Warners also charges the actress with breach of contract and asks that her agreement be declared invalid. Miss Smith backed away from a loanout to U-I for a topline in "Shoplifter." Not in the script of "The Man With My Pace," being readied as a Macdonald Carey starrer by Jess Smith Productions, independent unit, is a $300,000 damage action filed by writer-producer Richard M. Blumenthal. Naming Smith, Thomas J. McGowan and Samuel W. Taylor as defendants, Blumenthal seeks a declaratory judgment to determine the respective ownership rights in the screenplay package. He claims to be a co-owner, along with McGowan and Taylor, and charges he had been set to produce the film. That agreement allegedly was abrogated, however, according to Blumenthal, when the script was sold to Smith. Back on the payroll at 20th Century-Fox went Victor Mature, who had been suspended some weeks ago for refusing to accept a loanout assignment ^o :tar in RKO's "Alias Mike Fury." \ Theatre Chandelier Falls, Hurts Three LOS ANGELES—Police sought this week to determine what caused a chandelier to wrench loose from the ceiling of the Monterey Theatre in Monterey Park and fall into the audience, injuring several persons. Police reported the chandelier weighed 50 pounds, but G. W. Gutstein, manager of the theatre, said the part of the fixture which dropped was principally glass and weighed only about half a pound. The manager said he believed the fall was caused when the welding by which the piece was attached to iron pipes at the ceiling gave way. Steven Zsinko. 71, of Alhambra was under observation for a possible skull fracture. Treated for cuts and bruises were Mr. and Mrs. Thomas B. Glynn of Garvey, and Mulia Marchese of Alhambra. Hal Roach Sr. Produces TV Subject in Color HOLLYWOOD—Hal Roach sr., who some time ago abandoned his theatrical film producing activities in favor of video and commercial film production, has turned out a 40- minute subject in Anscocolor for the Union Oil Co., which that firm will utilize as part of an entertainment package celebrating its 60th anniversary. Produced for Roach by Sidney Van Keuren and directed by Harve Foster, the film will be presented, in conjunction with a stage revue, for the edification of union personnel in 33 cities, including Los Angeles, San Pi-ancisco, Seattle and Phoenix, beginning February 25. With its annual "Emmy" awards presentation dinner to be staged January 27, the Academy of Television Arts and Sciences will hand out plaques for video achievements in nine categories. Honors will be meted out for the best live show, kinescope show, live personality, kinescope personality, film, public service show, sports coverage, juvenile program and commercial plug. In addition, recognition will be paid the best all-around station and most significant technical achievement of the year. Thugs Kidnap Showman; Seek Safe Combination SAN FRANCISCO—Monte Crooks, 26, assistant manager of the Milbrae Theatre, told police here that he was kidnapped by two armed thugs and held captive for four hours while they threatened his life if he did not reveal the combination of the theatre safe. Crooks told police that he climbed into his car after closing the theatre shortly after midnight. The thugs were hidden in the back seat of the car. Crooks refused to give them the safe combination and one of the thugs took over the wheel of the car and drove around the peninsula until nearly 4 a. m. During the ride the thugs stole Crooks' wallet, containing $2, and a diamond ring, which they later returned. Tliey also thi-eatened his life and indicated they intended to harm Crooks' wife Constance and his 2-year-old daughter Melody if the theatreman failed to reveal the safe combination. Crooks said the men released him and returned his car keys somewhere near the Golden Gate park before taking off on foot.
