Content<br />
Sources of law, problems with the law, the tiers of<br />
Australian Government Commonwealth, State, Local<br />
Government. The Parliamentary Process. Constitutional<br />
constraints affecting environmental and public health<br />
legislation.<br />
Delegated legislation:<br />
- relevance to environmental health officers,<br />
- advantages and disadvantages,<br />
- reviewing through Parliament and the courts.<br />
The Australian court system, court personnel and tribunals<br />
with specialised jurisdictions.<br />
The civil and criminal trial process.<br />
Judges as a source of law - precedent and legal reasoning.<br />
Case studies of particular relevance will be examined<br />
negligence (consumer protection); nuisance (environmental<br />
controls); and strict liability (hazardous materials).<br />
Judges as a source of law - the main judicial approaches to<br />
statutory interpretation (plain meaning or policy), the<br />
context of words in a statute, the audience, the purpose.<br />
Particular rules; meanings limited to class or association,<br />
gaps in a statute, inconsistent provisions, conflict with<br />
property rights, penal provisions.<br />

This is a second year subject of the Bachelor of Applied<br />
Science (Environmental Health)<br />
Content<br />
Legislation relevant to the environmental health officer<br />
in local government the Health Act, enabling legal<br />
provisions, e.g. nuisance, infectious disease, building,<br />
accommodation, incidental controls;<br />
* the Food Act - controls on food premises, preparation<br />
and sale of food, etc. Warranties, third party procedure,<br />
defence of reasonable precautions. Provisions with<br />
respect to prosecution;<br />
incidental powers and controls by virtue of the Local<br />
Government Act will also be considered;<br />
legislation relevant to the environmexital health officer<br />
in state government authorities;<br />
Health Department -in addition to the Health Act and<br />
the Food Act, further relevant legislation with respect to<br />
drugs and health services will be considered;<br />
Environment Protection Authority. Consideration of<br />
the Environment Protection Act, state environment<br />
protection policies and regulations thereunder;<br />
relevant judgements on the application/interpretation of<br />
the legislation will be studied.<br />
