Objectives and Content<br />

The general objective is to assess the impact of law upon the<br />

relationship of employer and employee. The following<br />

matters are analysed in this subject:<br />

the contract of employment - formation of the contract<br />

of employment including discrimination and<br />

compulsory unionism, distinguishing an employee from<br />

an independent contractor, the terms of the contract of<br />

employment, common law remedies for wrongful<br />

termination:<br />

the arbitration system - the structure of the Australian<br />

Arbitration System, the constitutional context, the<br />

system in operation in settling disputes and making<br />

awards, enterprise bargaining;<br />

industrial conflict - penal powers under the arbitration<br />

system, deregistration, common law liabiIi ty for<br />

industrial action, statutory liability for industrial action;<br />

the Victorian Employee Relations Act.<br />
