<strong>and</strong> should contribute positively to making places better for people.<br />

2.7.3 Paragraphs 60, 61 <strong>and</strong> 65 of the NPPF make it clear that decisions<br />

should not attempt to impose architectural styles or particular tastes<br />

<strong>and</strong> should not stifle innovation, originality or initiative through<br />

unsubstantiated requirements to conform to certain development forms<br />

or styles, should address the connections between people <strong>and</strong> places<br />

<strong>and</strong> the integration of new development into the natural, built <strong>and</strong><br />

historic environment <strong>and</strong> proposals should not be refused for buildings<br />

which promote high levels of sustainability because of concerns about<br />

incompatibility <strong>with</strong> an existing townscape, if those concerns have been<br />

mitigated by good design.<br />

2.7.4 NPPF, Paragraph 200, states planning conditions should not be used<br />

to restrict permitted development rights unless there is clear<br />

justification to do so.<br />

2.7.5 It should be noted that in the consideration of application reference<br />

8/42/112B/PA that the erection of a detached dwelling the same design<br />

as proposed in this instance was considered to be appropriate.<br />

2.7.6 The character of the area in which the site is located varied <strong>with</strong> a<br />

mixture of house types which vary in size <strong>and</strong> scale there are both<br />

bungalows <strong>and</strong> houses <strong>with</strong>in the area. However there is one common<br />

theme in that the existing properties are all detached. There are also<br />

properties in close proximity to each other. The site is positioned<br />

between 2 dwellings of an exact design <strong>with</strong> the dwelling to the south<br />

positioned diagonally to the application site. The dwellings are<br />

constructed from grey brick <strong>with</strong> concrete roofs set back from the road<br />

by 9 metres.<br />

2.7.7 The application proposes a detached property of a similar scale <strong>and</strong><br />

size to the immediate properties measuring 7 metres in height. The<br />

property would be sited in line <strong>with</strong> the neighbouring property <strong>and</strong> due<br />

to the characteristics of this area would not dispute the character of the<br />

area. It is considered that subject to a condition requiring samples of<br />

materials to ensure they would fit in <strong>with</strong> the immediate properties. A<br />

new dwelling in this location would be acceptable <strong>and</strong> would respect<br />

the character of the area. The proposal is therefore considered to be<br />

acceptable in terms of its siting, design <strong>and</strong> layout <strong>and</strong> would accord<br />

<strong>with</strong> criteria 1 of H6 of the <strong>Selby</strong> <strong>District</strong> Local Plan.<br />

The proposal is therefore considered acceptable <strong>and</strong> inline <strong>with</strong> policy<br />

H6 of the <strong>Selby</strong> <strong>District</strong> Local Plan.<br />

2.8 Impact on Residential Amenity<br />

2.8.1 Policies ENV1(1)of the Local Plan require development to take account<br />

of the effect upon the amenity of adjoining occupiers. Significant weight<br />
