The key issues in the determination of this application are therefore whether<br />

the proposals overcome the previous reasons for refusal in terms of the<br />

principle of development, in particular in terms of housing numbers having<br />

had regard to the context of the release of the Phase 2 sites <strong>with</strong>in the Local<br />

Plan, whether the proposals enable comprehensive development of the<br />

Phase 2 site <strong>and</strong> provides a deliverable mechanism for the provision of<br />

improved primary school facilities.<br />

Having had regard to these issues it is considered that the current application<br />

overcomes the previous reasons for refusal <strong>and</strong> as such is acceptable in<br />

principle.<br />

In addition in terms of the proposed access to the site, implications of the<br />

development on the wider highways network, the environmental impacts of<br />

the scheme in terms of flood / drainage, ecology / biodiversity, l<strong>and</strong><br />

contamination, energy efficiency <strong>and</strong> cumulative impact the proposals are<br />

considered acceptable in accordance <strong>with</strong> policy.<br />

The proposals would also contribute to the general housing provision <strong>with</strong>in<br />

the <strong>District</strong> including the provision for affordable housing <strong>and</strong> would provide<br />

financial contributions towards the provision of highway improvements,<br />

education, waste <strong>and</strong> recycling facilities <strong>and</strong> would secure affordable housing,<br />

recreational open space, a travel plan <strong>and</strong> additional school l<strong>and</strong>.<br />

As such, having had regard to the development plan, all other relevant local<br />

<strong>and</strong> national planning policies, consultation responses received to date <strong>and</strong> all<br />

other material planning considerations, it is considered that the proposed<br />

development is acceptable in principle <strong>and</strong> accords <strong>with</strong> policy.<br />

Recommendation:<br />

This planning application is recommended to be APPROVED subject to:<br />

i) Delegation being given to officers to complete the Section 106<br />

Agreement to secure contributions for highways,<br />

recreational open space, education <strong>and</strong> waste <strong>and</strong> recycling<br />

facilities <strong>and</strong> to secure affordable housing provision, a<br />

travel plan, deliverability of additional school l<strong>and</strong>; <strong>and</strong> a<br />

management plan for protection <strong>and</strong> connectivity of ditches<br />

<strong>and</strong> watercourses.<br />

ii) the conditions detailed in paragraph 2.27.1 of this report<br />

1.1 The Site<br />

1.1.1 The application site is part of the Phase 2 SHB/1B allocation as defined<br />

in the <strong>Selby</strong> <strong>District</strong> Local Plan (2005) <strong>and</strong> lies between Moor Lane <strong>and</strong><br />
