The 6 th meeting <strong>of</strong> the Students’ <strong>Senate</strong> (2012 – 2013) was held on 5 th October,<br />
2012 in the <strong>Senate</strong> Hall, New SAC. It was called to order by the Convener,<br />
Students’ <strong>Senate</strong> at 8:30 PM.<br />

Ratification <strong>of</strong> the Minutes <strong>of</strong><br />

iii. 2012-13/2 nd (Special) Meeting held on 24.09.2012<br />
The draft Minutes <strong>of</strong> the Meetings were presented by the Convener for the consideration <strong>of</strong> the<br />
<strong>Senate</strong>.<br />
The following changes were noted:<br />
The date <strong>of</strong> the 2012-13/2 nd (Special) Meeting was corrected as 24.09.2012 instead <strong>of</strong><br />
23.09.2012.<br />
The attendance record <strong>of</strong> Ankur Atul Agarwal, Senator UG 11 for the 2012-13/ 2 nd (Special)<br />
Meeting was changed to "Present" from "Absent" as there was evidence that he was present<br />
in the meeting and had forgot to sign the attendance sheet.<br />
The Minutes <strong>of</strong> these Meetings, with the above-mentioned changes were ratified by the <strong>Senate</strong>.<br />
Item No. 2<br />
Announcements and Remarks, if any<br />
<br />
The Convener announced that in 2 nd meeting <strong>of</strong> the session 2012-13 <strong>of</strong> the academic <strong>Senate</strong><br />
held on September 27, 2102, a decision was taken that every instructor should inform each<br />
student marks in each component <strong>of</strong> the evaluation, the relative weights <strong>of</strong> each component<br />
and the total until then before the last week <strong>of</strong> classes in every semester/summer term<br />
(except obviously the end-semester marks). Based on the discussion held in the academic<br />
senate over this issue, the Convener and the President also suggested that students should<br />
take care that they do not leave for home before checking the end-semester marks in each<br />

subject as only then, students can be more aware and point out any discrepancy that may<br />
arise in grading.<br />
The Convener also announced that the Steering Committee in consultation with the<br />
Parliamentarian, Students’ <strong>Senate</strong> opines that the Agenda item "Questions and Remarks" is<br />
meant for asking questions, and should not be used for discussions <strong>of</strong> any kind. However, if<br />
the person asking the question is not satisfied with reply and wishes the senate to have a<br />
discussion on the same, he/she should submit it as an agenda item for the next meeting.<br />
The President, Students’ <strong>Gymkhana</strong> announced that contrary to the common perception,<br />
there is actually no subsidy in the mess charges <strong>of</strong> any IIT <strong>Kanpur</strong> student. Further, on an<br />
average the amount that a student pays towards mess is more than Rs. 3000 per month as<br />
besides the monthly mess bill, a student also pays Mess Establishment Charge in the<br />
beginning <strong>of</strong> every semester.<br />
Item No. 3<br />
Action Taken Report<br />
The Report on Action Taken for the previous Meetings <strong>of</strong> the <strong>Students'</strong> <strong>Senate</strong> was presented by the<br />
Secretary, <strong>Students'</strong> <strong>Senate</strong> for the consideration <strong>of</strong> the <strong>Senate</strong>.<br />
In the course <strong>of</strong> the presentation,<br />
Chairman <strong>of</strong> Virtual Classroom Committee - Senator M Tech Y11, Abhimanyu M A<br />
requested the <strong>Senate</strong> to allow the committee to submit its report by the beginning <strong>of</strong><br />
November, 2012. The request was granted by the <strong>Senate</strong>.<br />
Pratik Moona, the ex-student nominee to the HCUC informed that he had had a meeting<br />
with the Chief Medical Officer, but the meeting did not yield any positive results as the<br />
CMO seemed quite reluctant to make any major changes.<br />
The Chairman <strong>of</strong> the committee for looking into the monitoring <strong>of</strong> festivals requested that<br />
the committee be given time till the beginning <strong>of</strong> January to come up with the final report. It<br />
was noted that a meeting <strong>of</strong> the committee had taken placed. Correspondingly, the following<br />
lines <strong>of</strong> the ATR were changed:<br />
o In Item 9, the line "The committee is scheduled to meet after 14 th October, 2012"<br />
was changed to "The committee has met once. The committee is scheduled to meet<br />
for a second time after 14 th October, 2012."<br />
o In Item 10, the line "No meeting <strong>of</strong> the SFMC committee has taken place." was<br />
changed to "No meeting <strong>of</strong> the SFMC committee has taken place since the decision<br />
was taken."<br />
It was remarked by the General Secretary, Games and Sports Council that the President was<br />
supposed to take up the issue <strong>of</strong> seeking additional funds for the Inter IIT Sports<br />
contingent.<br />
The ATR, with the above-mentioned comments and changes, was accepted by the <strong>Senate</strong>.<br />

Further, the <strong>Senate</strong> opined that in principle all reports that are sent to the administration<br />
should be approved by the Students’ <strong>Senate</strong> before sending. However, in case a report needs<br />
to be submitted by a student representative to the administration in an exceptionally small<br />
time-frame, he must send a notification and a copy <strong>of</strong> the report to the <strong>Students'</strong> <strong>Senate</strong> for<br />
noting after the submission.<br />
Item No. 4<br />
Ratification <strong>of</strong> the change in the members <strong>of</strong> the <strong>Gymkhana</strong> Golden Jubilee<br />
Team.<br />
The President, Students’ <strong>Gymkhana</strong> informed the <strong>Senate</strong> that Ms. Dhriti Bhatt had resigned from<br />
the Golden Jubilee Team and name <strong>of</strong> Ms. Niharika Khare (Y9370), as proposed by the President,<br />
was ratified by the <strong>Senate</strong>.<br />
Item No. 5<br />
Presentation <strong>of</strong> the following preliminary conduction reports <strong>of</strong> Antaragni'12:<br />

ii. Security Plan<br />
iii. Finance report<br />
iv. Marketing report<br />
v. Special Task Force<br />
The reports were presented by the Festival Coordinator, Antaragni'12 for the consideration <strong>of</strong> the<br />
<strong>Senate</strong>. The Convener informed the <strong>Senate</strong> that there was a miscommunication <strong>of</strong> the policy in<br />
question between the Convener and Antaragni'12, due to which they were unaware that all MoUs<br />
had to be submitted before the weekend before the festival. Thus, the Festival Coordinator<br />
requested that he be allowed to submit the final list <strong>of</strong> sponsors to the Convener along with the<br />
MOUs on Monday (8 th October) instead <strong>of</strong> the earlier deadline <strong>of</strong> Friday (5 th October).<br />
The request was granted by the <strong>Senate</strong>.<br />
Also, it was informed that the list <strong>of</strong> STF members could not be prepared in time for the meeting.<br />
Thus, it was decided that the same shall be circulated on the senate list. (The list <strong>of</strong> STF members<br />
circulated on the senate list later is placed on AP-1.)<br />

Presentation <strong>of</strong> the post conduction report and finance report <strong>of</strong> Udghosh'12<br />
The Convener announced that the relevant reports had not been received. The <strong>Senate</strong> decided that<br />
the same shall be taken up in a subsequent meeting as and when the reports are submitted.<br />

Presentation <strong>of</strong> the post-conduction report <strong>of</strong> and ratification <strong>of</strong> the results <strong>of</strong><br />
Takneek'12.<br />
The report was presented by the General Secretary, Science and <strong>Technology</strong> Council and accepted<br />
by the <strong>Senate</strong>.<br />
Item No. 11<br />
Presentation <strong>of</strong> the post-conduction report <strong>of</strong> and ratification <strong>of</strong> the results <strong>of</strong><br />
Inferno’12.<br />
The report was not submitted by the General Secretary, Games and Sports Council. The General<br />
Secretary was requested to submit the report by the next meeting.<br />
Item No. 12<br />
Discussion on the report submitted by committee for constitutional changes<br />
regarding COSHA.<br />
The committee report was presented in detail by the Chair, Mr. Himanshu Pandey. The committee<br />
had proposed a constitutional amendment and a rules & procedures document. The following<br />
constitutional amendment was discussed by the Students’ <strong>Senate</strong> and sent to the Rules and<br />
Procedures Committee for getting its opinion:<br />
“The current Constitution states the following regarding the body <strong>of</strong> COSHA under the clause<br />
4.08(b):<br />
“ It shall consist <strong>of</strong> the President, the in charge Hostel Affairs, one SBRA Representative, Hall<br />
Presidents, and Mess Secretaries <strong>of</strong> every Hall <strong>of</strong> Residence and two Senators as <strong>Senate</strong> nominees. “<br />

(Hostel-In-Charge), two senators as senate nominees, President + one mess secretary from each<br />
hall <strong>of</strong> residence, SBRA convener and one SBRA representative.<br />
”<br />
The proposed rules and procedures for COSHA as approved by the <strong>Senate</strong> are placed at AP-1.<br />
A discussion on the closed-door nature <strong>of</strong> the COSHA meetings took place but the <strong>Senate</strong> could not<br />
reach a decision on keeping it closed door or open door. This discussion was deferred to the next<br />
Meeting due to lack <strong>of</strong> time.<br />
Item No. 13<br />
Presentation <strong>of</strong> the Revised <strong>Gymkhana</strong> Budget.<br />
Owing to the reduction <strong>of</strong> the matching grant, a revised budget allocation was proposed by the<br />
Finance Committee. The proposed budget as circulated with the agenda was accepted by the <strong>Senate</strong>.<br />
Further, regarding the distribution <strong>of</strong> SSF among Senators, the <strong>Senate</strong> decided that:<br />
1. Each Senator elected through <strong>Gymkhana</strong> General Elections, 2012 held in February, 2012,<br />
referred to as old Senator in the submitted document and hereafter, shall have Rs. 15,500<br />
and the maximum that he/she can contribute to a single Rs. 3875.<br />
2. Each Senator, elected through <strong>Gymkhana</strong> By-elections, 2012 held in September, 2012,<br />
referred to as new Senator in the submitted document and hereafter, shall have Rs. 8500 and<br />
the maximum he/she can contribute to a single event is Rs. 2125.<br />
As the above distribution is likely to cause a negative balance with some old senators due to the<br />
contributions made earlier, it was decided that the same would be taken care <strong>of</strong> by using the Buffer<br />
in the <strong>Gymkhana</strong> Budget as the total negative balance amounted to less than Rs. 5000.<br />

Discussion on the proposal for audit grade.<br />
The item was deferred for consideration in the next meeting <strong>of</strong> the <strong>Senate</strong>.<br />

Discussion on the proposal for mid-term reports by Senators.<br />
The item was deferred for consideration in the next meeting <strong>of</strong> the <strong>Senate</strong>.<br />
Item No. 16<br />
Discussion on the questions raised by Mr. Pankaj Kumar (Senator, PhD) regarding<br />
<strong>Gymkhana</strong> Elections and Golden Jubilee Celebrations.<br />
The questions were taken up for consideration one by one. The answers provided by the Convener<br />
are annexed at AP-2 to AP-4 and scanned copies <strong>of</strong> the relevant letters are placed at AP-5 and AP-6.<br />
Based on the discussion that followed the answers provided by the Convener, the senate decided<br />

The Convener shall discuss with the relevant authorities in Legal Cell <strong>of</strong> IIT <strong>Kanpur</strong> about<br />
the possibility <strong>of</strong> removing the restriction <strong>of</strong> age limit for PhD students for contesting<br />
<strong>Gymkhana</strong> elections and inform the senate accordingly.<br />
The Finance Committee shall supervise all the expenditures <strong>of</strong> <strong>Gymkhana</strong> Golden Jubilee<br />
and all the bills have to be approved by the FC before clearance. The Finance Convener was<br />
requested to make sure that all arrangements regarding forms are carried out at the earliest.<br />
The President apologized for his technical mistake. He clarified that he was not the co-PI for the<br />
<strong>Gymkhana</strong> Golden Jubilee Project as communicated by him in the 4 th Meeting <strong>of</strong> the Students’<br />
<strong>Senate</strong> 2012-13 held on 19 th August, 2012. The money had been allotted with the Dean, Students’<br />
Affairs alone as the PI.<br />
Item No. 17<br />
Discussion on the proposal to reinstate the contingency grant allotted for <strong>Institute</strong><br />
Assistantship granted students for the sum assured annually.<br />
The proposal was presented in detail by Senator, PhD, V. Srinivasan, for the consideration <strong>of</strong> the<br />
<strong>Senate</strong>. He informed the <strong>Senate</strong> that the contingency grant in no longer allotted to the students. He<br />
requested that the issue be taken up with the Administration to re-instate the contingency grant. The<br />
President, Students’ <strong>Gymkhana</strong> was directed to pursue to the matter with the administration.<br />
Item No. 18<br />
Discussion on the proposal to revise travel grant.<br />
The items were presented in detail for the consideration <strong>of</strong> the <strong>Senate</strong>. It was decided that the<br />
President would take up the request to revise the travel grant given for attending conferences.<br />
Senator, UG Y9, Pratik Moona requested that travel to competitions <strong>of</strong> a scholastic nature where<br />
the students are representing the <strong>Institute</strong> also be included in the purview <strong>of</strong> the grant.<br />
The President raised the issue <strong>of</strong> generation <strong>of</strong> the funds, asking the proposing Senators to provide<br />
some avenues for fulfilling the requirement.<br />
An ad-hoc subcommittee was set up to finalize the amount they feel the travel grant should be<br />
increased to, work out other modalities related to allotment <strong>of</strong> funds (for example- different grants<br />
based on region <strong>of</strong> conference) and suggest some avenues for generation <strong>of</strong> funds. The committee<br />

A question was raised regarding the functioning <strong>of</strong> the Halls <strong>of</strong> Residence and the<br />
constitution <strong>of</strong> the Halls, if any. The Convener clarified that the functioning <strong>of</strong> the Halls <strong>of</strong><br />
Residence are governed by the Ordinances <strong>of</strong> the <strong>Institute</strong>.<br />
Any other item, with the permission <strong>of</strong> the Chair.<br />
The Convener announced that he had received an extremely confidential Agenda item immediately<br />
before the convening <strong>of</strong> the meeting which needed to be considered. Upon request from the<br />
Convener, the following agenda item was discussed under closed door.<br />

Discussion on the complaint submitted by a Senator against the General Secretary,<br />
Games and Sports Council and any subsequent action to be taken.<br />
The Convener informed the <strong>Senate</strong> that he had received a complaint letter from a Senator who<br />
requested anonymity for fear <strong>of</strong> revengeful action, pertaining to the behavior <strong>of</strong> Mr. Yuvraj Dhillon,<br />
General Secretary, Games and Sports Council. The Convener read out the letter (annexed with these<br />
Minutes at AP-7 and AP-8) for the consideration <strong>of</strong> the <strong>Senate</strong>.<br />

The complainant had accused Mr. Yuvraj Dhillon <strong>of</strong> bribery, indiscipline, causing disrespect to the<br />
<strong>Senate</strong> and misuse <strong>of</strong> power as the General Secretary, Games and Sports and had proposed a noconfidence<br />
motion against the General Secretary.<br />
At the outset <strong>of</strong> the discussion, it was noted that a no-confidence motion required one senate<br />
member to propose and two senate members to second. Further, it was noted that due to the<br />
anonymity <strong>of</strong> the letter, the writer could not propose a no-confidence motion without revealing<br />
his/her identity.<br />
Based on the discussion that took place, the senate opined that:<br />
The comments made by the General Secretary in the 2 nd Special <strong>Senate</strong> meeting, 2012-13<br />
which were taken as basis for charges <strong>of</strong> bribery by the complainant were not intended to<br />
bribe anyone but rather for humor. However, the senate opined that no matter in what<br />
spirit, such comments should not be made on the floor <strong>of</strong> the <strong>Senate</strong>.<br />
Further, the senate opined that indeed the behavior <strong>of</strong> the General Secretary on the floor <strong>of</strong><br />
the senate was condemnable and he had been responsible for creating indiscipline in senate<br />
meetings.<br />
As nobody in the <strong>Senate</strong> agreed to propose or second the no-confidence motion suggested in the<br />
complaint letter, the no-confidence motion was dropped.<br />
Senator, UG Y9, Aman Haji proposed a censure motion against Mr. Yuvraj Dhillon, which was<br />
seconded by Senators, UG Y9 Jyoti Gupta and Pratik Moona and Senator UG Y12, Chirag Gupta.<br />
A vote by secret ballot was held, following which, the censure motion was passed by simple<br />
majority.<br />
The <strong>Senate</strong> has censured the General Secretary, Games and Sports Council for:<br />
The comments made by him in the 2 nd Special <strong>Senate</strong> Meeting, 2012-13 <strong>of</strong>fering treat and<br />
getting attendance marked present in PE.<br />
His general behavior on the floor <strong>of</strong> the senate causing indiscipline and grave disorder in the<br />
senate proceedings.<br />
Discussion on the request to hold a senate meeting in the week following<br />

The Convener accepted the request from several Senators to hold a senate meeting in the week<br />
following Antaragni to finish the pending agenda items <strong>of</strong> the meeting.<br />

“The following points will act as norms to be followed for all the proceedings <strong>of</strong> the COSHA.<br />
The one mess secretary who is a member <strong>of</strong> the COSHA from each hall should be nominated by the<br />
HEC via the President <strong>of</strong> that respective hall, at the beginning <strong>of</strong> the term. Thus, there shall be two<br />
members representing each hall in the COSHA, and the members <strong>of</strong> the COSHA will enjoy voting<br />
rights.<br />
The senate nominees for COSHA will be responsible for assisting with the COSHA paperwork,<br />
including writing the minutes <strong>of</strong> the COSHA meetings.<br />
The attendance criteria for COSHA meeting will only be applicable for senate nominees, the Chair<br />
and the COSHA Convener. The attendance norms for the standing sub-committees <strong>of</strong> the Students’<br />
<strong>Senate</strong>, as laid down in the <strong>Gymkhana</strong> Constitution shall be followed: if the attendance for any<br />
member <strong>of</strong> a standing committee, who is a member <strong>of</strong> the <strong>Senate</strong>, is less than half <strong>of</strong> the meetings<br />
held rounded down to the nearest integer, the COSHA Convener should report this to the Convener,<br />
Students’ <strong>Senate</strong>, who may call for either a written or a verbal explanation.<br />
The quorum for a COSHA meeting shall be one half <strong>of</strong> the total number <strong>of</strong> members <strong>of</strong> COSHA. “<br />

Question A. The Lyndogh committee recommendations for age restriction is applicable only in<br />
institutes where political parties/student union participate in Student body elections (like ABVP,<br />
BCSO supported students). However, in IIT <strong>Kanpur</strong> no such political parties are involved in<br />
Student body election.<br />
Answer A. Lyngdoh Committee report – page 38, line 1 clearly mentions that “It is to be noted<br />
here that the Recommendations No. 3 through 10 will apply to all modes <strong>of</strong> student elections.” The<br />
eligibility criterion for candidates comes under recommendation number 5 and hence applies to all<br />
modes <strong>of</strong> student elections. Further, no separate document or any guideline within the report has<br />
been found mentioning that these recommendations shall be applicable only for institutes where<br />
political parties/student union participate. However, if any such <strong>of</strong>ficial document which supports<br />
this claim can be brought to the notice <strong>of</strong> the senate, I am sure the senate shall be willing to reconsider.<br />
Question B. It is very heartening to know that the institute has approved Rs.1.5 crores for<br />
<strong>Gymkhana</strong> Golden Jubilee celebrations. Pls provide me the copy <strong>of</strong> the proposal which was<br />
submitted to the institute and also provide me copy <strong>of</strong> all the <strong>of</strong>ficial communication /letter/<strong>of</strong>fice<br />
order through which the amount was sanctioned by the institute.<br />

Further, a scanned copy <strong>of</strong> the 2 letters through which the amount was sanctioned has been<br />
placed on AP-5 and AP-6<br />
Question C The sanctioned budget for Golden Jubilee is *for gymkhana (50 years celebration)*<br />
which should be spent by the various executive wings <strong>of</strong> the gymkhana and not by the<br />
president alone which is similar to the expenditure process <strong>of</strong> annual budget <strong>of</strong> the gymkhana. So,<br />
why this process is not followed. Kindly provide details <strong>of</strong> any <strong>of</strong>fice order which clearly mentions<br />
that the president alone can decide the expenditure and allotments and also under which clause <strong>of</strong><br />
student gymkhana constitutions it has been mentioned that the students senate can form any such<br />
committee like the golden jubilee executive committee.<br />
Answer C A project has been setup under the Dean, R & D for <strong>Gymkhana</strong> Golden Jubilee with the<br />
Dean, Students’ Affairs as the PI. The money is being spent by all the councils and not by the<br />

President alone. However, being the Chief Executive <strong>of</strong> the Students’ <strong>Gymkhana</strong>, the President is<br />
entrusted with the ultimate responsibility <strong>of</strong> execution <strong>of</strong> all activities under the name <strong>of</strong> Students’<br />
<strong>Gymkhana</strong>. Further, the President has the right to provide his recommendation regarding the<br />
distribution just as anyone else in the <strong>Senate</strong>, but the final allocation has to be approved by the<br />
<strong>Senate</strong>. The same was carried out in the 2nd Special <strong>Senate</strong> Meeting.<br />
The Golden Jubilee Committee has been setup under the Presidential Council to assist him in the<br />
successful organization <strong>of</strong> Golden Jubilee Celebrations. Article 5.04 a) <strong>of</strong> the <strong>Gymkhana</strong><br />
Constitution states that “The aim <strong>of</strong> the Presidential Council shall be to help the President in<br />
discharging his/her duties and any other duty assigned by the <strong>Senate</strong>.”<br />
Question D: As per the following clause in the gymkhana constitution, *4.04 Finance Committee<br />
(FC)<br />
a. The Primary aim <strong>of</strong> the Finance Committee is to manage the finances <strong>of</strong> the Students’ <strong>Gymkhana</strong>,<br />
and it shall control and supervise the expenditures incurred by the executive wings <strong>of</strong> the<br />
<strong>Gymkhana</strong>. It shall report to the <strong>Senate</strong> <strong>of</strong> Finances and Accounts periodically, as prescribed by the<br />
<strong>Senate</strong>.*<br />
*14. Payments will normally be made if the executive concerned verifies a bill and it has been<br />
examined by the FC and approved/accepted* *( as mentioned in Apendix II)*Does the current FC<br />
supervise and approve the expenditures <strong>of</strong> the Golden Jubilee Fund as the president who is<br />
spending it now is under student gymkhana and is an head <strong>of</strong> executive wing <strong>of</strong> gymkhana. Kindly<br />
provide supporting documents with regards to your answer..<br />
Answer: As <strong>of</strong> now, the Finance Committee has informed that they have not received any bills so<br />
far. However, in principle, all bills have to be approved by the Finance Committee. The Finance<br />
Committee has been requested to make sure that this procedure is strictly followed.<br />
Question E: Who is responsible for any discrepancy in the expenditures and mismanagement <strong>of</strong><br />
events in the golden jubilee. Kindly provide supporting documents which clearly mentions the<br />
responsibility<br />
Answer: As in all matters <strong>of</strong> <strong>Gymkhana</strong>, the policy decisions are always taken by the senate and the<br />
complete legislative responsibility associated with the decisions lies with the Students’ <strong>Senate</strong>. The<br />
responsibility to control and supervise the finances lies with the Finance Committee. Also, it is the<br />

responsibility <strong>of</strong> the Finance Committee to point out to the <strong>Senate</strong> any discrepancies that they find<br />
out regarding the expenditures which are being approved by it. Finally, the responsibilities related to<br />
all the executive work lies with Golden Jubilee Committee, President, Students’ <strong>Gymkhana</strong> and<br />
concerned executive in case <strong>of</strong> work related to a particular council.<br />
Question F: Why was the expenditure on the opening ceremony was not ratified and shared to the<br />
general body members prior to the event. Kindly provide supporting documents which clearly<br />
mentions that the president can spend on an event prior to ratification <strong>of</strong> the budget and upto what<br />
amount.<br />
Answer: As the allotment <strong>of</strong> Rs. 5.5 lakhs was made specifically for the opening ceremony <strong>of</strong><br />
<strong>Gymkhana</strong> Golden Jubilee (ref. letter at AP-5), hence this was allowed only for the opening<br />
ceremony. All the rest <strong>of</strong> the distribution had to be approved by the <strong>Senate</strong> and this approval was<br />
carried out in the 2nd Special <strong>Senate</strong> meeting.<br />
