Fatal fire: ‘It’s the 

taxpayer who will 

be loser’ – judge

THE judge who has been presiding at 

legal proceedings following the fatal 

Atherstone-on-Stour warehouse fire in 

2007 has warned that the taxpayer will be 

the loser. 

Mr Justice MacDuff was commenting on the 

possible outcome of a sentencing hearing, fixed 

for December, regarding Warwickshire County 

Council’s admission that it failed to ensure safety 

at work. 

The judge has already 

presided over the trial at 

Stafford Crown Court— 

which concluded at the end 

of May after seven weeks— 

at which three fire managers 

were acquitted of 

manslaughter by gross negligence. 

The men had been 

charged after a £4.6 million 

police investigation into the 

blaze that took the lives of 

four firefighters. 

In a directional hearing at 

the Royal Courts of Justice in 

London last week, Mr Justice 

MacDuff declared: “Sentencing 

a corporation is 

fraught with difficulty. For 

these offences there can only 

be a financial penalty. There 

is no person to imprison or to 

send to do community 

service. 

“So there is a financial 

penalty imposed on the corporation 

for corporate failings—and 

people who were 

not responsible will suffer. 

Nevertheless, the law provides 

for heavy penalties 

where circumstances demand 

it; where the corporation is 

privately owned, sentencing 

policy recognises that shareholders 

must ultimately 

shoulder the burden. 

“But in this case there are 

no shareholders, only taxpayers. 

And here is the crux. 

The prosecution is funded by 

the taxpayer, the defendant 

likewise. Any fine, small, 

large or in between, will be 

paid out of the defendant’s 

budget. It will pass from one 

public fund to another. 

“Any order for costs, consequent 

upon my findings, 

will leave one public fund to 

be paid to another. The sentence 

is all about whether a 

large or small amount should 

be paid in fines and costs 

from A to B where both A 

and B are public funds which 

rely entirely upon local or 

national taxation or both. 

“And to make that determination, 

another large

Trust, which runs Warwick, 

Stratford and Shipston hospitals, 

announced the winners of the annual 

amount of public money will 

be spent upon expensive 

lawyers and experts over several 

days, tying up a judge 

and a court room—not to 

mention court staff and overheads 

for the same period. In 

the final analysis, it will cost 

the taxpayer another huge 

sum of money—on top of 

that already spent—to decide 

which of two highly pressurised 

public funds should 

be depleted. 

“The loser in all this will be 

the taxpayer. This case has 

already cost the taxpayer a 

huge sum of money. The taxpayer 

is going to have to 

transfer a sum of money, large 

or small, from one of his 

pockets to another. He might 

question the purpose of transferring 

money from one 

public fund (pocket) to 

another. He might further 

question the point of doing so, 

if a substantial additional premium 

in legal and experts’ 

fees is to be charged to enable 

the transfer to be made. 

“I would ask the parties to 

reflect upon this and to consider 

what directions they 

wish me to make for the sentencing 

hearing which will 

taken place later this year.” 

Yesterday (Monday) a 

spokesman for Warwickshire 

County Council told the 

Herald: “As the judge 

explains, the prosecution 

alleges various failings, some

of which we accept and some 

of which we deny. Four of 

our firefighters died in this 

tragedy and we and everyone 

involved take this case very 

seriously. 

“If an agreement with the 

prosecution on important 

issues cannot be reached, it 

will be necessary for the 

judge to hear evidence and 

make up his own mind on the 

facts before deciding on the 

sentence. 

“That is why the court has 

set aside up to two weeks in 

December—although we 

will continue to do whatever 

we can to make the hearing 

much shorter than that. 

“We are every bit as concerned 

as the judge is that 

any further expenditure to the 

taxpayer is kept to a minimum 

and we are doing our 

best to avoid any additional 

costs to the public purse.” 

Man found dead at 

GlobalGathering 

POLICE are investigating the death of a 24-year-old man 

at the GlobalGathering festival on Saturday. 

Paramedics were called after the man was found unconscious 

in a tent on the Long Marston Airfield site. However, 

despite attempts to save him, he was declared dead at 

4.40pm. The death is currently being treated as “unexplained” 

and a post mortem examination will be carried 

out.

‘Rattling’ 

junctions 

dealt with 

REMEDIAL work on two Warwick town centre 

streets began yesterday (Monday) to deal with the 

new “rattling” raised junctions, reports Rebekah 

Smith. 

The installation of the traffic-calming measures in 

High Street and Jury Street has led to irritation for 

motorists and resolving the “technical design issue” 

means drivers face a fortnight of further disruption. 

A spokesperson for Warwickshire County Council 

said: “The pattern of the blocks which have been laid 

on the raised parts of the road have not settled as well 

as we expected, resulting in a rattling noise when 

being driven over.” 

The issue is believed to have been caused by a 

number of factors, including the way in which the 

blocks were laid, the mortar bed the surface was laid 

on, and the weather during the construction. 

Contractors will be on site until Friday 10th 

August re-laying the blocks with tarmac as a temporary 

measure. The council will remove the tarmac 

areas and lay a herringbone pattern of bricks in January 

next year as a permanent solution. 

Monica Fogarty, the council’s strategic director for 

communities, said: “I apologise that we did not get it 

right first time and that we are having to come back 

to do remedial works. We have to balance the needs 

of residents’ concerns regarding noise and nuisance, 

with the further disruption this will cause to businesses.” 

According to Ms Fogarty, evidence from a recent 

video survey indicates the raised junctions have been 

successful in reducing vehicle speeds and helping 

pedestrians to cross High Street and Jury Street.

Suspects are 

arrested after 

police chase 

POLICE gave chase to two suspected burglars 

after a gaming machine was stolen from a Longbridge 

pub. 

A 21-year-old man from 

the Stratford area and a 

Warwick man, aged 26, 

were later arrested on suspicion 

of burglary and found 

to have been travelling in a 

stolen car. 

Police were alerted to the 

burglary at the Porridge Pot, 

in Stratford Road, when the 

pub’s alarm sounded at 

3.05am on Friday 27th July. 

Officers arrived and followed 

a white Ford Fiesta, 

later found to be stolen, that 

they believed was acting 

suspiciously nearby. 

Arrested 

A police spokeswoman 

said: “The vehicle stopped 

and two people ran off from 

the vehicle. The 21-year-old 

male from the Stratford area 

was arrested after a short 

foot chase. 

“The 26-year-old male 

from Warwick was arrested 

sometime later in the rear 

garden of a property on 

Stratford Road.” 

Police recovered a ‘Cops 

and Robbers’ gaming 

machine that had been abandoned 

near roadworks outside 

121 Stratford Road. 

The Ford Fiesta was also 

recovered by officers, who 

discovered it had been 

stolen from Priory Road, in 

Kenilworth, sometime 

between 10pm on Thursday 

26th July and the time of the 

theft.

the burglary at the Porridge 

Pot or the theft of a white 

Ford Fiesta from Kenilworth

Mis-sold land: 

firms ordered 

into liquidations 

EXCEPTIONAL DISCOUNTS OF UP TO 40%! 

TWO related companies that mis-sold land to the 

public to the tune of £3.2 million, including land at 

Hatton, near Warwick, have been ordered into 

liquidation. 

Berkeley Warbeck Ltd 

and its successor, Dentam 

Frost Ltd, both sold plots of 

undeveloped land for 

investment. 

Investors were persuaded 

to part with millions of 

pounds for land on the basis 

that planning permission 

was likely to be granted 

resulting in a substantial 

increase in value within two 

to three years. 

Green belt 

In reality, there was no 

likelihood of planning permission 

being granted to 

add value to the plots of 

land which were located in 

the green belt area and subject 

to restrictions on development. 

The High Court heard 

how three individuals, 

Michael Bohdjalian, Dylan 

Creaven, and Chris Newhouse 

benefitted from the 

unscrupulous trading, 

although they were not formally 

appointed as directors 

of either company. 

Mr Bhodjalian and Mr 

Creaven were paid 

£539,778 and £365,328 

respectively and Mr Newhouse, 

described as head of 

UK trading, received 

£163,453. Additionally, 

there were unexplained cash 

withdrawals of some 

£181,295. 

Company investigations 

supervisor Chris Mayhew 

said: “The public needs to

Go-ahead for 

‘blot on the 

landscape’ 


CONTROVERSIAL plans to replace a bungalow 

in Stratford with a three-storey contemporary 

building were given the go-ahead last week, 

despite objections from residents and the mayor. 

Stratford District Council 

received over 80 letters of 

objection, but a planning 

committee voted unanimously 

to grant planning 

permission for a modern flatroofed 

development planned 

for 17 Welcombe Road. 

The Mayor of Stratford, 

Cllr Keith Lloyd (Ind Stratford 

First), who is also a district 

councillor for the ward, 

said: “I'm disgusted with 

them all, they have let the 

people down in this town 

immensely. 

Dismayed 

“I’m dismayed that this 

proposed blot on the landscape 

has not been refused. 

This corner of Stratford is 

part of the conservation area 

and should be treated with 

architecture that blends in 

with the street scene. 

“To recommend approval 

for a building that is more 

suitable in areas such as 

Canary Wharf or even 

Dubai is totally contrary to 

the conservation area guidelines 

agreed by the council. 

“This decision is showing 

a complete lack of consideration 

to many residents who 

appreciate this area and who 

wish to protect its future.”

Stratford Voice objected to 

the development because 

they believe it will “stick 

out like a sore thumb”. 

Many residents think that 

the contemporary modern 

style of the new building, 

that replaces a dark red 

brick bungalow is not in 

keeping with the surrounding 

homes. Next door 

for example, is a two-storey 

red-brick mock Georgian 

house. 

A Stratford Voice representative 

said: “What is the 

point in designating conservation 

areas if applicants are 

allowed to develop any type 

of dwelling totally riding 

roughshod over the aesthetic 

appearance of neighbouring 

properties?” 

However, planning 

officer Gary Moss concluded 

in his report to the 

committee: “It is my 

opinion that the proposed 

development is acceptable 

and would not detract from 

the character and appearance 

of the locality... by 

removing a bungalow of no 

particular architectural 

merit and replacing it with a 

high quality, albeit, contemporary 

new dwelling.”

Pupils’ torch relay raises 

£1,200 for charity 

A TREDINGTON mum of three with a rare 

form of breast cancer has handed a cheque 

for more than £750 to the Shakespeare Hospice 

after Newbold and Tredington Primary 

School took part in their own Olympic 

torch relay. 

Some 64 pupils in the school raised 

almost £1,200 by lapping the field with 

home-made torches, and the rest of the 

money was donated to Leukemia and Lymphoma 

research. 

Emma Rowlands, whose children go to 

the school, has inflammatory breast cancer, 

and suggested the school donate the money 

to the hospice because of the “fantastic” 

help she has received from them in her 

battle. She presented them with the cheque 

last week.

Disappointment at 

delay in cutting 

councillor numbers 

DISAPPOINTMENT was voiced last week that a 

dramatic cut in the number of members of Stratford 

District Council, and a major change in the 

authority’s electoral arrangements, are unlikely to 

happen before 2019. 

At Monday’s meeting of 

the council it was revealed 

that the Local Government 

Boundary Commission for 

England would not be 

reviewing SDC’s proposed 

electoral arrangements in the 

programme for 2013-14, 

which means that the 

changes could not occur in 

2015 as hoped. 

Under proposals put forward 

by the council’s audit 

committee, the authority 

would have its current membership 

reduced from 53 to 

between 35 and 40. 

It would also have elections 

for the whole council 

every four years, instead of 

the current system by which 

a third of the councillors are 

elected every year on a 

three-year cycle—with no 

elections taking place in the 

fourth year when the county 

council elections are held. 

The committee also suggested 

that each ward would 

have only one member with 

a baseline of 2,500 electors 

per ward. 

It was pointed out in the 

committee’s report that there 

would be a reduction in costs 

of holding all-out elections 

every four years and these 

costs would be further 

reduced if the first such poll 

was held on the same day in 

2015 as the parliamentary 

elections. 

After Monday’s council 

meeting Cllr Richard 

Cheney (Lib Dem, Shipston), 

the opposition leader 

on the district council, told 

the Herald: “The local Lib 

Dems have been asking for 

some years for a significant 

reduction in the number of 

district councillors. We 

would like to see it cut by 

one third, to 35, so it’s

extremely disappointing that 

we're being told that this is 

unlikely before 2019. 

“A cut of one third would 

save a significant amount of 

money each year, yet we’re 

being told we can’t do it 

because the Boundary Commission 

haven't got the

We’re determined to keep 

pressing to get this sorted out 

at the earliest possible date.” 

Meanwhile, the council is 

urging residents to make 

their views known about the 

community governance at a 

parish level in the district. 

A community governance 

review (CGR) is a legal 

process whereby councils 

can create parish councils, 

review and change parish 

boundaries and in extreme 

cases, abolish parishes. 

The review for the Stratford 

district will consider 

whether the existing parish 

councils are effective, convenient 

and reflect the identities 

and interests of the 

local area. It will also consider 

whether parish councils 

should be merged, altered or 

abolished. 

The review will not automatically 

mean there will be 

changes and the district 

council is not seeking a particular 

solution at this time 

but looking for peoples’ 

views.

Deaths spark warning 

over water dangers 

LOCAL people were warned this 

week of the dangers of swimming 

in open water. 

The warning, by Warwickshire 

Fire and Rescue Service, follows 

the death of two teenagers in the 

West Midlands. The first lost his 

life after getting in to difficulty in a 

river near Saltford Weir on 

Tuesday; the second died after getting 

into difficulty in a quarry in 

Lower Gornal in Dudley the following 

day. 

Warwickshire’s assistant chief 

fire officer Jim Onions said: “In 

light of these tragic incidents, I 

cannot stress enough the dangers 

that exist in open water swimming. 

The water may look calm on the 

surface, but there may still be 

strong undercurrents that could 

pull even the strongest of swimmers 

under. The water may also 

feel relatively warm on the surface, 

but just a few feet below can be icy 

cold, even in the warmer weather 

and can very quickly cause severe 

cramp or hypothermia. 

“Our message is simple, cooling 

off in rivers, canals, ponds, quarries 

and lakes can have fatal consequences, 

so please don’t take the 

risk!” 

The dangers of swimming in 

cold water may not always be 

apparent, so take care and be 

aware of the following: 

●The water can be very cold— 

this could very quickly cause 

severe cramp and hypothermia. 

●There may be hidden currents 

which could quickly pull you 

under the water. 

●It can be difficult to get out 

(steep slimy banks). 

●Alcohol and swimming do not 

mix—stay out of the water if you 

have been drinking. 

●There may be hidden rubbish, 

eg shopping trolleys, broken glass. 

●If you get into trouble, there 

are no lifeguards to save you. 

●It may be polluted and may 

make you ill.

A VISITOR to Stratford was horrified when she returned to 

her car to find it badly damaged after a parking incident in 

the town’s Riverside car park on Saturday. 

Mina Mulholland’s black Ford Focus was left battered 

and its lights broken by what she believes was another 

driver’s complete disregard for other people’s property. In 

addition to Mina’s vehicle, two other vehicles parked close 

by, were also damaged. 

“It looked like my car had been vandalised. Whoever 

caused this damage must have realised they were banging 

into other people’s cars with their own vehicle but carried 

on regardless. The owner of one of the other vehicles damaged 

was almost in tears when she discovered what had 

happened,” Mina said.

Cable thief is jailed 

for eight months 

A MAN who was involved in the theft of more 

than £14,000 worth of copper cable from a Highways 

Agency depot has been jailed for eight 

months. 

And a judge at Warwick 

Crown Court also made a 

deprivation order for the 

confiscation of the van used 

by Tudorel Irimia to transport 

the cable. 

Romanian Irimia, aged 

37, of Mullien Street, 

Coventry, had earlier 

pleaded guilty to the theft of 

the cable. 

Prosecutor Iain Willis 

said that TechMAC, which 

is part of the Highways 

Agency, stores materials for 

use in road repair projects at 

a depot at Longbridge, near 

Warwick. 

Security cameras showed 

that in the early hours of 3rd 

September last year four 

men broke into the compound 

by cutting through a 

steel fencing pole. 

They stole a quantity of 

specialist copper power 

cable worth £14,500 which 

they loaded into a van. 

The first the police knew 

about it was when they were 

contacted by a suspicious 

member of the public.

searched the area found the 

van with the cable still 

inside on the car park of the 

nearby Holiday Inn, there 

was no sign of the 

offenders. 

But on 2nd November 

four Romany gipsies, 

including Irimia, went to

the vehicle was hers and 

asked for it to be returned. 

As a result Irimia and the 

woman were arrested, and 

when he was questioned he 

denied stealing the cable 

from the Longbridge depot. 

He claimed he and the 

others had been doing some 

work in London, and he had 

driven them there to collect 

some cabling in payment for 

the work they had carried 

out. 

Mr Willis added that 

Irimia had previous convictions 

for theft and making 

false representations. 

Irimia had to defend himself 

through an interpreter 

after the court heard he had 

not provided information 

needed to be granted legal 

aid. 

He told the judge: “I did 

not tell the truth to the 

police because I was threatened 

by those other four 

people. But those people are 

now in Germany. We 

entered the premises and we 

stole the cable. It was put 

into the van and I drove.” 

Jailing Irimia, Judge 

Marten Coates told him: 

“Metal theft is rife in this 

country at the moment. It 

seems to be a criminal enterprise 

popular with people 

from eastern Europe.”

Police commissioner candidates clash over statistics 

THE Labour and Conservative contenders 

for the new post of police and 

crime commissioner for Warwickshire 

have again clashed over statistics. 

Labour candidate James Plaskitt, 

the former MP for Warwick and 

Leamington, said figures released by 

the Home Office showed that crime 

detection rates in Warwickshire were 

the lowest of the 43 police forces in 

England and Wales. 

But Tory candidate Fraser Pithie 

said figures from the Office for 

National Statistics showed that from 

April to 23rd July this year total 

recorded crime had fallen by 9.8 per 

cent. 

However, he pointed out that total 

recorded crime in Warwickshire in

oldest personal trainer in the

yourself fit and don’t sit 

about watching TV all night 

but keep yourself moving, 

you can add another ten 

years to your life.” 

He says constant enjoyment 

of all forms of physical 

activity and work are his 

secrets of staying young at 

heart and in mind.

his toes, gave up body 

building ten years ago and 

now bases his own fitness

Midweek are accepted subject to the following

(1) The placing of an order constitutes an 

assurance that the advertisement is legal, 

decent, honest and truthful complying with 

the British Codes of Advertising and Sales 

Promotion, with any relevant codes of 

practice and with the requirements of 

current legislation. 

(2) Advertisement orders are issued by an 

advertising agency as a principal and must 

be on the agency’s official form. When 

copy instructions not constituting an 

official order are used, they shall be clearly 

marked “Copy instructions - not an order.” 

(3) The advertiser/advertising agency agrees to 

indemnify the publisher in respect of all 

costs, damages, or other charges falling

actions or threatened legal actions arising

(4) While every endeavour will be made to 

meet the wishes of advertisers, the 

publisher does not guarantee the insertion

(5) (i) In the event of any error, misprint or 

omission in the printing of an 

advertisement or part of an 

advertisement the publisher will 

either re-insert the advertisement or 

relevant part of the advertisement as 

the case may be or make a 

reasonable refund of or adjustment to 

the cost. No re-insertion, refund or 

adjustment will be made where the 

error, misprint or omission does not 

materially detract from the 

advertisement. 

(ii) In no circumstances shall the total 

liability of the publisher for any 

error, misprint or omission exceed 

(a) the amount of a full refund of 

any price paid to the publisher for 

the advertisement in connection with 

which liability arose or (b) the cost 

of a further or corrective 

advertisement of a type and standard 

reasonably comparable to that in 

connection with which liability 

arose. 

(iii) It is the responsibility of the 

advertiser/advertising agency to 

check the first insertion of any series 

of advertisements and notify the 

publisher immediately of any errors. 

The publisher assumes no 

responsibility for the repetition of 

errors unless notified by the 

advertiser. 

(iv) 

The publisher shall not be liable for 

any loss or damage occasioned by 

any total or partial failure (however 

caused) of publication or distribution 

of any newspaper or edition in which 

any advertisement is scheduled to

(6) The publisher reserves the right to: 

(i) cancel the order at any time by 

giving reasonable notice before the 

next insertion, but in that event the

not be liable for payment of the

unexpired part of any order without penalty 

in the event of the death or failure of its

(8) (i) The copyright for all purposes in all 

artwork, copy and other material 

which the publisher or its employees 

have originated, contributed to or 

reworked shall vest in the publisher. 

(ii) 

The publisher is hereby authorised to 

record, reproduce, publish, distribute 

and broadcast (or to permit the same) 

all advertisements (including but not 

limited to text, artwork and 

photographs) and to include and 

make them available in any 

information service, electronic or 

otherwise. 

(9) The placing of an order by an advertiser, or 

an advertising agency on behalf of a client, 

constitutes an assurance that all necessary 

authority and permission has been secured 

in respect of the use in the advertisement(s) 

of pictorial representations of (or 

purporting to be of) living persons, and of 

references to the words attributed to living 

persons. 

(10) The advertiser’s artwork, film and all other 

property is held at the advertiser’s risk and 

should be insured by him against loss or 

damage from whatever cause. The 

publisher reserves the right to destroy 

without notice all artwork, film and other 

property which has been in his custody for 

six months from the date of its last 

appearance in an advertisement unless the 

advertiser has given instructions to the 

contrary. 

(11) Notice of cancellation will not be accepted 

by telephone. 

(12) (i) Every endeavour will be made to 

forward replies to box numbers to 

the advertiser as soon as possible 

after receipt by the publisher, but the 

publisher accepts no liability in 

respect of any loss or damage 

alleged to have arisen through delay 

in forwarding or omitting to forward 

such replies (howsoever caused). The 

advertiser authorises the publisher to 

return to its originator any 

communication which, in the opinion 

of the publisher, should not be 

delivered to the advertiser.

pre-season programme with a narrow 1- 

0 defeat at home to Blue Square Bet 

North opponents Hinckley United on 

Saturday. 

A 58th minute strike from Harvey 

Headley gave the Knitters victory over a 

Town side who gave a good account of 

themselves and were without the 

unavailable Ricky Baker and Mark 

Faulds. 

Joint manager Carl Adams said: 

“What people need to realise is that over 

the past week we’ve played three sides 

from higher leagues than ourselves and 

performed with real credit each time. 

“Maybe it would have been nice to 

have played easier opposition and have 

banged some goals in give our strikers a 

confidence boost, but such games usually 

don’t prove anything.” 

And looking forward to the start of the 

Midland Alliance campaign at Heath 

Hayes next Saturday he added: “I’m 

convinced that we’ve got the basis of a 

side that can have a successful season 

and I’m looking for us to hit the ground 

running. We look particularly accomplished 

at the back, and I’m sure we will 

be hard to beat.”
