the demolition <strong>and</strong> construction phases <strong>and</strong> as such it would be recommended that<br />

a condition be included on any consent granted that the development be carried out<br />

in complete accordance <strong>with</strong> the recommendations <strong>with</strong>in this report in order to<br />

comply <strong>with</strong> Policy ENV2 of the <strong>Selby</strong> <strong>District</strong> Local Plan <strong>and</strong> the NPPF.<br />

2.17 Conclusion<br />

2.17.1 The development of this site for the erection of one dwelling would be considered<br />

acceptable in principle, despite the proposals not being in accordance <strong>with</strong> Policy<br />

H2A, limited weight should be attached to the non compliance <strong>with</strong> Policy H2A <strong>and</strong><br />

significant weight should be attached to the site being identified as a designated<br />

service village capable of accommodating additional small scale development <strong>and</strong><br />

the proposals not causing harm to the local area in accordance <strong>with</strong> the NPPF.<br />

2.17.2 Having assessed the proposals against the relevant policies the proposals are<br />

considered to be acceptable in respect of the design <strong>and</strong> effect upon the character<br />

of the conservation area, flood risk, drainage, climate change, impact on highways,<br />

residential amenity, nature conservation <strong>and</strong> contamination.<br />

2.17.3 The proposed developed is therefore considered to be contrary to the provisions of<br />

the Development Plan however there are material considerations as described<br />

above that are considered to be of sufficient weight to outweigh this conflict <strong>and</strong><br />

therefore planning permission is recommended subject to conditions.<br />

2.18 Recommendation<br />

This application is recommended to be APPROVED subject to the following<br />

conditions:<br />

01. The development for which permission is hereby granted shall be begun<br />

<strong>with</strong>in a period of three years from the date of this permission.<br />

Reason:<br />

In order to comply <strong>with</strong> the provisions of Section 51 of the Planning <strong>and</strong><br />

Compulsory Purchase Act 2004.<br />

02. No development shall take place until samples of all facing <strong>and</strong> roofing<br />

materials have been submitted to <strong>and</strong> approved in writing by the Local<br />

Planning Authority, <strong>and</strong> the development shall be constructed of the<br />

approved materials.<br />

Reason:<br />

In the interests of visual amenity <strong>and</strong> in order to ensure that the proposals<br />

are in keeping <strong>with</strong> the character <strong>and</strong> appearance of the conservation area to<br />

comply <strong>with</strong> Policies ENV1 <strong>and</strong> ENV25 of the <strong>Selby</strong> <strong>District</strong> Local Plan.<br />

03. No development shall take place until details of the design, appearance <strong>and</strong><br />

finished colour of all external doors, window frames, glazing bars, rainwater<br />

goods <strong>and</strong> ridge tiles have been submitted to <strong>and</strong> approved in writing by the<br />

Local Planning Authority, <strong>and</strong> only the approved materials shall be utilised<br />

<strong>and</strong> these shall thereafter be so retained <strong>and</strong> maintained unless otherwise<br />
