In 2008, the board issued its first advisory opinions, including<br />
those regarding:<br />
• <strong>The</strong> employment <strong>of</strong> lawyers and non-lawyers by unions<br />
to assist local bargaining units during public sector<br />
collective bargaining and labor grievance arbitrations<br />
(February).<br />
• Non-attorneys completing mortgage forms<br />
(December).<br />
• Non-attorneys preparing legal documents through an<br />
online legal document service (December).<br />
Commission on Certification<br />
<strong>of</strong> Attorneys as Specialists<br />
In 1993, the <strong>Supreme</strong> <strong>Court</strong> adopted a rule establishing a<br />
process for identifying attorneys who meet minimum standards<br />
for certification as specialists in certain fields <strong>of</strong> legal practice.<br />
Because many lawyers advertise their services, attorney specialty<br />
certification is an effort to balance the advertising with ethical<br />
and pr<strong>of</strong>essionalism requirements set forth by the <strong>Supreme</strong><br />
<strong>Court</strong>. Standards established under Gov. Bar R. XIV are<br />
intended to assist the public by enhancing access to quality<br />
legal services.<br />
<strong>The</strong> Commission on Certification <strong>of</strong> Attorneys as Specialists<br />
asked the <strong>Supreme</strong> <strong>Court</strong> to approve Social Security disability<br />
law as a field subject to specialization designation. <strong>The</strong> <strong>Court</strong><br />
approved this area <strong>of</strong> specialization in 2008.<br />
Committee on the Appointment <strong>of</strong> Counsel<br />
for Indigent Defendants in Capital Cases<br />
<strong>The</strong> Committee on the Appointment <strong>of</strong> Counsel for Indigent<br />
Defendants in Capital Cases administers the requirements <strong>of</strong><br />
Sup.R. 20, including the certification <strong>of</strong> attorneys eligible to be<br />
appointed to represent indigent capital defendants.<br />
In 2008, the committee submitted its sixth Report <strong>of</strong> the<br />
Committee on the Appointment <strong>of</strong> Counsel for Indigent Defendants in<br />
Capital Cases, which highlighted the committee’s work from<br />
2003 to 2007. <strong>The</strong> committee also worked on amendments to<br />
Sup.R. 20, “Appointment <strong>of</strong> Counsel for Indigent Defendants<br />
in Capital Cases,” which incorporate ABA Guidelines for the<br />
Appointment and Performance <strong>of</strong> Defense Counsel in Death<br />
Penalty Cases.<br />
