Not<strong>with</strong>st<strong>and</strong>ing this the applicant has failed to provide sufficient information to enable the<br />

Local planning Authority to undertake an assessment of impacts <strong>and</strong> to discharge its<br />

duties under the Habitats Regulations 1994.<br />

As such the proposal would be contrary to Policies GB2 <strong>and</strong> GB4 of the <strong>Selby</strong> <strong>District</strong><br />

Local Plan <strong>and</strong> the guidance in Planning Policy Guidance Note 2 ‘Green Belts’.<br />

RECOMMENDATION:<br />

This application is recommended to be Refused for the following reasons:<br />

1 The proposed nursing home, by virtue of its nature would constitute inappropriate<br />

development <strong>with</strong>in the Green Belt, wherein it is national <strong>and</strong> local policy to resist<br />

such development except in very special circumstances, which have not been<br />

demonstrated in this instance. The proposal is therefore contrary to Policy GB2 of<br />

the <strong>Selby</strong> <strong>District</strong> Local Plan <strong>and</strong> the guidance contained in PPG2.<br />

2. The proposed nursing home, by virtue of its size, scale <strong>and</strong> location would detract<br />

from the open character of this Green Belt location contrary to Policy GB4 of the<br />

<strong>Selby</strong> <strong>District</strong> Local Plan.<br />

3. The Regional Spatial Strategy for Yorkshire <strong>and</strong> the Humber (2008) would direct<br />

development of this nature to Principal Towns <strong>and</strong> Local Service Centres. In the<br />

absence of a case to demonstrate how the proposal would benefit the rural<br />

economy or be accessible to public transport, for example, the proposal is in an<br />

unsustainable location contrary to Policies YH6 <strong>and</strong> ENV11 of the Yorkshire <strong>and</strong><br />

Humber Plan.<br />

4. The applicant has failed to provide sufficient information to allow the Local Planning<br />

Authority to make a full <strong>and</strong> proper assessment of the impacts of the proposal on<br />

bats in accordance <strong>with</strong> the guidance in PPS9 <strong>and</strong> accompanying ODPM Circular<br />

06/2005 “Biodiversity <strong>and</strong> Geological Conservation- Statutory Obligations And Their<br />

Impact Within The Planning System <strong>and</strong> to undertake its duties under the Habitat<br />

Regulations 1994.<br />
