advisory opinions.<br />

In addition to advisory opinions, Ruth B. Dangel, staff<br />

counsel, issued 16 staff letters addressing various ethical issues<br />

during the year. <strong>The</strong> board’s legal staff responded to more than<br />

1,800 telephone inquiries from judges, lawyers, reporters and<br />

members <strong>of</strong> the public regarding ethics, lawyer discipline and<br />

judicial-campaign conduct issues.<br />

Clients’ Security Fund<br />

<strong>The</strong> Clients’ Security Fund was established in 1985 by<br />

the <strong>Supreme</strong> <strong>Court</strong> to reimburse clients who lose money<br />

or property as a result <strong>of</strong> the dishonest conduct <strong>of</strong> an <strong>Ohio</strong><br />

attorney. <strong>The</strong> fund receives its funding from attorneyregistration<br />

fees paid by licensed <strong>Ohio</strong> attorneys.<br />

<strong>The</strong> <strong>Court</strong> appoints a seven-member board <strong>of</strong> commissioners,<br />

which meets in March, June, September and December, to<br />

determine the eligibility <strong>of</strong> claims for reimbursement.<br />

Claims are initiated by the completion <strong>of</strong> an application for<br />

reimbursement. <strong>The</strong> allegations contained in the applications<br />

are investigated first by the Clients’ Security Fund staff.<br />

To be eligible for reimbursement from the Clients’ Security<br />

Fund, a claimant must meet the requirements set forth in Gov.<br />

Bar R. VIII. <strong>The</strong> fund does not reimburse losses resulting from<br />

negligence, malpractice or fee disputes.<br />

During fiscal year 2008, the Clients’ Security Fund received<br />

288 applications for reimbursement. In all, 92 applications<br />

were dismissed. <strong>The</strong> board <strong>of</strong> commissioners reviewed 145<br />

applications and determined 117 claims were eligible for<br />

reimbursement and 27 claims were ineligible. <strong>The</strong> board<br />

reimbursed 117 eligible claimants $743,932. Forty-seven<br />

attorneys were found to have engaged in dishonest conduct<br />

resulting in losses <strong>of</strong> money or property to their clients.<br />

During 2008, the board <strong>of</strong> commissioners and the<br />

Commission on Pr<strong>of</strong>essionalism obtained <strong>Supreme</strong> <strong>Court</strong><br />

approval to publish for public comment a draft <strong>of</strong> A Consumer’s<br />

Practical Guide to Managing a Relationship with a Lawyer. Once<br />

published, the guide will be distributed statewide to help the<br />

public understand the lawyer-client relationship.<br />
