5.0 m above the building entrance. All other accessory residential buildings<br />

shall not exceed 5.0 m.<br />

(19) For single dwellings, duplex dwellings and townhouse complexes, one<br />

basement storey may be situated below the first storey.<br />

Apartment<br />

(20) The height <strong>of</strong> apartment buildings shall not exceed 12.0 m.<br />

(21) All accessory buildings and structures on land being used for apartment<br />

buildings shall not exceed 5.0 m in height.<br />

(22) For apartment buildings, there shall be no limit on the number <strong>of</strong> basement<br />

storeys being situated below the first storey.<br />

Building Setbacks<br />

(23) Building setbacks shall be provided with sufficient depth whereby all snow<br />

shed from the ro<strong>of</strong> will be retained on the subject parcel.<br />

(24) A greater setback required by a Development Permit pursuant to the<br />

provisions <strong>of</strong> Section J <strong>of</strong> the “<strong>Silver</strong> <strong>Star</strong> Official Community Plan” will take<br />

precedence over the setbacks outlined below in Sections 503(25) to<br />

503(27) <strong>of</strong> this bylaw.<br />

(25) Except where a greater distance is required pursuant to Sections 315,<br />

503(23)and 503(24) <strong>of</strong> this bylaw, no single dwelling or duplex dwelling<br />

shall be located within:<br />

(a) 5.0 m <strong>of</strong> the rear property line;<br />

(b) 3.0 m <strong>of</strong> a side property line;<br />

(c) 5.0 m <strong>of</strong> an exterior side property line; and<br />

(d) 5.0 m <strong>of</strong> the front property line.<br />

(26) Except where a greater distance is required pursuant to Sections 315,<br />

503(23)and 503(24) <strong>of</strong> this bylaw, no townhouse complex or apartment<br />

building shall be located within:<br />

(a) 5.0 m <strong>of</strong> the rear property line;<br />

(b) 3.0m <strong>of</strong> a side property line except where a property line abuts a<br />

parcel for a single dwelling or duplex dwelling, the setback shall<br />

be 5.0 m;<br />

(c) 5.0 m <strong>of</strong> an exterior side property line; and<br />

(d) 5.0 m <strong>of</strong> the front property line.<br />
