policy since the previous approval it is not considered that there are other material<br />

considerations that would lead to a significantly different decision.<br />

2.12 Recommendation<br />

This application is recommended to be APPROVED subject to the following<br />

conditions:<br />

1. Approval of the details of the (a) layout, (b) scale, (c) external appearance of the<br />

buildings, (d) the l<strong>and</strong>scaping of the site (hereinafter called 'the reserved matters')<br />

shall be obtained from the Local Planning Authority in writing before any<br />

development is commenced.<br />

Reason: This is an outline permission <strong>and</strong> these matters have been reserved for the<br />

subsequent approval of the Local Planning Authority, <strong>and</strong> as required by Section 92<br />

of the Town <strong>and</strong> Country Planning Act 1990.<br />

2. <strong>Applications</strong> for the approval of the reserved matters referred to in No.2 herein shall<br />

be made <strong>with</strong>in a period of three years from the grant of this outline permission <strong>and</strong><br />

the development to which this permission relates shall be begun not later than the<br />

expiration of two years from the final approval of the reserved matters or, in the<br />

case of approval on different dates, the final approval of the last such matter to be<br />

approved.<br />

Reason: In order to comply <strong>with</strong> the provisions of Section 51 of the Planning <strong>and</strong><br />

Compulsory Purchase Act 2004.<br />

3. Unless otherwise approved in writing by the Local Planning Authority, there shall be<br />

no excavation or other groundworks, except for investigative works, or the<br />

depositing of material on the site until the access(es) to the site have been set out<br />

<strong>and</strong> constructed in accordance <strong>with</strong> the published Specification of the Highway<br />

Authority <strong>and</strong> the following requirements:<br />

The access to Lambourne shall be formed to give a minimum<br />

carriageway width of 3.2 metres, <strong>and</strong> that part of the access road<br />

extending 6 metres into the site shall be constructed in accordance <strong>with</strong><br />

St<strong>and</strong>ard Detail number E6.<br />

Any gates or barriers shall be erected a minimum distance of 6 metres<br />

back from the carriageway of the existing highway <strong>and</strong> shall not be able<br />

to swing over the existing or proposed highway.<br />

Provision shall be made to prevent surface water from the site/plot<br />

discharging onto the existing or proposed highway in accordance <strong>with</strong> the<br />

Specification of the Local Highway Authority. All works shall accord <strong>with</strong><br />

the approved details unless otherwise agreed in writing by the Local<br />

Planning Authority.<br />

You are advised that a separate licence will be required from the Highway Authority<br />

in order to allow any works in the adopted highway to be carried out. The<br />

‘Specification for Housing <strong>and</strong> Industrial Estate Roads <strong>and</strong> Private Street Works’<br />

published by North Yorkshire County Council, the Highway Authority, is available at<br />

the County Council’s offices. The local office of the Highway Authority will also be<br />
