The L<strong>and</strong>scape Assessment of the district prepared in 1999 to support the emerging Local<br />

Plan refers to the number of country mansions in this area <strong>and</strong> Scarthingwell, although the<br />

local manor associated has gone, makes a distinctive contribution to the l<strong>and</strong>scape.<br />

Policy ENV9 of the RSS would seek to conserve historic parks <strong>and</strong> gardens, to enhance<br />

their character <strong>and</strong> reinforce distinctiveness. The local plan policy is intended to ensure<br />

that the remaining parkl<strong>and</strong> is protected. In this respect it is noted the important features<br />

<strong>with</strong>in the park would be retained <strong>and</strong> that the building would occupy the area already<br />

occupied by buildings, <strong>and</strong>, or, hard-st<strong>and</strong>ing. The proposal would therefore not harm the<br />

setting, character <strong>and</strong> amenity of the Locally Important Historic Park <strong>and</strong> thus would not be<br />

contrary to Policy ENV16 of the Local Plan.<br />

5. Effect on Local Amenity<br />

The nearest residential property to the site is Scarthingwell View (The Old Headmaster’s<br />

House), to the south west. The occupant of this property has objected on grounds<br />

including loss of privacy, overlooking <strong>and</strong> light pollution as a result of the proposed building<br />

being brought closer to his property. The part of the proposed building closest to this<br />

neighbour would be single <strong>and</strong> two-storey <strong>with</strong> the nearest two storey element being some<br />

23m away from the dweling. In view of these distances <strong>and</strong> the intervening boundaries, it<br />

is not considered that this relationship would significantly detract from the amenity of the<br />

occupier of Scarthingwell View.<br />

There are no other residential neighbours that may be affected by the proposal.<br />

6. Highway Safety<br />

Under Policy T2 development proposals which would result in the creation of a new<br />

access or the intensification of use of an existing access should be permitted provided that<br />

there would be no detriment to highway safety. The proposal would not result in the<br />

creation of a new access <strong>and</strong> therefore the only consideration is whether the use would, by<br />

virtue of intensifying the use of the existing access, be detrimental to highways safety. In<br />

this respect the comments made by the objectors are noted.<br />

The application information states that the maximum number of staff on duty would<br />

increase from 19 to 23 as a result of this proposal. The change from a 50 bed nursing<br />

home to a 50 bed care home <strong>with</strong> 15 close care apartments coupled <strong>with</strong> this minor<br />

increase in the number of staff is not considered to have any material effects on traffic<br />

generation <strong>and</strong> thus highway safety implications.<br />

It is understood that there are no fixed visiting times so there is thus unlikely to be any<br />

peaks in visitor flows that might impact on the network.<br />

The Highway Authority has not raised any objection to the proposal <strong>and</strong> it is concluded<br />

that the proposal would not be detrimental to highway safety <strong>and</strong> would comply <strong>with</strong> local<br />

plan Policy T2.<br />

7. The Relative Sustainability of the Development<br />

The Core Approach of the RSS would see the Principal Towns as the main local focus for<br />

new development (Policy YH5). In <strong>Selby</strong> <strong>District</strong>, <strong>Selby</strong> town itself is the sole designated<br />

principal town.<br />
