miscellaneous debts where the debtor is adjudged bankrupt, insolvent<br />

or (in the case of companies) in liquidation and where the officer<br />

judged that recovery of the monies was not economically possible.<br />

There was no financial limit to the amount that could be written off in<br />

these circumstances<br />

2.4.3 In simplifying these arrangements the new constitution has set a limit in<br />

all cases of write-offs at £5,000.<br />

2.4.4 It is proposed to amend delegation 11.1 (d) (i) so that any proposed<br />

write off over a specified amount can only be authorised by the<br />

Executive Director with S151 responsibilities after consultation with the<br />

Leader of the <strong>Council</strong> (or other specified Executive Member).<br />

2.4.5 The Executive is asked to consider an appropriate financial limit and<br />

whether, in the case of bankruptcy, insolvency or liquidation the same<br />

financial limit should apply or whether the <strong>Council</strong> should revert to an<br />

unlimited delegation.<br />

2.5 The State of the Area Address<br />

2.5.1 The <strong>Council</strong> Procedure Rules (pages 60 to 78) at Rule 16 require the<br />

State of the Area Address to be reported to the Scrutiny Committee for<br />

consideration as part of the consultation process. This provision was<br />

copied across from the previous constitution when the <strong>Council</strong> had a<br />

single Scrutiny Committee. Having regard to the remits of the Policy<br />

Review Committee and the Scrutiny Committee it is more appropriate<br />

for the State of the Area Address to the considered by the Policy<br />

Review Committee (as it was this year) and it is proposed that<br />

Procedure Rule 16 is amended to reflect this.<br />

The relatively minor administrative amendments set out above are proposed<br />

as sensible improvements to the Constitution and have come to light in the<br />

first six months of operating with the new arrangements<br />
