2.11 Other Considerations<br />

2.11.1 Having taken into account comments in the objection letter in relation to previous<br />

applications on this site, size <strong>and</strong> scale not been in keeping, height increase <strong>and</strong><br />

levels, boundary treatments, impact on public amenity, road safety <strong>and</strong> access<br />

these issues were all taken into account <strong>with</strong> the Appeal decision which granted<br />

approval for the proposals <strong>and</strong> as stated above there would appear to be no<br />

changes since this approval that would warrant a different decision to that originally<br />

made.<br />

2.11.2 Comments relating to changes since the previous approval in terms of the growth of<br />

South Milford, impact on amenities <strong>and</strong> schools have been taken into account,<br />

however given the small scale of this development it is not considered that it would<br />

result on a significant impact to lead to a different decision.<br />

2.11.3 In terms of the assessment against the NPPF this is detailed above.<br />

2.12 Conclusion<br />

2.12.1 The development proposed is an application for extension of time for the erection of<br />

3no. detached dwellings following the demolition of the existing dwelling, which was<br />

judged to be acceptable at an earlier date. The main issue is therefore whether<br />

there are any significant changes in the development plan or other relevant material<br />

considerations since the permission was granted, which would lead to a significantly<br />

different decision on the application. Having taken into account the changes to the<br />

site <strong>and</strong> its surroundings, planning applications on or around the site <strong>and</strong> changes<br />

in policy since the previous approval it is not considered that there are other<br />

material considerations that would lead to a significantly different decision <strong>and</strong> as<br />

such the application should be approved in accordance <strong>with</strong> the conditions set out<br />

on the original consent <strong>and</strong> as detailed below.<br />

2.13 Recommendation<br />

This application is recommended to be APPROVED subject to the following<br />

conditions:<br />

1. The development hereby permitted shall begin not later than three years from<br />

the date of this decision.<br />

Reason:<br />

In order to comply <strong>with</strong> the provisions of Section 51 of the Planning <strong>and</strong><br />

Compulsory Purchase Act 2004.<br />

2. No development shall take place until samples of the materials to be used in the<br />

construction of the external surfaces of the buildings hereby permitted have<br />

been submitted to <strong>and</strong> approved in writing by the Local Planning Authority.<br />

Development shall be carried out in accordance <strong>with</strong> the approved details.<br />
