1. Introduction <strong>and</strong> background<br />

1.1 The Site<br />

The application site constitutes an area to the north of the property<br />

named “Fairwinds” The site constitutes the side garden of this property.<br />

The eastern boundary of the site is bounded by a low wall the southern<br />

boundary by various conifer trees <strong>and</strong> the northern by 1 metre <strong>and</strong> 2<br />

metre high fencing.<br />

1.2 The Proposal<br />

1.2.1 The application seeks full planning consent for the erection of a<br />

detached dwelling. The proposed dwelling would measure 6 metres in<br />

width by 7.6 metres in depth. The dwelling would have a height of 7<br />

metres to pitch.<br />

1.3 Planning History<br />

Application reference 8/42/112B/PA for the erection of a detached<br />

dwelling on l<strong>and</strong> to the side of Fairwinds <strong>Selby</strong> Road Whitley was<br />

refused in December 2012 for the following reason<br />

“The application proposes residential development on l<strong>and</strong> that does<br />

not constitute previously developed as defined by PPS3 Revised June<br />

2010. Policy H2A states that In order to ensure the annual house<br />

building requirement is achieved in a sustainable manner application<br />

for residential development will only be acceptable on previously<br />

developed sites <strong>with</strong>in defined development limits. The proposal is<br />

therefore contrary to Policies H2A <strong>and</strong> H6 of the <strong>Selby</strong> <strong>District</strong> Local<br />

Plan <strong>and</strong> would undermine the Council’s clear strategy to ensure that<br />

the annual house building requirement is delivered in a sustainable<br />

manner.”<br />

1.4 Consultations<br />

1.4.1 Whiltey Parish Council<br />

This application is almost identical to the application that was refused<br />

in 2011. The reasons for refusal were because it was contrary to<br />

policies H2A <strong>and</strong> H6 of the <strong>Selby</strong> DC Local Plan. Have these policies<br />

changed since 2011?<br />

The site for the proposed building is part of the garden of Fairwinds. It<br />

is not credible to suggest that hard surfaces previously used for<br />
