13.1 Application: 2012/0028/COU<br />

Location: Street Record, <strong>Selby</strong> Bypass, Gateforth, <strong>Selby</strong><br />

Proposal: Change of use of l<strong>and</strong> from mushroom farm to<br />

showpeoples quarters on l<strong>and</strong> to the south.<br />

The Planning Officer presented a report which had been referred to the<br />

Planning Committee due to it considered to be locally controversial given the<br />

number of objections received on the scheme.<br />

The Planning Officer explained that for the change of use of site from its last<br />

use as part of the “Mushroom Farm” to “showpeoples quarters” creating ten<br />

plots <strong>with</strong> a road through the middle of the site.<br />

The Committee were informed that having had regard to all relevant policies<br />

<strong>and</strong> other material considerations it was considered that the proposal was<br />

acceptable in principle. The main issue to consider was need for provision of<br />

a site for Showpeople <strong>and</strong> the impacts arising from the development.<br />

Within the officers update note, information was provided on an updated<br />

consultation response. Further information was also provided by the<br />

Environment Agency <strong>and</strong> there was also an amendment to a condition. The<br />

Planning Officer also recommended an amendment to the wording of the<br />

recommendation to be:<br />

This application is recommended to be APPROVED subject to completion of a<br />

S106 agreement as detailed in the update note <strong>and</strong> the conditions detailed at<br />

paragraph 2.23 of the officer report.<br />

• Elected Chair of Thorpe Action Group.<br />

• The report is not a legally binding document <strong>and</strong> represents the<br />

desires of the Showpeople.<br />

• The application is for 10 plots however only 8 farm units have been<br />

detailed.<br />

• The Showpeople attend 94% of fairs outside of North Yorkshire<br />

which does not demonstrate a desperate need.<br />

• There is a lack of detail in how the surface <strong>and</strong> waste water drainage<br />

would be dealt <strong>with</strong> <strong>and</strong> a proposed S106 agreement must cover<br />

how these elements would be dealt <strong>with</strong>.<br />

• It has been stated that a development should not add or increase<br />

distances of travel to work <strong>and</strong> the proposal goes against the fact<br />

that 94% of Showpeople attend fairs outside of North Yorkshire.<br />

• This application does not meet requirements for sustainable<br />

development.<br />
