<strong>Ohio</strong> Criminal Sentencing Commission<br />
<strong>The</strong> <strong>Ohio</strong> Criminal Sentencing Commission was created by<br />
statute in 1990. Chaired by Chief Justice Moyer, the commission<br />
reviews <strong>Ohio</strong>’s sentencing statutes and sentencing patterns, and<br />
recommends necessary statutory changes. <strong>The</strong> commission has<br />
31 members, 10 <strong>of</strong> whom are judges appointed by the Chief<br />
Justice.<br />
During 2008, the <strong>Ohio</strong> Criminal Sentencing Commission and<br />
its Criminal Sentencing Advisory Committee continued to meet<br />
and work in tandem on proposals for the General Assembly<br />
and other criminal sentencing matters. Major topics included<br />
simplifying the felony and misdemeanor sentencing statutes,<br />
culpable mental states after the <strong>Court</strong>’s decisions in the <strong>State</strong><br />
v. Colon cases, and a survey <strong>of</strong> judges, prosecutors and defense<br />
attorneys regarding felony sentencing laws.<br />
<strong>The</strong> commission also continued a major project, begun in<br />
2007, <strong>of</strong> streamlining the criminal code. <strong>The</strong> goal is to make<br />
the code more workable for criminal justice practitioners —<br />
including judges, prosecutors and defenders — and to produce<br />
a code that is easily understood by the defendants and victims<br />
directly affected by it.<br />
In light <strong>of</strong> significant changes to the felony sentencing<br />
statutes originally adopted at the commission’s behest in<br />
1996, the commission also surveyed common pleas judges,<br />
prosecuting attorneys and the defense bar to gauge the viability<br />
<strong>of</strong> those statutes. <strong>The</strong> results will be reported to the General<br />
Assembly early in 2009.<br />
Further, the staff continued in 2008 to provide training<br />
materials for the commission’s comprehensive 2007 rewrite<br />
<strong>of</strong> <strong>Ohio</strong> laws governing the forfeiture <strong>of</strong> assets linked to<br />
racketeering, drug <strong>of</strong>fenses and gang activity. <strong>The</strong> commission<br />
continued to monitor and discuss the state’s prison crowding<br />
situation as well.<br />
