7.4 Examination discipline<br />

7.4.1 When an apparent irregularity or act <strong>of</strong><br />

misconduct is observed in an examination<br />

room, the student will be informed<br />

immediately by the Examination Supervisor<br />

that the Examination Supervisor believes<br />

the student is in breach <strong>of</strong> the examination<br />

procedures. The student will be permitted<br />

to finish the examination paper.<br />

Immediately the alleged breach is<br />

discovered the Examinations Officer will<br />

report the circumstances to the Chief<br />

Examiner, the Subject Convener and the<br />

Heads <strong>of</strong> the appropriate Schools.<br />

7.4.2 If the alleged irregularity involves the use <strong>of</strong><br />

unauthorised material the Examination<br />

Supervisor will take possession <strong>of</strong> such<br />

material. The material will be retained by<br />

the Academic Registrar until such time as<br />

an investigation or appeal (as set out<br />

below) is completed.<br />

7.4.3 The Chief Examiner will assess whether or<br />

not there is prima facie evidence to suggest<br />

there has been an irregularity. If it is the<br />

belief <strong>of</strong> the Chief Examiner that there may<br />

have been an irregularity a meeting <strong>of</strong> the<br />

Examination Conduct Committee will be<br />

convened to investigate the matter.<br />

7.5 Notice <strong>of</strong> meeting<br />

7.5.1 The student(s) concerned must, within<br />

three working days <strong>of</strong> the Chief Examiner's<br />

decision to convene a meeting <strong>of</strong> the<br />

Examination Conduct Committee, be<br />

notified by the Examinations Officer <strong>of</strong> the<br />

meeting.<br />

7.5.2 This notification will be in the form <strong>of</strong> a<br />

prepared statement into which the<br />

Examinations Officer inserts the relevant<br />

details for each student.<br />

The notice must contain the following:<br />

the date, time and venue <strong>of</strong> the<br />

examination at which the alleged breach<br />

occurred;<br />

the subject code and name <strong>of</strong> the<br />

examination;<br />

the student's name and ID number;<br />

the nature <strong>of</strong> the alleged breach;<br />

the date and time <strong>of</strong> the Examination<br />

Conduct Committee meeting;<br />

a description <strong>of</strong> where the student may<br />

get assistance in terms <strong>of</strong> preparing their<br />

case, including the name and telephone<br />

number <strong>of</strong> the Student Union Advocate;<br />

a description <strong>of</strong> how the student may<br />

respond to the allegation;<br />

information to the student that s/he has<br />

five working days from the date <strong>of</strong> the<br />

notice <strong>of</strong> the alleged breach to respond;<br />

informs the student that s/he may present<br />

any evidence or call such others relevant<br />

to the case which s/he may present to the<br />

committee.<br />

7.5.3 The meeting will be held as expeditiously<br />

as possible but not later than five working<br />

days from the date <strong>of</strong> the notice.<br />

7.6 Examination Conduct Committee<br />

7.6.1 The Examination Conduct Committee shall<br />

consist <strong>of</strong>:<br />

a) the Head <strong>of</strong> the awarding Division<br />

(Chair), or nominee<br />

b) the Head <strong>of</strong> the School;<br />

c) the Subject Convener;<br />

d) the President <strong>of</strong> the Student Union, or<br />

nominee.The Examinations Officer (or<br />

other nominee <strong>of</strong> the Registrar) will be<br />

present at the meeting to act as<br />

Secretary and record the decisions.<br />

The student concerned may be<br />

represented by an advocate, both <strong>of</strong><br />

whom may address the Committee and<br />

provide such information or call such<br />

othersas the Committee may agree. The<br />

advocate may not be a member <strong>of</strong> the<br />

Committee.<br />

7.6.2 Powers <strong>of</strong> the Examinations Conduct<br />

Committee<br />

If the Committee as convened according to<br />

sections 7.6 and 7.6.1 is <strong>of</strong> the view by a<br />

majority vote that an irregularity has<br />

occurred, the Committee may, taking into<br />

account the seriousness <strong>of</strong> the occurrence<br />

and circumstances, decide:<br />

a) to take no action;<br />

b) to reprimand the student;<br />

c) that particular questions in the<br />

examination paper be not marked;<br />

d) that the examination paper be<br />

cancelled;<br />

e) that the paper for the examination in<br />

question be not marked and a fail result<br />

be recorded;<br />

f) to suspend the student from the<br />

<strong>University</strong> for a period <strong>of</strong> time (up to<br />

two semesters);<br />

g) that the student be suspended from<br />

further study from the course for a<br />

maximum <strong>of</strong> two years;<br />

h) that the student be excluded from<br />

further study in the course. Such<br />

students wishing to re-enter, may apply<br />

for re-admission to the course after a<br />

minimum <strong>of</strong> two years; or,<br />

i) to recommend to the Vice-Chancellor<br />

that the student be excluded from<br />

further study in the <strong>University</strong>. Such<br />

students wishing to re-enter, may apply<br />

for re-admission to the university after<br />

the period <strong>of</strong> exclusion.
