</str<strong>on</strong>g>s <str<strong>on</strong>g>of</str<strong>on</strong>g> a standing<br />

different than that <str<strong>on</strong>g>of</str<strong>on</strong>g> a layman, it<br />

is not pro<str<strong>on</strong>g>of</str<strong>on</strong>g> that Land Surveyor's<br />

eminence is equal to the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> law, medicine and civil engineering.<br />

True pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al standing requires<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al acti<strong>on</strong>s, attitudes<br />

and behavior by the average practiti<strong>on</strong>er<br />

to earn pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al stature in<br />

eyes <str<strong>on</strong>g>of</str<strong>on</strong>g> others.<br />

One <str<strong>on</strong>g>of</str<strong>on</strong>g> the attributes <str<strong>on</strong>g>of</str<strong>on</strong>g> a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

is the abihty to work with people<br />

rather than with things. For surveyors,<br />

superior ability in use <str<strong>on</strong>g>of</str<strong>on</strong>g> instruments<br />

and measurement is necessary,<br />

but purely technical. A practicing<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al must, at least to a<br />

certain extent, desert his craft and<br />

learn to deal with people. Independent<br />

judgment and, with it, Hability, is<br />

the sphere <str<strong>on</strong>g>of</str<strong>on</strong>g> activity <str<strong>on</strong>g>of</str<strong>on</strong>g> the, pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al;<br />

his technical expertise is presumed.<br />

The layman seeks the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

for c<strong>on</strong>sultati<strong>on</strong> because <str<strong>on</strong>g>of</str<strong>on</strong>g> the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al's<br />

abiUty to use independent<br />

judgment to solve a problem. Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

Land Surveyors, in their practice,<br />

can really <str<strong>on</strong>g>of</str<strong>on</strong>g>fer nothing bey<strong>on</strong>d<br />

their opini<strong>on</strong>, derived after reviewing<br />

a certain set <str<strong>on</strong>g>of</str<strong>on</strong>g> facts. It is not <strong>on</strong>ly<br />

with this "opini<strong>on</strong>" that the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

shoulders resp<strong>on</strong>sibility but<br />

must also be able to persuade other<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>als to his way <str<strong>on</strong>g>of</str<strong>on</strong>g> thinking.<br />

Curtis Brown, in preface to the sec<strong>on</strong>d<br />

editi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> his book, "Boundary<br />

C<strong>on</strong>trol and Legal Principles", summarizes<br />

<strong>on</strong>e attribute <str<strong>on</strong>g>of</str<strong>on</strong>g> the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

by saying, "The aim <str<strong>on</strong>g>of</str<strong>on</strong>g> the surveyor<br />

is first to know and sec<strong>on</strong>d to<br />

appear to know. Appearing to know<br />

brings in the clients and knowing<br />

holds them."<br />

There are other attributes <str<strong>on</strong>g>of</str<strong>on</strong>g> a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong><br />

that surveyors must c<strong>on</strong>sider,<br />

such as public service and trust.<br />

The surveyor, while obligated to<br />

locate the cHent's property line, is<br />

also trusted, as a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al, by the<br />

adjoiner and the general public to<br />

locate the line to the best <str<strong>on</strong>g>of</str<strong>on</strong>g> his ability,<br />

based up<strong>on</strong> the facts <str<strong>on</strong>g>of</str<strong>on</strong>g> the case,<br />

and up<strong>on</strong> his pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al judgment,<br />

even if it may be to the disadvantage<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> his chent.<br />

The pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al surveyor's obligati<strong>on</strong><br />

to the client is limited to<br />

gathering all <str<strong>on</strong>g>of</str<strong>on</strong>g> the facts <str<strong>on</strong>g>of</str<strong>on</strong>g> the case,<br />

and applying experience, educati<strong>on</strong>,<br />

and judgment in deciding up<strong>on</strong> a<br />

course <str<strong>on</strong>g>of</str<strong>on</strong>g> acti<strong>on</strong> or in the soluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the problem. The obligati<strong>on</strong> does not<br />

permit distorti<strong>on</strong>, omissi<strong>on</strong> or fraud<br />

to allow a more satisfactory soluti<strong>on</strong><br />

for the chent.<br />

The pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al surveyor, it is<br />

clear, has an obligati<strong>on</strong> to both the<br />

client and to the pUbhc, if a positi<strong>on</strong>^^<br />

In additi<strong>on</strong>, every pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

Land Surveyor has an obligati<strong>on</strong> to<br />

every other pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al Land Surveyor.<br />

Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al stature for all<br />

surveyors is affected by individual<br />

acti<strong>on</strong>s. Hence, no surveyor should<br />

act in any way that will bring discredit<br />

to the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>. This includes<br />

and collective acti<strong>on</strong>s, that<br />

both their c<strong>on</strong>duct and service are<br />

truly pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al, that knowledges<br />

and skills are comparable with other<br />

practiti<strong>on</strong>ers, that they are h<strong>on</strong>est<br />

and impartial, and that surveyors'<br />

fees are reas<strong>on</strong>able for the services<br />

that in this country, where the law<br />

"LICENSING". Column <strong>on</strong>e, first<br />

paragraph <str<strong>on</strong>g>of</str<strong>on</strong>g> text asks: 1) What is<br />

BLM authority to resurvey federal<br />

land? (newly acquired or not),.2) If<br />

state law holds over federal law?<br />

Let's take No. 2 first: According to<br />

the C<strong>on</strong>stituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the United States<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> America (effective March 4, 1789)<br />

federal law reigns supreme, states<br />

sec<strong>on</strong>d and individuals third (amendments;<br />

Article X — ratified by threefourths<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the states Dec. 15, 1791).<br />

the <strong>on</strong>ly excepti<strong>on</strong>s are the "Bill <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Rights" otherwise known as the<br />

Amendments to the C<strong>on</strong>stituti<strong>on</strong>,<br />

(menti<strong>on</strong>ed above). So much for who<br />

holds over whom.<br />

About item No. 1 — If you read<br />

Title 43 <str<strong>on</strong>g>of</str<strong>on</strong>g> the U.S. Codes you will<br />

find that Article 2 describes the<br />

authority vested in the BLM which is<br />

created in Article 1. Access to records<br />

is provided in Article 13, al<strong>on</strong>g with<br />

the fact that a polite ph<strong>on</strong>e call yields<br />

the same effect, usually. (See also Articles<br />

38, 41, 42, & 45).<br />

Article 52 comes to the point at<br />

hand in its paragraph No. 1 — "Skillful<br />

Surveyors" begin the key to the<br />

whole issue. I'll return to this in a<br />

moment.<br />

Column 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> "Memorandum"<br />

recites Article 772 <str<strong>on</strong>g>of</str<strong>on</strong>g> 43USC and proports<br />

in the very next paragraph that<br />

individual rights — expressly stated<br />

— were not intended, but that States<br />

Rights were meant. HOW CAP-E<br />

HE! The author <str<strong>on</strong>g>of</str<strong>on</strong>g> that text is ob-,<br />

viously a b<strong>on</strong>afide nincompoop.<br />

With that said, let us return to<br />

"Skillful Surveyor". A note <str<strong>on</strong>g>of</str<strong>on</strong>g> interest<br />

is that there are 50 states (50<br />

ways <str<strong>on</strong>g>of</str<strong>on</strong>g> doing things) and <strong>on</strong>ly <strong>on</strong>e<br />

federal law — but few if any surveyors<br />

(state licensed) are truly that<br />

familiar with federal survey laws.<br />

Article 52 gives the Government<br />

the right to hire talent rather than<br />

play games with local fuddy-duddies.<br />

And so it should be.<br />

Before a state licensed lawyer may<br />

practice in federal court, he must<br />

pass the test and receive a feeral<br />

license — and so it perhaps should be<br />

for surveyors. BUT until the law is so<br />

enacted and/or until Article 52 is<br />

repealed, amended or otherwise<br />

changed, I suggest that to keep the<br />

m<strong>on</strong>ey in the local surveyor's pocket<br />

(as the memo desires), the local<br />

surveyor be satisfied to challenge the<br />

"SKILLFUL"ness <str<strong>on</strong>g>of</str<strong>on</strong>g> "Skillful Surveyor".<br />

The acquisiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a state-granted<br />

license does not c<strong>on</strong>fer godship up<strong>on</strong><br />

its recipient. It generally signifies<<br />

passage <str<strong>on</strong>g>of</str<strong>on</strong>g> MINIMAL ability.<br />

I prefer that the government be<br />

forced (through proper means) to<br />

aspire to the highest ideals and<br />

employ those truly good at their pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong><br />

— licensed or not. Because in<br />

the future we will all benefit.<br />

THE EDM WITH A VOICE<br />

Geodimeter 122, "The EDM with a<br />

Voice,*' uses the measuring light beam<br />

to carry the operator's instructi<strong>on</strong>s to<br />

the rodpers<strong>on</strong>.<br />

The instrument has all the capabilities<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the machine it replaces, Geodimeter<br />

120, plus these new features:<br />

Unicom, the built-in <strong>on</strong>e-way voice<br />

communicati<strong>on</strong>; Track-Light (which<br />

allows the rodpers<strong>on</strong> to stay virtually<br />

<strong>on</strong> line), high precisi<strong>on</strong> mode (arithmetic<br />

mean readings down to 0.0001<br />

meter), increased range (2.2 miles to a<br />

triple prism) and improved vertical<br />

angle sensor accuracy. Like Geodimeter<br />

120, it features data recording<br />
