by, or under common control with such person). A facility may<br />

contain more than one establishment.”<br />

EPCRA section 313 defines establishment as “an economic<br />

unit, generally at a single physical location, where business is<br />

conducted or where services or industrial operations are<br />

performed.” Under section 372.30(c) of the reporting rule, you<br />

may submit a separate Form R for each establishment, or for<br />

groups of establishments in your facility, provided all releases<br />

<strong>and</strong> other waste management activities <strong>and</strong> source reduction<br />

activities involving the EPCRA section 313 chemical from the<br />

entire facility are reported. This allows you the option of<br />

reporting separately on the activities involving an EPCRA<br />

section 313 chemical at each establishment, or group of<br />

establishments (e.g., part of a covered facility), rather than<br />

submitting a single Form R for that EPCRA section 313<br />

chemical for the entire facility. However, if an establishment<br />

or group of establishments does not manufacture, process, or<br />

otherwise use or release or otherwise manage as waste an<br />

EPCRA section 313 chemical, you do not have to submit a<br />

report for that establishment or group of establishments for that<br />

particular chemical. (See also Section B.2.a of these<br />

instructions.)<br />

A covered facility must report all releases <strong>and</strong> other waste<br />

management activities <strong>and</strong> source reduction activities of an<br />

EPCRA section 313 chemical if the facility meets a reporting<br />

threshold for that EPCRA section 313 chemical. However, if<br />

the facility is composed of several distinct establishments, EPA<br />

allows these establishments to submit separate reports for the<br />

EPCRA section 313 chemical as long as all releases <strong>and</strong> other<br />

waste management activities of the EPCRA section 313<br />

chemical from the entire facility are accounted for. Whether<br />

submitting a report for the entire facility or separate reports for<br />

the establishments, the threshold determination must be made<br />

based on the entire facility. Indicate in Section 4.2 whether<br />

your report is for the entire covered facility as a whole or for<br />

part of a covered facility (i.e., one or more establishments).<br />

Federal facilities <strong>and</strong> contractors at federal facilities<br />

(GOCOs—Government-owned, contractor-operated facilities)<br />

should check either 4.2c or 4.2d, but not both. Federal facilities<br />

should check 4.2c, even if their TRI reports contain release <strong>and</strong><br />

other waste management information from contractors located<br />

at the facility. Contractors at federal facilities, which are<br />

required by EPCRA section 313 to file TRI reports<br />

independently of the federal facility, should check 4.2d. This<br />

information is important to prevent duplication of federal<br />

facility data. (See Appendix A for further guidance on these<br />

instructions.)<br />

4.3 Technical Contact<br />

Enter the name <strong>and</strong> telephone number (including area code) of<br />

a technical representative whom EPA or state officials may<br />

contact for clarification of the information reported on Form R.<br />

You should also enter an email address for this person. If the<br />

technical contact does not have an email address you should<br />

enter NA. This contact person does not have to be the same<br />

person who prepares the report or signs the certification<br />

statement <strong>and</strong> does not necessarily need to be someone at the<br />

location of the reporting facility. However, this person should<br />

be familiar with the details of the report so that he or she can<br />

answer questions about the information provided.<br />

4.4 Public Contact<br />

Enter the name <strong>and</strong> telephone number (including area code) of<br />

a person who can respond to questions from the public about the<br />

report. If you choose to designate the same person as both the<br />

technical <strong>and</strong> the public contact, you may enter “Same as Section<br />

4.3” in this space. This contact person does not have to be the<br />

same person who prepares the report or signs the certification<br />

statement <strong>and</strong> does not necessarily need to be someone at the<br />

location of the reporting facility. If your facility does not have<br />

a public contact, provide the technical contact name <strong>and</strong><br />

telephone number in the public contact name <strong>and</strong> telephone<br />

number fields.<br />

4.5 St<strong>and</strong>ard Industrial Classification (SIC) Code<br />

Enter the appropriate four-digit St<strong>and</strong>ard Industrial<br />

Classification (SIC) Code that is the primary SIC Code for your<br />

facility in Section 4.5(a). Enter any other applicable SIC Codes<br />

for your facility in 4.5 (b)–(f). Table I lists the SIC codes within<br />

10 (except 1011, 1081, <strong>and</strong> 1094), 12 (except 1241), 20–39,<br />

4911 (limited to facilities that combust coal <strong>and</strong>/or oil for the<br />

purpose of generating electricity for distribution in commerce),<br />

4931 (limited to facilities that combust coal <strong>and</strong>/or oil for the<br />

purpose of generating electricity for distribution in commerce),<br />

4939 (limited to facilities that combust coal <strong>and</strong>/or oil for the<br />

purpose of generating electricity for distribution in commerce),<br />

4953 (limited to facilities regulated under the RCRA Subtitle C,<br />

42 U.S.C. section 6921 et seq.), 5169, 5171, <strong>and</strong> 7389 (limited<br />

to facilities primarily engaged in solvent recovery services on a<br />

contract or fee basis). If the report covers more than one<br />

establishment, enter the primary 4-digit SIC code for each<br />

establishment starting with the primary SIC code for the entire<br />

facility. You are required to enter SIC codes only for those<br />

establishments within the facility that fall within SIC codes 10<br />

(except 1011, 1081, <strong>and</strong> 1094), 12 (except 1241), 20–39, 4911<br />

(limited to facilities that combust coal <strong>and</strong>/or oil for the purpose<br />

of generating electricity for distribution in commerce), 4931<br />

(limited to facilities that combust coal <strong>and</strong>/or oil for the purpose<br />

of generating electricity for distribution in commerce), 4939<br />

(limited to facilities that combust coal <strong>and</strong>/or oil for the purpose<br />

of generating electricity for distribution in commerce), 4953<br />

(limited to facilities regulated under the RCRA Subtitle C, 42<br />

U.S.C. section 6921 et seq.), 5169, 5171, <strong>and</strong> 7389 (limited to<br />
