Proposed Action<br />

Mrs. Dean explained to the Board the applicant is requesting Preliminary Plat<br />

approval for a 57-lot subdivision on 22.49± acres.

Location<br />

The property is located on the west side <strong>of</strong> Wickham Road, north <strong>of</strong> Pebble Creek<br />

Street and south <strong>of</strong> Summer Brook Street, in Township 26 south, Range 36 east,<br />

Section 36.<br />

History<br />

The property is currently vacant and is proposed to be zoned R-1B with a Low<br />

Density Residential Future Land Use classification.<br />

October 22, 2013: Council annexed the 22.49± acre property (Ord. 2013-58).<br />

October 22, 2013: Council approved the transmittal <strong>of</strong> the proposed future<br />

land use classification, establishing Low Density Residential<br />

land use.<br />

January 14, 2014: <strong>City</strong> Council approves 1 st Reading to adopt the Low Density<br />

Residential land use and R-1B zoning designation<br />

Second Reading <strong>of</strong> the <strong>City</strong> future land use and <strong>City</strong> zoning designations are<br />

anticipated to be heard by <strong>City</strong> Council on January 28, 2014.<br />

Mrs. Dean identified the property and adjacent properties future land use and<br />

zoning designations.<br />

Analysis <strong>of</strong> the Preliminary Plat<br />

With the 57 lots proposed, the overall density will be 2.53± units per acre (below the<br />

maximum allowed 6 units per acre), which will be compatible with the densities<br />

established on adjacent residential projects.<br />

The average lot size is 8,520± square feet. The proposed layout meets or exceeds<br />

the minimum lot width and depth (code requires a minimum <strong>of</strong> 5,000 square feet<br />

and 6,500 square feet). One <strong>of</strong> the tracts is proposed for private road right-<strong>of</strong>-way<br />

(Tract E) from Wickham Road. All lots have frontage on the proposed Glen Ridge<br />

Circle. The R-1B zoning requires a minimum <strong>of</strong> 10% <strong>of</strong> useable open space. The<br />

applicant is providing approximately 3.91 acres (17%) <strong>of</strong> useable open space. The<br />

useable open space is located in Tracts A, C and D, and includes a clubhouse<br />

amenity with pool, walking paths and several benches.<br />

Mrs. Dean identified the six tracts proposed for the plat.<br />

Access to Wickham Road: This section <strong>of</strong> Wickham Road is a 4-lane, divided<br />

arterial roadway maintained by Brevard County. The entire 22.49± acre project<br />

will provide a single entrance point on Wickham Road on the east end <strong>of</strong> the<br />

project. The access point will include a south-bound right-turn lane into the<br />

project, which will be permitted by Brevard County during the construction plan<br />

review process. The proposed street, Glen Ridge Circle, will be a private, gated<br />

roadway serving the project.<br />

Internal Sidewalks: Sidewalks are required to be provided on both sides <strong>of</strong> a<br />

residential subdivision street (Appendix D, Chapter 8, Section 8.6(B)(7)a.). All lots<br />

will have sidewalks; however, the applicant is requesting a subdivision variance to<br />

provide the sidewalk only on one side <strong>of</strong> the road on the north side <strong>of</strong> Glen Ridge<br />

Circle, from Wickham Road to the western end <strong>of</strong> Tract B, since there are no lots<br />

and no usable open space tracts located on the north side <strong>of</strong> the proposed<br />

private roadway at this location. The applicant will provide the necessary<br />

crosswalks to connect pedestrians to the sidewalks in proximity to the Clubhouse<br />

and pool (located at the western end <strong>of</strong> Tract A).<br />

Mrs. Dean referenced the Environmental Impact Analysis. As with all projects,<br />

applicable permits will be required prior to construction plan approval, if<br />

necessary. Conservation Policy 1.12.1 <strong>of</strong> the <strong>Melbourne</strong> Comprehensive Plan<br />

states that the <strong>City</strong> shall ensure that the following measures are taken when<br />

assessing activities that may result in impacts: avoidance <strong>of</strong> wetland impacts;<br />

minimization <strong>of</strong> wetland impacts; and compensation for wetland impacts through<br />

mitigation. If the <strong>City</strong> determines direct impact upon wetlands cannot be<br />

avoided, the following mitigation measures shall be applicable:<br />

‣ All mitigation must comply with federal, state, regional, and local<br />

agencies;<br />

‣ Impacts must be minimized by the appropriate design measures; and;<br />

‣ The mitigation measures are consistent with other policies <strong>of</strong> the<br />

Comprehensive Plan and the terms <strong>of</strong> any mitigation plans approved by<br />

SJRWMD and/or other regulatory agencies.<br />

Joint Planning Agreement (JPA) Comments<br />

The property is located within the Joint Planning Area (JPA). Brevard County did<br />

not issue any comments regarding the proposed preliminary plat.<br />

Mobility Requirements for this Project: Total new trip generation for this project is<br />

estimated to be approximately 546 trips per day via access from Wickham Road<br />

(based upon ITE Land Use Code 210 – Single-Family Detached Housing). For<br />

mobility purposes, the applicant will be required to provide seven mobility<br />

improvements. The mobility improvements will need to be completed in<br />

conjunction with the installation <strong>of</strong> subdivision infrastructure and the issuance <strong>of</strong> a<br />

certificate <strong>of</strong> completion for the project.<br />

The applicant can also choose to make a payment in lieu <strong>of</strong> constructing the<br />

mobility improvements. Based upon the proposed use (single-family homes), the<br />

payment in lieu <strong>of</strong> amount will be $3,047 per unit for a total <strong>of</strong> $173,679. A one<br />

percent deposit <strong>of</strong> $1,736.79 is required within ninety (90) after preliminary plat<br />

approval. Final payment <strong>of</strong> the remaining balance will be due at the time<br />

building permits are issued by the <strong>City</strong>. The applicant can also choose to do a<br />

combination <strong>of</strong> providing mobility improvements and making a payment in lieu <strong>of</strong><br />

constructing the mobility improvements.<br />

WATER AND SEWER CONCURRENCY<br />

The <strong>City</strong>’s Ten-Year Water Supply Facilities Work Plan indicates that adequate<br />

potable water is available to serve the subject site. Sanitary sewer service is<br />

available from the Brevard County<br />

Capacity Reservation for the Project: Project capacity reservation fees have<br />

been estimated to be $462.00 per residential unit. The following is a breakdown<br />

<strong>of</strong> the impact fees for water service.<br />

‣ Water: The water capacity reservation fee is estimated to be $263.34,<br />

which is 1% <strong>of</strong> the total water impact fee <strong>of</strong> $26,334.00, based upon the<br />

proposed 57 residential units.<br />

School Concurrency<br />

School District staff has reviewed the proposal and have determined that it will not<br />

have a negative impact on school capacity.<br />

Mrs. Dean referenced the findings contained in the Planning and Zoning Board<br />

agenda memorandum.<br />

Recommendation<br />

Based on the findings contained in the Planning and Zoning Board agenda<br />

memorandum, for the 22.49± acres, zoned R-1B, located on the west side <strong>of</strong><br />

Wickham Road, north <strong>of</strong> Pebble Creek Street and south <strong>of</strong> Summer Brook Street, in<br />

Township 26 south, Range 36 east, Section 36, the Community Development<br />

Department recommends:<br />

APPROVAL OF SD-2013-04, Preliminary Plat approval for a 57-lot subdivision,<br />

consisting <strong>of</strong> a 5-page plan prepared by Masteller & Moler, Inc. <strong>of</strong> Vero Beach,<br />

<strong>Florida</strong>, Project Number 1324 with a signed and sealed date <strong>of</strong> December 19,<br />

2013, including a subdivision variance to not provide a sidewalk on the north side<br />

<strong>of</strong> the road, from Wickham Road to the western end <strong>of</strong> Tract B (Section 8.6 (B)(7)a,<br />

as specifically identified on the preliminary plat and including the following<br />

conditions:<br />

a. Changes to the Preliminary Plat will require reevaluation by the <strong>City</strong><br />

Engineering Department and Community Development Department.<br />

Any substantial change to the plan as will require review and approval by<br />

<strong>City</strong> staff, the Planning and Zoning Board, Local Planning Agency, and the<br />

<strong>City</strong> Council.<br />

b. Appropriate environmental permits must be obtained as part <strong>of</strong> the<br />

construction plan review process.<br />

c. All hardwood trees and scrub oaks located outside <strong>of</strong> the building footprint<br />

and parking driveway aisles shall be preserved, and buildings and<br />

parking/drive aisles shall be shifted when possible to preserve hardwood trees<br />

or scrub oaks, as determined during construction plan review.<br />

d. The applicant shall obtain all necessary access permits for Wickham Road<br />

from Brevard County prior to construction plan approval.<br />

e. A maximum <strong>of</strong> two (2) building permits for single-family model homes may be<br />

issued prior to the recordation <strong>of</strong> the final plat (consistent with Appendix D,<br />

Chapter 8, Section 8.5(d)(2)).<br />

f. Concurrency: As required by Chapter 10, Appendix D, and Chapter 32,<br />

<strong>Melbourne</strong> <strong>City</strong> Code, to reserve capacity, the Owner/Developer shall be<br />

required to pay the capacity reservation fee in the amount <strong>of</strong> $263.34 for<br />

water impact fees. Payment must be received by the <strong>City</strong> <strong>of</strong> <strong>Melbourne</strong><br />

within ninety (90) days <strong>of</strong> the date <strong>of</strong> rendition <strong>of</strong> this Development Order by<br />

<strong>City</strong> Council/Planning and Zoning Board approval. This Development Order<br />

shall not become effective until payment <strong>of</strong> the capacity reservation fee has<br />

been made payable to and received by the <strong>City</strong> <strong>of</strong> <strong>Melbourne</strong>.<br />

g. Mobility: As required by Appendix D, Chapters 3 and 10, to address mobility,<br />

the Owner/Developer shall be required to make the 1% mobility fee deposit<br />

in the amount <strong>of</strong> $1,736.79. The payment must be received by the <strong>City</strong> <strong>of</strong><br />

<strong>Melbourne</strong> within ninety (90) days <strong>of</strong> the Planning and Zoning Board<br />

approval. This Development Order shall not become effective until payment<br />

<strong>of</strong> the capacity reservation fee has been made payable to and received by<br />

the <strong>City</strong> <strong>of</strong> <strong>Melbourne</strong>.<br />

Chad Genoni, Sunbay LLC, 4760 North US Highway 1, stated he was available for<br />

questions or comments.<br />

Mr. King opened the public hearing; there being no public comment, the public<br />

hearing was closed and discussion was brought back to the Board.<br />

the findings and conditions contained in the Planning and Zoning Board agenda<br />

memorandum dated January 16, 2014.<br />

Motion carried unanimously.<br />

6. Future/Additional Business<br />

Mrs. Dean provided the Board with a summary <strong>of</strong> the preliminary business items.<br />

7. Election <strong>of</strong> Chairman and Vice Chairman for 2014<br />

Mr. Clement nominated Mr. King for Chairman and Mr. Coruzzi for Vice-Chairman.<br />

Moved by Lebovitz/Trauger to close the nominations.<br />

Motion carried unanimously.<br />

By consensus, the Board agreed to maintain Alan King as Chairman for 2014 and Ed<br />

Coruzzi as Vice-Chairman for 2014.<br />
