3.5 RECEIVING RULINGS AND RESOLUTIONS<br />

This chapter conta<strong>in</strong>s some guidance on avoid<strong>in</strong>g potential slips when receiv<strong>in</strong>g decisions<br />

issued by an adm<strong>in</strong>istrative authority and thus make sure that your rights are<br />

be<strong>in</strong>g enforced.<br />

a. All rul<strong>in</strong>gs and resolutions must be handed to you <strong>in</strong> person. In most cases<br />

this means mail delivery and if so, you will be required to sign <strong>the</strong> acknowledgment<br />

<strong>of</strong> receipt, confirm<strong>in</strong>g that <strong>the</strong> delivery was received.<br />

The day you receive any <strong>of</strong>ficial documents will always be important, because<br />

it is considered as a start<strong>in</strong>g date <strong>of</strong> a limited eligibility period, dur<strong>in</strong>g<br />

which you must ei<strong>the</strong>r regularise your application or perform some o<strong>the</strong>r<br />

specified action. If you fail to perform <strong>the</strong> required action with<strong>in</strong> <strong>the</strong> given<br />

deadl<strong>in</strong>es due to negligence, you are runn<strong>in</strong>g <strong>the</strong> risk <strong>of</strong> adm<strong>in</strong>istrative procedure<br />

term<strong>in</strong>ation.<br />

b. If you have a legal or authorised representative, keep an eye on <strong>the</strong> arrival <strong>of</strong><br />

all mail that he is to receive on your behalf.<br />

c. Decisions regard<strong>in</strong>g your applications will be sent to <strong>the</strong> address you specify<br />

<strong>in</strong> your applications, so make sure you give <strong>the</strong> exact and exist<strong>in</strong>g address. If<br />

you do not have your own address, use one belong<strong>in</strong>g to a person you trust.<br />

3.6 THE RIGHT TO APPEAL<br />

You may appeal aga<strong>in</strong>st a decision addressed to you on <strong>the</strong> first level, even if adm<strong>in</strong>istrative<br />

authority did not specify this fact <strong>in</strong> <strong>the</strong> decision. It is, on <strong>the</strong> o<strong>the</strong>r hand,<br />

impossible to make an appeal if <strong>the</strong> decision explicitly <strong>in</strong>dicates it. You may submit a<br />

compla<strong>in</strong>t about a decision at <strong>the</strong> adm<strong>in</strong>istrative authority that issued <strong>the</strong> decision.<br />

You may do so ei<strong>the</strong>r <strong>in</strong> writ<strong>in</strong>g or orally on <strong>the</strong> record.
