town centre crash

THE controversial decision by Warwickshire 

Police not to prosecute following an 

horrific crash in Stratford in which seven 

people were injured is being reviewed on 

the orders of the new police and crime commissioner. 

Ron Ball, who was elected as Warwickshire’s 

police commissioner less than three weeks ago, 

has decided to intervene because of mounting 

public concern over the decision. 

Last week the Herald 

exclusively reported that the 

police were not pursuing a 

prosecution because there 

was “insufficient evidence.” 

Seven people were injured 

shortly after 2.30pm on 23rd 

April when a car driven by 

Alan Marks MBE, from 

Shottery, mounted the pavement 

by Costa Coffee after 

failing to negotiate the 

Market Cross roundabout. 

The car ploughed in to pedestrians 

and coffee drinkers. 

Six people, including Mr 

Marks himself, were taken to 

hospital. One of the injured, 

Heather Coleau from Chipping 

Campden, sustained 

brain injuries which she said 

had changed her life. 

Last week Mrs Coleau— 

who spent a month in hospital 

with brain injuries and a 

fractured skull and has not 

worked since—said that she 

was bitterly disappointed to 

discover that no-one was 

being charged as a result of 

the crash. 

Announcing the action he 

had taken on Friday, the day 

after the report in the Herald, 

Mr Ball said: “I have asked 

for a review of the decision. 

It is actually an operational 

matter, which is strictly not 

my remit, but there is clearly 

a public interest element to 

what has happened here. I 

have asked them to go back 

and look at it again and report 

back to me.”

Three hurt as cars 

collide on A3400

A WOMAN broke both her legs and a man suffered 

serious internal injuries in a two-car crash on the 

A3400 near Long Compton on Thursday night. 

Ambulance and police were called to the scene just 

after 7pm, where they found three people injured, two 

of them trapped. Firefighters were called to cut a man 

and woman, both in their 20s, from a car. 

A West Midlands Ambulance Service spokesperson 

said: “The driver from the first car, a man in his 40s, 

was treated for minor injuries at the scene before 

being conveyed to the John Radcliffe Hospital in 

Oxford for further assessment and treatment. Two 

occupants were found trapped in the second car. The 

first casualty, a man believed to be in his 20s, was 

trapped for a short period of time. Once freed, he was 

treated for neck and back pain and multiple lacerations. 

The man was fully immobilised and was also 

conveyed to the John Radcliffe Hospital. 

“The second occupant, a woman in her 20’s, was 

trapped for nearly an hour. Ambulance and fire crews 

worked together to extricate the woman from the 

vehicle. Ambulance crews treated the woman for 

serious multiple injuries to her legs, pelvis, back and 

head. The woman was fully immobilised and taken to 

the same hospital for further treatment.” 

Police confirmed the woman suffered two broken 

femurs as well as a broken pelvis. The crash involved 

a red Vauxhall Corsa and a silver Ford Focus. Police 

closed the A3400 for most of the night. 

MP presses for 

M40 junction 

improvements 

KENILWORTH and Southam MP Jeremy Wright 

has high hopes that his months of lobbying have 

persuaded the government to fund urgent improvements 

to the M40 junction at Gaydon. 

Congestion at Junction 12, which is used by thousands 

of employees travelling to and from the 

nearby Jaguar Land Rover (JLR) and Aston Martin 

(AML) sites, often results in dangerous tailbacks of 

more than a mile along the M40 and similar holdups 

on the B4100. 

Mr Wright, whose constituency covers Gaydon, 

said: “I have been in discussion with the Departments 

of Transport and Business, Innovation and 

Skills for several months expressing, in the strongest 

possible terms, the significance of this junction to 

the local economy and the urgent need to tackle the 

problem. Both JLR and AML wish to expand and 

already have planning permission to provide facilities 

which will accommodate an additional 2,600 

jobs. Without substantial alteration to the road network, 

such expansion will only worsen the dangerous 

congestion problems. Warwickshire County 

Council have applied for funding for a scheme 

which will deal with the problem now and in the 

future and I am hopeful that the Minister for Roads 

will reach a positive decision in the near future.”

THE Ministry of Defence has confirmed it will not save the 2nd Battalion 

The Royal Regiment of Fusiliers despite hundreds of ex-servicemen 

marching on the Houses of Parliament in protest earlier this autumn. 

In a letter to Cllr Michael istry of Defence confirmed 

Doody, leader of Warwick the decision to remove the 

District Council, the Min-

been overturned.

Tesco to top up 

foodbank collections 

A FOOD collection took place at Tesco 

in Stratford over the weekend, 

designed to provide supplies for a foodbank 

in the town in 2013. 

The Stratford Tesco branch and the 

Trussell Trust network of foodbanks 

were collecting food donations at Tesco 

on Birmingham Road on Saturday and 

Sunday. 

They were hoping to collect three 

tonnes of supplies from public donations. 

Alexandra Holmes, project manager 

of the forthcoming Stratford foodbank, 

said: “Increasing numbers of 

people are struggling to make ends 

meet in the current economic climate. 

Times are tough for many local people 

so Stratford Foodbank is delighted to 

be part of Tesco’s ‘Help Feed People in 

Need’ appeal. We’re hoping that many 

local people will donate at a Tesco store 

to help stop people going hungry in 

Stratford.” 

Tesco will be topping up total donations 

by 30 per cent and will also be 

providing funding to both the Trussell 

Trust and the Stratford foodbank to 

help them build on the work they do. 

Alexandra told the Midweek Herald 

that the location of the foodbank had 

not been decided yet.

published this week, looks

Avon flooding

THE play area and sports pitches on Stratford Recreation 

Ground will remain closed for another week because of 

standing water following the floods. 

An inspection and full clean-up operation will take place 

this week involving a jet wash and disinfection of the play 

equipment, as well as replacing sand in the sand area. 

Yesterday (Monday), Stratford District Council estimated 

the play area would remain closed for a further seven 

days while this work is completed. Although the flooding 

may have subsided there is still standing water in the area 

and the playground will remain closed until this has 

receded. 

The Royal Society for the Prevention of Accidents 

(RoSPA) are inspecting the equipment to make sure none 

of it has been affected by the flood waters. 

The council apologised for any inconvenience. For further

Crews tackle shed blaze 

A FIRE took hold of the inside of a large concrete shed in 

Norton Lindsey on Friday night. 

Two fire engines, one from Henley, and one from Leamington, 

were called to Lowerhouse Farm at 10.30pm to 

tackle the fire in the building. Firefighters were on the 

scene for around one hour.

Amnesty brings Write to Rights campaign to town

International Group will be in the 

Corn Market in the town this Saturday 

to promote the annual Write for 

Rights campaign in which members of 

the public are invited to sign cards

STRATFORD mum Kate Tonner understands 

more than most the importance of diagnosing 

cancer early. 

The 32-year-old used to 

avoid smear tests because 

she found them embarrassing. 

But Kate has now spoken 

out after a recent survey of 

adults in the West Midlands 

found that partners play a 

huge role urging their loved 

ones to visit a GP when they 

have health concerns, and it 

was Kate’s husband Ian who 

persuaded her to visit the 

doctor. 

Since being told she had 

cervical cancer two years 

ago, Kate’s been on a mission 

to promote the importance 

of early diagnosis. 

Regret 

“The one thing that fills 

me with regret is that I didn’t 

go to the doctor sooner with 

my symptoms,” she said. 

“I’d been bleeding 

between my periods for 

nearly a year before I mentioned 

it, and I always 

avoided my smear tests. 

Eventually I spoke to my 

husband and he persuaded 

me to go to the GP. 

“Now I tell all my friends 

to go for their smear tests, 

and to go to the doctor and 

get any unusual symptoms 

checked out. An early diagnosis 

can make all the difference.” 

Twelve months ago Kate 

discovered just how true that 

statement was when doctors 

revealed that her cancer had 

spread to her lymph nodes. 

“If I hadn’t been so 

embarrassed and so afraid of 

what the doctor might say, 

my cancer might have been 

discovered before it spread,” 

said Kate, who has now 

retired from her job as a 

police community support 

officer to become a full-time 

mum to eight-year-old

“We were gobsmacked. 

After four months of radiotherapy 

and chemotherapy, 

we had just had the elation 

of being told the cancer had 

gone. Then I went for a Pet 

scan and we got this terrible 

news. It looked desperate.” 

Kate was told she could 

have treatment to shrink the 

cancer and prolong her life, 

but that a cure was not possible. 

She and fiancé Ian were 

advised to bring forward 

their planned wedding and 

they married in December 

last year with Grace as a 

bridesmaid. 

Kate was due to have 

chemotherapy in January 

2012 but radiotherapy 

proved so successful that she 

has not needed any further 

treatment. The cancer is still 

there, but it is small and so 

far MRI scans every few 

months have shown that it is 

not growing. 

“I was distraught when I 

found out my cancer 

couldn’t be cured, but I have 

come to terms with things 

better than I ever thought I 

could,” said Kate. 

“None of us know how 

long we have to live, so our 

job is just to get on with 

living the best, healthiest life 

possible while we’re here to 

enjoy it. 

“Now I tell all my friends 

to go for their smear tests, 

and to go to the doctor and 

get any unusual symptoms 

checked out. An early diagnosis 

can make all the difference.” 

A WARWICK man has been charged after allegedly 

assaulting a person on Monday last week while trying to 

steal something from their car. 

Shane Parker, aged 25, from Kilnsey Grove, was charged 

with assault, going equipped for theft, theft from two vehicles, 

and receiving stolen goods. He was arrested following 

the incident in Vicarage Fields, Warwick, at 9.40pm and 

remanded in custody by magistrates in Leamington.

may also prompt authorities into 

granting justice.

Orders for insertion of advertisements in the 

Midweek are accepted subject to the following 

conditions: 

(1) The placing of an order constitutes an 

assurance that the advertisement is legal, 

decent, honest and truthful complying with 

the British Codes of Advertising and Sales 

Promotion, with any relevant codes of 

practice and with the requirements of 

current legislation. 

(2) Advertisement orders are issued by an 

advertising agency as a principal and must 

be on the agency’s official form. When 

copy instructions not constituting an 

official order are used, they shall be clearly 

marked “Copy instructions - not an order.” 

(3) The advertiser/advertising agency agrees to 

indemnify the publisher in respect of all 

costs, damages, or other charges falling

actions or threatened legal actions arising

publisher does not guarantee the insertion

(5) (i) In the event of any error, misprint or 

omission in the printing of an

either re-insert the advertisement or 

relevant part of the advertisement as 

the case may be or make a 

reasonable refund of or adjustment to 

the cost. No re-insertion, refund or 

adjustment will be made where the 

error, misprint or omission does not 

materially detract from the

(ii) In no circumstances shall the total 

liability of the publisher for any 

error, misprint or omission exceed 

(a) the amount of a full refund of 

any price paid to the publisher for 

the advertisement in connection with 

which liability arose or (b) the cost 

of a further or corrective 

advertisement of a type and standard 

reasonably comparable to that in 

connection with which liability 

arose. 

(iii) It is the responsibility of the 

advertiser/advertising agency to 

check the first insertion of any series 

of advertisements and notify the 

publisher immediately of any errors. 

The publisher assumes no 

responsibility for the repetition of 

errors unless notified by the

The publisher shall not be liable for 

any loss or damage occasioned by 

any total or partial failure (however 

caused) of publication or distribution

giving reasonable notice before the 

next insertion, but in that event the

(7) An advertising agency may cancel any 

unexpired part of any order without penalty 

in the event of the death or failure of its 

client. 

(8) (i) The copyright for all purposes in all 

artwork, copy and other material 

which the publisher or its employees 

have originated, contributed to or 

reworked shall vest in the publisher. 

(ii) 

The publisher is hereby authorised to 

record, reproduce, publish, distribute 

and broadcast (or to permit the same) 

all advertisements (including but not 

limited to text, artwork and 

photographs) and to include and 

make them available in any 

information service, electronic or 

otherwise. 

(9) The placing of an order by an advertiser, or 

an advertising agency on behalf of a client, 

constitutes an assurance that all necessary 

authority and permission has been secured 

in respect of the use in the advertisement(s) 

of pictorial representations of (or 

purporting to be of) living persons, and of 

references to the words attributed to living 

persons. 

(10) The advertiser’s artwork, film and all other 

property is held at the advertiser’s risk and 

should be insured by him against loss or 

damage from whatever cause. The 

publisher reserves the right to destroy 

without notice all artwork, film and other 

property which has been in his custody for 

six months from the date of its last 

appearance in an advertisement unless the 

advertiser has given instructions to the 

contrary. 

(11) Notice of cancellation will not be accepted 

by telephone. 

(12) (i) Every endeavour will be made to 

forward replies to box numbers to 

the advertiser as soon as possible 

after receipt by the publisher, but the 

publisher accepts no liability in 

respect of any loss or damage 

alleged to have arisen through delay 

in forwarding or omitting to forward 

such replies (howsoever caused). The 

advertiser authorises the publisher to 

return to its originator any 

communication which, in the opinion 

of the publisher, should not be 

delivered to the advertiser.

Box numbers are open for the receipt 

of bona-fide answers only and are 

not available for the distribution of 

trade canvassing matter. Original 

testimonials, goods, cash, stamps or 

payment of any kind must not be 

enclosed. 

The newspaper reserves the right to 

disclose the name and address of 

advertisers and/or agencies to the 

police, trading standards officials or 

any other relevant authority and, 

where the publisher in its sole 

discretion deems it reasonable, to
