The Council has a 5.57 year supply as identified in the recent appeal<br />

decision at <strong>Selby</strong> Garden Centre, Hull Road, Osgodby<br />

(APPN2739/A/11/2162857) dated 23 March 2012.<br />

Conclusion<br />

Given the change in higher order policies since the Council meeting of<br />

13 September 2011, the Councils case for restricting the quantum of<br />

housing on the SDLP allocated site SHB/1(B) is weakened.<br />

In terms of Affordable Housing the Policy Team is of the opinion that<br />

the Option A of 40% contribution is in conformity <strong>with</strong> policy. A scenario<br />

approach to negotiating affordable housing is not supported by policy<br />

<strong>and</strong> that further clarification/evidence should be provided by the<br />

applicant on local infrastructure projects.<br />

1.4.3 NYCC Highways<br />

The applications were supported by a Transport Assessment (TA)<br />

which assessed the impact of the proposals on the key junctions in <strong>and</strong><br />

around Sherburn in Elmet for 498 <strong>and</strong> 598 dwellings. The local<br />

Highway Authority (LHA) also requested additional work to be<br />

undertaken in relation to the modelling of the Low Street/Kirkgate/Moor<br />

Lane/Finkle Hill signal controlled junction, in order that a model could<br />

be created which accurately reflected the impact of the development on<br />

this key junction. It is now considered that the modelling submitted<br />

reflects the existing conditions <strong>and</strong> the assumptions made for the<br />

impact of the development are acceptable. It is the view of the LHA that<br />

the development traffic can be satisfactorily accommodated on the<br />

surrounding highway network. Recommended conditions in relation to<br />

the application are attached.<br />

Should the Application for the 498 dwellings (2012/0400/EIA) <strong>and</strong> 100<br />

dwellings (2012/0399/EIA) both be approved a composite Section 106<br />

Agreement will be required to provide the following:<br />

Contribution towards a Toucan crossing on Low Street.<br />

Amending the Traffic Regulation Order.<br />

Bus stops/shelters <strong>and</strong> DDA compliant kerbing.<br />

Improvements/refurbishment of the traffic signals at the Low<br />

Street/Moor Lane junction.<br />

Provision of a link road between the two development sites in<br />

accordance <strong>with</strong> details to be submitted <strong>and</strong> approved by the local<br />

Highway Authority. The link road should be provided upon occupation<br />

of the 300th dwelling.<br />

As the link road will eliminate the potential for rat-running through The<br />

Fairway a contribution is required towards measures to discourage ratrunning<br />

through Eversley Park Estate.<br />
