1. Introduction <strong>and</strong> background<br />

1.1 The Site<br />

The application site constitutes an open parcel of undeveloped l<strong>and</strong><br />

sited between two pair of semi detached properties <strong>with</strong> no physical<br />

features. The site is open to the north <strong>with</strong> a 1 metre high fence<br />

marking the western <strong>and</strong> eastern boundaries of the site.<br />

1.2 The Proposal<br />

1.2.1 The application seeks full planning consent for the erection of a<br />

detached dwelling. The dwelling would measure 10 metres in width by<br />

10.2 metres in depth. The dwelling would have a height of 5 metres to<br />

the eaves <strong>and</strong> 6.5 metres to pitch. The dwelling would have 4<br />

bedrooms <strong>and</strong> be set back from the road to provide 2 parking spaces<br />

<strong>and</strong> a small garden area to the front.<br />

1.3 Planning History<br />

Application reference 8/57/503/PA for the erection of a detached<br />

dwelling on l<strong>and</strong> between 29 <strong>and</strong> 29A Common Lane South Milford<br />

Leeds was refused in June 2011 for the following reason<br />

“The application proposes residential development on l<strong>and</strong> that does<br />

not constitute previously developed <strong>and</strong> is therefore contrary to Policies<br />

H2A <strong>and</strong> H6 of the <strong>Selby</strong> <strong>District</strong> Local Plan.”<br />

This application was appealed by the applicant <strong>and</strong> the appeal was<br />

subsequently dismissed by the Planning Inspectorate<br />

The inspector considered that the main issue in the consideration of<br />

the appeal was “whether the proposal would undermine policies<br />

designed to focus new housing development on previously developed<br />

l<strong>and</strong>.” The appeal was dismissed as the inspector considered that the<br />

proposal would be contrary to policy H2A of the <strong>Selby</strong> <strong>District</strong> Local<br />

Plan.<br />

1.4 Consultations<br />

1.4.1 South Milford Parish Council<br />

Does the developer propose an open plan front garden to provide<br />

access to parking spaces or - if so the rest of the street scene<br />

incorporates boundary walls which the pc would like to see replicated.<br />
