• no special circumstances have been advanced to warrant development in the<br />

Green Belt, disproportionate additions are not appropriate,<br />

• there will be an adverse effect on wildlife, the lake <strong>and</strong> the parkl<strong>and</strong>,<br />

• the development on three floors would be intrusive,<br />

• road safety issues <strong>and</strong> concerns over no objection from the highway authority.<br />

The letters from the local residents object on grounds relating to the lack of concern from<br />

the highway authority; the incidence of fatalities <strong>and</strong> accidents on the A162; objection to a<br />

third floor being added <strong>and</strong> the consequent additional staff <strong>and</strong> visitor traffic; that the site<br />

has grown since it was a school <strong>and</strong> water courses <strong>and</strong> sewage disposal need checking.<br />

In addition, there are then a series of annotated <strong>and</strong> historical photographs, press articles<br />

<strong>and</strong> copy correspondence from other bodies, including the Government Office, relating to<br />

protected species issues, a definition of material considerations, the scale of development<br />

<strong>and</strong> road safety issues.<br />

Section 38(6) of the Planning <strong>and</strong> Compulsory Purchase Act 2004 states "if regard is to be<br />

had to the development plan for the purpose of any determination to be made under the<br />

planning acts the determination must be, made in accordance <strong>with</strong> the plan unless<br />

material considerations indicate otherwise". The development plan for the <strong>Selby</strong> <strong>District</strong><br />

May 2008) <strong>and</strong> the policies in the <strong>Selby</strong> <strong>District</strong> Local Plan (adopted on 8 February 2005)<br />

saved by the direction of the Secretary of State.<br />
