have to produce documentary evidence of production done, such as, a copy of the work 

order, satisfactory completion of assignment and payments received, etc. and will submit 

at least five best productions in the form of video CD/audio CD as proof along with the 

application form. 

4. Should have done audio/video production work of at least Rs.100.00 lakhs during 

last 3 financial years (only production cost shall be taken into account, not the cost of 

advertising, etc.) 

5. Detailed guidelines, application proforma and other details in this regard may be

documents by post shall be entertained. The application complete in all respects, 

inclusive of a demand draft of Rs.5,000/- (Five thousand only) as non-refundable

GUIDELINES FOR EMPANELMENT OF PRODUCERS OF FILMS / 

AUDIO-VIDEO SPOTS AND PRODUCTION THEREON 

Directorate of Extension (DOE) will empanel a limited number of good 

performing agencies for the work of production of films / audio-video spots for the 

publicity of programmes, policies and other activities of Ministry of Agriculture 

under the guidelines specified herein. 

GENERAL: 

1. These guidelines will supercede all provisions / guidelines previously in 

force in the Department of Agriculture & Cooperation in this regard. 

2. These guidelines shall come into force with immediate effect. 

3. An Empanelment & Costing Committee (ECC) will be constituted to 

consider the applications of audio/video producers and recommend those having 

requisite qualifications for empanelment. ECC will evolve its own procedure for 

scrutiny of applications, screening of show reels for quality assessment etc. The 

films will be got produced on fixed cost basis. This Committee will also decide the 

fixed cost valid for three financial year for different kinds of audio-visual 

productions, dubbing, duplication, etc., taking into consideration the rates fixed 

by DAVP, Doordarshan, All India Radio and other organizations it deems fit. 

These fixed costs may, however, be reviewed by ECC as and when required. 

4. The composition of Empanelment and Costing Committee (ECC) shall be 

as under:

The Committee is empowered to co-opt any other official member having 

experience in this field. 

5. Producers already empanelled with DOE and those seeking 

empanelment for the first time shall apply afresh for empanelment under these 

guidelines. There will be no ‘provisional empanelment’ of the producers. 

ELIGIBILITY CRITERIA: 

6. Directorate of Extension proposes to empanel producers in the following 

three categories: 

A. Audio Producers 

B. Video Producers 

C. Audio – cum – Video Producers 

7. Only such producers who have adequate qualifications, experience and 

capabilities to produce good quality audio-video production, programmes in 

required formats will be eligible to apply for empanelment. 

8. Any producer to become eligible for empanelment will be required to 

have:- 

i. Adequate qualifications with minimum professional experience of three 

preceding years in the field of audio-video productions. 

ii. Should have produced at least 20 good quality audio and video 

programmes in the last 3 years for empanelment as audio-cum-video 

producer or either 20 good quality audio programmes or 20 good quality 

video programmes for empanelment as only audio producer or only video 

producer respectively (different episodes of a serial or programme will be 

treated as one and the same programme). The producer will produce 

documentary evidence of production done, such as, a copy of the work 

order, signed contract, payments received, etc. and will submit at least 5 

best productions in the form of audio/video CD as proof along with the 


iii. Should have done audio/video production work of at least Rs.100.00 lakh 

during last 3 financial years (only production cost will be taken into 

account, not the cost of advertising etc.) 

iv. Should have a minimum net worth of Rs. 3 lakh. 

[Net worth: Net worth means the excess of the book value of assets 

(other than fixed assets) of an enterprise over its liabilities. It would be 

calculated as sum of the paid up equity and free reserves minus 

accumulated losses, if any, in the company. The applicant shall furnish a 

proof of its networth certified by a statutory auditor/chartered accountant.] 

9. ECC will decide any additional suitable criteria if required to facilitate the 

selection of only the good and genuine agencies in limited number. 

EXCEPTION 

10. a) Special Category: Young professionally qualified producers who are 

degree/diploma holders from Central Government institutes, FTII Pune 

and Satyajit Ray Film & TV Institute Kolkata or other reputed institutes 

recognized or affiliated to universities, in Direction, Cinematography or

Editing courses during preceding 5 years will be eligible for empanelment 

in the above categories. They should apply with their award/prize winning 

productions. 

b) They will be required to show a net worth and turnover equal to 1/3 rd of 

that laid down in eligibility criterion in the category where they seek 

empanelment. 

c) They will be required to show past special experience of atleast one 

programme of the category for which empanelment is sought. 

APPLICATION: 

11. All applications shall be required to be submitted in the prescribed 

proforma alongwith the required information/documents/material. 

12. The Producer shall be required to submit copies of income-tax returns of 

last 3 years with PAN number. 

13. The producer should also submit its balance sheets and profit and loss 

accounts of his/her firm/company, for the three preceding financial years; duly 

verified by a Chartered Accountant (indicating membership no. of Chartered 

Accountant in his seal). 

14. The producer will submit bio-data of his/her creative team. Composition 

of creative team to be submitted alongwith bio-data of atleast Director, 

Cinematographer, Script Writer & Music Director. Awards won by the members of 

the creative team as well as the producer may be stated alongwith the 

documentary proof. Due weightage will be given to the agencies with award 

winning Directors of Tele Films/Documentaries. The producer will also submit 

documentary proof of ownership/retainership of production facilities, if any. 

15. The producer will submit a certificate to the effect that the information 

submitted by him/her is correct and he/she will abide by the decision of DAC in 

toto regarding empanelment. In case the information submitted by him/her is 

found to be false or fabricated in any manner, he/she may be suspended or 

debarred from empanelment. 

16. The producer or his/her representative may be required to make a 

presentation before the ECC at his/her own cost. 

17. The producer will submit alongwith his/her application a demand draft for 

Rs. 5,000 (non-refundable) drawn in favour of the Drawing and Disbursing 

Officer, Directorate of Extension, New Delhi as processing fee. 

PRODUCTION PROCEDURE: 

18. The selection of subject, content, duration and line of approach regarding 

production of any film shall be decided by the Extension Division in consultation 

with the concerned subject matter Division, if any. The background material shall 

be prepared by the concerned subject matter Division and provided to DOE. 

This may also include language and format of the film, likely places of shooting,

time available for completion, number of prints of the film required in designated 

language and as dubbed in other required languages and other related aspects, 

as appropriate. While deciding the number of prints the Division may take into 

account the requirement of States, concerned institutes and for film library of 

DOE, DAC etc., as appropriate. 

19. DOE will invite technical concepts / scripts in separate sealed covers 

from the empanelled producers. The proposals shall be invited from the 

empanelled producers after calling all of them for a briefing meeting on the 

subject matter. The technical concept/script of the producers not found up to the 

mark, shall be rejected. 

20. The payment with respect to the following items / jobs shall be released to 

the empanelled producers completing the assignment as per the rates approved 

by the Empanelment & Costing Committee (ECC) of DAC: 

i) Charges of production in Betacam, SP (or Digi-Beta Format, if 

required) and a Telecast copy in DVC Pro for video production and 

Digital Format for audio production with basic version in English/Hindi 

or any regional languages; 

ii) Dubbing charges in other languages; 

iii) Charges for Graphics/ animation. 

iv) Charges for Additional audio CD copy 

v) Charges for additional beta Telecast copy or for miscellaneous video 

work. 

21. Final selection of producer of the film shall be made on the basis of the 

evaluation of technical concepts / scripts received from the film producers by a 

Script Committee consisting of following:- 

i. Head of the Concerned Division - Chairman 

ii. Director (Extension), DAC - Member 

iii. A representative of D.G., Doordarshan - Member 

iv. A representative of DG, AIR - Member 

v. Campaign Officer of DAVP - Member 

vi. Director (Finance), DAC - Member 

vii. Director (FI), DOE - Member 

viii. Joint Director (Mass Media) - Member- 

Secretary 

Provided that for the production of programmes for telecast on 

Doordarshan under “Mass Media Support to Agriculture Extension” 

scheme, the Script Committee shall be headed by the Additional 

Secretary In-charge of Extension Division and Joint Secretary (Extension) 

and other Joint Secretaries of concerned Subject Matter Divisions shall 

be included in it as Members, apart from other Members as stated above. 

The identified producers shall also have to make presentation on their 

proposal before the script committee. 

22. Directorate of Extension will place work order on the film producer after 

the approval of technical concepts / scripts. The number of copies required in 

different formats (Betacam SP, Digi Beta, DVC Pro, DVD & CD, etc) including 

that of dubbed versions shall be clearly mentioned in the order.

23. An agreement in the prescribed format will be entered into between the 

Government of India and the film producer (copy of agreement at Annexure-I). 

24. After completion of the shooting the producer shall at his/her own cost 

arrange the preview of the film at rough-cut stage before the Script Committee on 

the scheduled date and time. Script Committee shall preview the film at roughcut 

stage and suggest changes/modifications in writing wherever necessary, 

which should be incorporated by the producer on his/her own cost and shown to 

the Script Committee again for approval. Script Committee may subject a film for 

more than one preview if the changes/modifications suggested by the Committee 

are not carried out properly and all such previews shall be arranged by the 

producer at his/her own cost. A film will be treated as complete only on approval 

of the Script Committee. If a producer fails to carry out the changes suggested by 

the Script Committee, he would be dealt with in accordance with the provisions 

under para 28 below. 

25. Wherever the film is got produced under these provisions all copyright of 

the film including broadcasting rights and new media rights, if any, will rest with 

the Ministry. 

26. Payments to film producers will be made in stages. It will be as under:- 

a. On approval of script 40 per cent 

b. After inclusion of comments 30 per cent

c. On final approval of completed film 30 per cent 

27. A bank guarantee to cover the advance payments will be taken to secure 

the same. The validity period of Bank Guarantee should be six months beyond 

the entire period allowed by the Department to the producer to complete the 

production to the full satisfaction of the Department. Bank Guarantee will be for 

the cumulative amounts. At each stage of payment Bank Guarantee for the total 

amount paid to the producer till that stage will be insisted upon. In case a 

production is in more than one stand-alone episode, each episode may be 

considered as separate production for the purpose of bank guarantee. 

28. The producer will be given a time frame to complete the production. In 

the case of any deviation from the time frame to complete the production within 

the stipulated time, the DAC shall, without prejudice to the right to the 

Government to recover from the Agency damages for breach of contract, recover 

from the Agency as agreed liability damage, and not by way of penalty, a sum 

equivalent to 1% of the contract value for each week or part thereof for delay 

beyond the stipulated period given in Schedule I, subject to a maximum of 13%. 

Any delay beyond three months of the agreed time frame will result in 

encashment of the Bank Guarantee, by the Department, without any notice to the 

producer. 

OTHER CONDITIONS: 

29. No producer will be eligible to have empanelment in more than one name 

(either in his own name or in the name of his/her close relative) or subsidiary 

firm/sister company. 

30. The ECC may suspend producers from the panel on the basis of reasons 

to be recorded in writing.

31. Empanelment shall be valid for a period of two years. The existing panel 

of producers in DOE shall stand cancelled on expiry of its validity (including the 

extended period, if any) or the date of finalization of the new panel, whichever is 

earlier. 

32. DAC reserves the right to commission programmes at appropriate costs 

by assignment to eminent producers and directors in the country who have won 

national and international recognition / awards with the approval of a Committee 

to be chaired by the Secretary of the Department. 

33. The guidelines may be amended from time to time as and when 

considered necessary. 

34. Any producer blacklisted by the DAVP or Doordarshan/AIR will not be 

admitted for empanelment and if already empanelled will be liable for suspension 

when such debarment comes into effect. 

35. Secretary (DAC) is authorized to relax these guidelines in deserving 

cases for reasons to be recorded in writing.

A. WHEREAS DAC has decided to make a _______film/video spot/audio spot ____titled 

_____of approximately _____ minutes duration in __________ colour format (clearly 

mention the no. of prints required in different formats including that of dubbed versions). 

B. AND WHEREAS DAC is desirous of engaging the services of the Agency for the above 

purpose, such services being as stipulated in this Agreement (hereinafter referred to as 

Services). 

C. AND WHEREAS the Agency has agreed to rendering such services. 

D. AND WHEREAS the DAC is desirous of engaging the service of the Agency, which has 

no Principal and Agent nor Master and servant relationship between DAC/GOI and the 

Agency. 

NOW, THEREFORE IT IS HEREBY AGREED between both parties to the Agreement as 

follows: 

(1) That the Agency shall render the services to the total satisfaction of DAC and as per the 

technical specifications given in Annexure-I. The production should be new, using state of 

art technology and free of any infringement of IPR (Intellectual Property Rights) of any third 

party. The decision of DAC about the quality of services including the script, selection of 

locations, models and anchors, shooting, editing, music, voiceover, various kinds of effects, 

recording or print quality etc. and its (DAC) satisfaction will be final and shall not be 

challenged by the Agency on any ground whatsoever.

(2) For Violation of IPR, the Agency is liable for compensation and the Agency shall be 

responsible to and indemnify DAC and shall be required to pay license fee to the other party 

and any other payment required to square up the matter regarding any infringement of 

Intellectual Property Rights (IPR) of any third Party (ies). 

(3) The Schedule I, II and Technical Specifications (Annexure I) attached to this Agreement are 

deemed to be integral part of this Agreement. 

(4) The date of commencement of services shall be as specified in Schedule I of this Agreement. 

(5) The date of satisfactory completion of services shall be the date which DAC accepted by 

issuing an appropriate certificate of satisfactory completion of services, subject to such date 

being on or before the completion date given in Schedule I and other terms and conditions 

of this Agreement. 

(6) The consideration payable by DAC to the Agency for satisfactory completion of the service 

shall be as stated below (and also given in Schedule II) which will be strictly adhered to and 

the Agency is answerable to DAC for the amount paid at every stage as under: 

a. Ist Installment: On approval of script and within____days of submission of bank 

guarantee – 40% of the total contract value that is Rs. (amount) 

b. IInd Installment: After inclusion of comments made on preview – 30% of the total 

contract value that is Rs. (amount) 

c. Final Installment: On final approval of completed film – 30% of the total contract 

value, that is, Rs.(amount) 

Total amount to be paid to the Agency = Rs.____________ (in words also) 

(7) If the terms of payment defined in Schedule II relate to phase-wise progress of rendering the 

services, each such phase shall be deemed to have been completed subject to such conditions 

as contained therein, if any, on issue of a letter acknowledging receipt and satisfactory 

performance of the film, such letter being duly signed by an authority authorized on this 

behalf by DAC. 

(8) If the terms of payment contemplate payment to the Agency of any advance, such 

arrangement shall be subject to the Agency securing the agreed amount of the advance by an 

unconditional and irrevocable bank guarantee in favour of DAC, from a Nationalized Indian 

Bank. Such bank guarantee shall be valid up to six months beyond the entire period allowed

y the DAC to the producer (the Agency) to complete the production to the full satisfaction 

of DAC. The bank guarantee shall be for the cumulative amounts at each stage of payment, 

Bank Guarantee for the total amount paid to the Agency till that stage shall be insisted upon. 

Further, the Agency/Producer of the film should also furnish Performance. Guarantee 

(equivalent to at least 10% of the contract value or such other amount as deemed fit) for 

timely and satisfactory completion of the film/project. 

(9) DAC shall have full rights to monitor the progress of services being rendered by the Agency 

at all stages and to give suitable instructions and directives at any stage, for modifying, 

altering, deleting or adding as deemed fit by DAC. The Agency shall implement such 

modifications unconditionally. 

(10) DAC shall have right at all times to enter the premises and work area of the Agency. 

(11) If during the course of monitoring the work of the Agency, DAC is satisfied that the services 

being rendered are not to its complete satisfaction then DAC shall have the right to cancel the 

Agreement after giving a notice of 15 days and have the work completed by any other body 

at the sole risk and cost to the Agency. This shall be without prejudice to DAC right to call 

back advance, invoke bank guarantee and impose such recoveries, penalties and sanctions as 

it deems fit. 

(12) In case of abandonment’s or earlier termination of the services of the Agency without 

satisfactory completion of the film production, then the total advance paid to the Agency but 

unutilized at the time of such termination shall be returned immediately with interest (at the 

rate agreed between the Parties) to DAC/Government by the Agency/the Producer. 

(13) The film producer (the Agency) will hire a Subject Matter Consultant who will ensure 

technical soundness of the subject leading to the production of film. 

(14) Any artists/workmen/officer/employee or agent etc. engaged by the Agency for the purpose 

of rendering services under this Agreement shall always be and continue to be the employee 

or agent of only the Agency and not of DAC, and DAC shall not be liable or responsible for 

any loss, accident, damage suffered by the Agency, any employee or agent of the Agency or 

any person claiming under the Agency, arising in or out of the execution of this work in any 

manner whatsoever.

(15) If at any point of time it is necessary to make amendment to the Provisions in Schedule I or 

II, such revisions, if accepted by both parties, shall be included by appropriate amendment to 

this Agreement duly signed by both the parties. 

(16) The time for completion being essence of this Agreement, if the Agency delays, fails or 

defaults, the DAC may, without prejudice to the other rights to the DAC (Government) to 

recover from the Agency the damages for breach of contract, may recover from the Agency 

as agreed Liquidated damages (and not by way of penalty) a sum equivalent to 1% of the 

contract value for each week or a part thereof, for delay beyond the stipulated date of 

completion given in Schedule-I, subject to a maximum of 10% of the contract value. Any 

delay beyond three months of the agreed time frame, DAC, will have the option to encash the 

Bank Guarantee, without any notice to the producer/the Agency. 

(17) In case of any dispute between DAC and the Agency arising out of or in relation to the 

Agreement, the dispute shall be referred to arbitration of a sole arbitrator to be appointed by 

the Secretary, DAC on recommendations of Law Secretary, Department of Legal Affairs. 

The Arbitration and Conciliation Act, 1996 shall not be applicable to arbitration under this 

clause. The award of the arbitrator shall be binding on the parties to the dispute provided, 

however, any party aggrieved by such award may make a further reference for setting aside 

or revision of the award to the Law Secretary or any other officer when so authorized by the 

Law Secretary, whose decision shall bind the parties finally and conclusively. The place of 

arbitration shall ordinarily be at New Delhi but may be changed by the arbitrator for 

sufficient reasons. 

(18) The Agency shall fully indemnify, DAC against all liability arising out of action, demands, 

proceedings resulting from negligence or breach attributable solely to the Agency. Similarly, 

the DAC shall fully indemnify, the Agency against all liability arising out of action, 

demands, proceedings resulting from negligence or breach attributable solely to the DAC 

This Clause shall survive the termination or expiration of the Agreement executed by the 

parties Provided there shall be no indemnity on either side in cases of indirect, remote or 

consequential damages including loss of profit or loss of business, by the other party. 

(19) The Agency is required to submit the production as per the specifications given in Annexure- 

I. The Producer should submit a separate broadcast/telecast copy of each audio/video 

production in each language. However, to economize on the storing space, master, client 

copies of different audio/video productions and languages can be submitted in one or more

tapes/CDs as the case may be, with title plate (title, subject, duration, language) in English 

before each Video product. Any compromise on the quality of production is liable for 

penalty/cancellation of contract. 

(20) The Authorized signatory of the Agency is required to submit the letter of Authorization 

issued by the Board of Directors/ Governing Body or any other authentic Governing body of 

Agency as the case may be. 

(21) (i) Force Majeure shall include un-predictable, un-foreseen, catastrophic and Natural 

calamities or acts of God, beyond the control of both the parties and not brought about at the 

instance of, the Party claiming to be affected by such event or which, if anticipated or 

foreseeable, could not be avoided or provided for and which has caused the non-performance 

or delay in performance, such as earthquakes, flood, land slide, epidemics, drought, hail 

storm, high variation in temperature, fire, war, curfew, riots, acts of State or Governmental 

action, existing on or after the effective date of this Agreement which prevent totally or 

partially the fulfillment of the obligations of one or both the parties. 

(ii) The party invoking Force Majeure shall provide to the other party confirmation of the 

existence of facts constituting Force Majeure. Such evidence shall consist of a statement of 

certificate of any Governmental Department or Agency. If such a statement or certificate 

cannot reasonably be obtained, the party claiming Force Majeure may, as a substitute 

therefore, make a notarial statement describing in detail the facts claimed to constitute Force 

Majeure and the reasons, why such a certificate or statement confirming the existence of such 

facts can not reasonably be obtained. 

(iii) During the period that the performance by one of the parties of its obligations under this 

Agreement has been suspended by an event of Force Majeure, the other party may likewise 

suspend the performance of all or part of its obligations hereunder, except for payment of any 

amounts then already due and payable. 

(iv) Should the period of Force Majeure continue for more than six calendar months, either 

party may terminate this Agreement without liability to the other party, except for payments 

due as of the termination date, upon giving written notice and recovery of advance payment 

including invoking of Bank Guarantees.

(22) All notices required or allowed to be given hereunder shall be made by either: 

a. Delivery in person with signed receipt. 

b. Telex/Fax properly transmitted to the parties, or 

b. Registered mail 

(23) All notices shall be addressed to the parties respectively as follows: -

(24) Or to such other address or telex/Fax number as either party may from time to time specify 

by written notice to the other party. 

(25) The Agency hereby warrants that the services supplied to DAC shall be of highest quality 

and shall be in full compliance of the Technical specifications laid down in Annexure-I to 

this Agreement. In case of DAC not approving of any part of the video tape made by the 

Agency, the Agency shall be liable to remake the said part at its own cost as per the 

directions of DAC within the time stipulated by DAC. 

(26) The title rights, copyrights and all other rights of whatsoever nature to the script and the film 

made or produced under this Agreement shall be vested exclusively in the DAC and the 

Agency shall have no claims on such script, film or other material or against DAC other than 

the consideration as made upon in this Agreement. 

(27) Nothing contained in this Agreement shall be construed as establishing or creating between 

the Parties a relationship of master and servant or principal and agent. 

(28) Neither this Agreement nor any rights under it may be assigned, transferred or sub-let by any 

party without the prior written consent of the Party. 

(29) No waiver by any Party of any one or more obligations or defaults by any other Party in the 

performance of this Agreement shall operate or be construed as a waiver of any other 

obligations or defaults whether of a like or of a different character. 

(30) The Agency shall at all time indemnify DAC against any claims in respect of any damages or 

compensation payable in consequences of any accident or injury sustained or suffered by its 

(the Agency’s) employees or agents or by any other third Party resulting from or by any 

operation conducted by or on behalf of the Agency.

(31) The Agency shall notify DAC of any material change in their status, shareholding or that of 

any Guarantor of the Agency, in particular, where such change would impact on performance 

of obligations under this Agreement. 

(32) This Agreement shall not be amended, modified, varied or supplemented in any respect 

except by an instrument in writing signed by all the Parties, which shall state the date upon 

which the amendment or modifications shall become effective. 

(33) The provision of this Agreement shall inure to the benefit of and be binding upon the Parties 

and their permitted assigns and successor in interest. 

(34) The courts at Delhi (or any other place as deemed fit) shall alone have jurisdiction to decide 

any dispute arising out of or in respect of this Agreement.

Annexure-I 

Technical Specification 

1. The production should be new using state of art technology and free of any infringement of 

IPR (Intellectual Property Rights) of any third party. 

2. The production should be using suitable music and background voices for video spots. 

3. For the production of video spots, the producer should select an artist/anchor, whom the 

farmers can identify with 

4. For the video spots, the producer should use modern editing techniques as per the programme 

requirements 

5. The video spots should meet the international telecast standards of all public and private 

channels, where quality is concerned. 

6. To ensure regional look to the programme, the language version video spots should include 

besides dubbing, content, characters, property, artists, outdoor shooting locations, language 

graphic/animations, etc. 

7. The Producer should submit the video spots in two VHS, two CDs, one master in Beta 

Format , one Master in international track, one telecast copy in Beta Format and one telecast 

copy in DVC Pro -50 format.
