• choose such measures <strong>in</strong> <strong>the</strong> decision-mak<strong>in</strong>g process, which are more beneficial<br />
for <strong>the</strong> party, provided that all legal provisions are be<strong>in</strong>g considered<br />
and respected;<br />
• make sure that a lack <strong>of</strong> <strong>in</strong>formation on your side does not affect your legal<br />
rights;<br />
The General Adm<strong>in</strong>istrative Procedure Act (ZUP) determ<strong>in</strong>es that <strong>the</strong> adm<strong>in</strong>istrative<br />
authority must issue a decision to a party <strong>in</strong> <strong>the</strong> adm<strong>in</strong>istrative<br />
proceed<strong>in</strong>g after a maximum period <strong>of</strong> one month after a complete application<br />
had been received, unless a fact-f<strong>in</strong>d<strong>in</strong>g procedure is rendered necessary.<br />
In all o<strong>the</strong>r cases a decision must be issued <strong>in</strong> two months later at <strong>the</strong> latest.<br />
The adm<strong>in</strong>istrative <strong>of</strong>ficer is bound by duty to notify you if your application is<br />
<strong>in</strong>complete and <strong>of</strong>fer advice regard<strong>in</strong>g possible solutions.<br />
• expla<strong>in</strong> procedures, rights and duties that you may be <strong>in</strong>terested <strong>in</strong> without<br />
you hav<strong>in</strong>g to <strong>of</strong>fer any explanation whatsoever as to <strong>the</strong> reason why this<br />

• allow you to exercise <strong>the</strong> right to cooperation <strong>in</strong> <strong>the</strong> procedure, and to give<br />
your statement with regard to all <strong>the</strong> facts and circumstances related to your<br />
application.<br />
Accord<strong>in</strong>g to <strong>the</strong> General Adm<strong>in</strong>istrative Procedure Act, a party to an adm<strong>in</strong>istrative<br />
proceed<strong>in</strong>g can be any natural or legal person, governed by private or public law, who<br />
<strong>in</strong>itiated <strong>the</strong> adm<strong>in</strong>istrative procedure, or aga<strong>in</strong>st whom <strong>the</strong> adm<strong>in</strong>istrative procedure<br />
is tak<strong>in</strong>g place. A group <strong>of</strong> people may also be def<strong>in</strong>ed as a party if <strong>the</strong>se people are<br />
entitled to have rights and obligations which will be decided upon <strong>in</strong> <strong>the</strong> adm<strong>in</strong>istrative<br />
proceed<strong>in</strong>g.
