1. Introduction <strong>and</strong> background<br />

1.1 The Site<br />

The application site constitutes an area to the north of the property<br />

named “Drey”. The site previously constituted the garden area of this<br />

property <strong>and</strong> has since been sold off as a building plot. The l<strong>and</strong> is<br />

currently open <strong>with</strong> no defined boundary treatments <strong>and</strong> a single flat<br />

roofed garage is located on the site.<br />

1.2 The Proposal<br />

1.2.1 The application seeks outline planning consent for the erection of a<br />

detached dwelling.<br />

1.3 Planning History<br />

Application reference 8/18/27B/PA for Outline planning permission for<br />

erection of a dwelling house on l<strong>and</strong> adjacent to Drey 77 Water Lane,<br />

Hemingbrough was Approved in April 2000.<br />

Application reference 8/18/27C/PA for the erection of a two storey<br />

extension (existing garage to be demolished) on the side elevation at<br />

Drey 77 Water Lane Hemingbrough was Approved in May 2001<br />

Application reference 8/18/27D/PA for the proposed erection of<br />

detached dwelling on l<strong>and</strong> at Drey 77 Water Lane, Hemingbrough was<br />

approved in July 2006.<br />

Application reference 8/18/27E/PA Outline application for the proposed<br />

erection of detached dwelling <strong>with</strong> all matters reserved on l<strong>and</strong> at Drey<br />

77 Water Lane Hemingbrough the application was refused in<br />

September 2010 for the following reason<br />

“The application proposes residential development on l<strong>and</strong> that does<br />

not constitute previously developed <strong>and</strong> is therefore contrary to Policies<br />

H2A <strong>and</strong> H6 of the <strong>Selby</strong> <strong>District</strong> Local Plan.”<br />

This application was appealed by the applicant <strong>and</strong> the appeal was<br />

subsequently dismissed by the Planning Inspectorate<br />

The inspector considered that the main issue in the consideration of<br />

the appeal was “whether the proposal would undermine policies<br />

designed to focus new housing development on previously developed<br />

l<strong>and</strong>.” The appeal was dismissed as the inspector considered that the<br />
