2. <strong>Applications</strong> for the approval of the reserved matters referred to in No.1<br />

herein shall be made <strong>with</strong>in a period of three years from the grant of<br />

this outline permission <strong>and</strong> the development to which this permission<br />

relates shall be begun not later than the expiration of two years from<br />

the final approval of the reserved matters or, in the case of approval on<br />

different dates, the final approval of the last such matter to be<br />

approved.<br />

Reason:<br />

In order to comply <strong>with</strong> the provisions of Section 51 of the Planning <strong>and</strong><br />

Compulsory Purchase Act 2004.<br />

3. Prior to the commencement of the dwelling hereby approved, details of<br />

the materials to be used in the construction of the exterior walls <strong>and</strong><br />

roof(s) of the dwelling shall be submitted to <strong>and</strong> approved in writing by<br />

the Local Planning Authority, <strong>and</strong> only the approved materials shall be<br />

utilised.<br />

Reason:<br />

In the interests of visual amenity <strong>and</strong> in order to comply <strong>with</strong> Policy<br />

ENV1 of the <strong>Selby</strong> <strong>District</strong> Local Plan.<br />

4. No development shall take place <strong>with</strong>in the application area until the<br />

applicant has secured the implementation of a programme of<br />

archaeological work in accordance <strong>with</strong> a written scheme of<br />

investigation which has been submitted by the applicant <strong>and</strong> approved<br />

by the Local Planning Authority.<br />

The site is of archaeological interest<br />

This application has been determined in accordance <strong>with</strong> the relevant<br />

planning acts.<br />

3.1.2 Human Rights Act 1998<br />

It is considered that although a decision made in accordance <strong>with</strong> this<br />

recommendation results in an interference <strong>with</strong> the applicant’s <strong>and</strong> his<br />

extended family’s homes <strong>and</strong> that Article 8 of the European Convention<br />

on Human Rights is engaged the recommendation made in this report<br />
