1.4.8 Yorkshire Wildlife Trust<br />

The bat survey looks fine. As a maternity roost was previously found at the site a<br />

European Protected Species licence will need to be applied for <strong>and</strong> mitigation <strong>and</strong><br />

compensation planned as part of the application for the licence. The replacement<br />

bat roost will need to be provided before the present roost is demolished.<br />

1.4.9 Natural Engl<strong>and</strong><br />

This proposal does not appear to affect any statutorily protected sites or<br />

l<strong>and</strong>scapes, or have significant impacts on the conservation of soils, nor is the<br />

proposal EIA development. No objections to the bat survey.<br />

1.4.10 Garden History Society<br />

No response received <strong>with</strong>in statutory consultation period.<br />

1.4.11 Saxton Cum Scarthingwell Parish Council<br />

No response received <strong>with</strong>in statutory consultation period.<br />

1.5 Publicity<br />

1.5.1 The application was advertised by site notice, neighbour notification letter <strong>and</strong><br />

advertisement in the local newspaper resulting in no objections being received<br />

<strong>with</strong>in the statutory consultation period.<br />

2. Report<br />

2.1 Section 38(6) of the Planning <strong>and</strong> Compulsory Purchase Act 2004 states "if regard<br />

is to be had to the development plan for the purpose of any determination to be<br />

made under the planning Acts the determination must be made in accordance <strong>with</strong><br />

the plan unless material considerations indicate otherwise". The development plan<br />

for the <strong>Selby</strong> <strong>District</strong> comprises the policies in the <strong>Selby</strong> <strong>District</strong> Local Plan (adopted<br />

on 8 February 2005) saved by the direction of the Secretary of State <strong>and</strong> the<br />

Regional Spatial Strategy for Yorkshire <strong>and</strong> the Humber (adopted 2008).<br />
