egard to this it is considered that the proposed development would represent an<br />

efficient <strong>and</strong> effective use of l<strong>and</strong> as it would provide additional housing <strong>with</strong>in the<br />

village boundary <strong>and</strong> it would not, by virtue of the fact that the site is currently<br />

occupied by a series of agricultural buildings, result in the loss of any public/private<br />

open space or features of l<strong>and</strong>scape value. Consequently, subject to being<br />

acceptable in terms of its impact upon visual <strong>and</strong> residential amenity <strong>and</strong> highway<br />

safety the proposed development is considered to be acceptable in principle.<br />

2.7 Design <strong>and</strong> Effect Upon the Character of the Area<br />

2.7.1 Paragraph 56 of the NPPF advises the Government attaches great importance to<br />

the design of the built environment, advising that good design is a key aspect of<br />

sustainable development which is indivisible from good planning.<br />

2.7.2 Paragraph 60 of the NPPF makes it clear that decisions should not attempt to<br />

impose architectural styles or particular tastes <strong>and</strong> should not stifle innovation,<br />

originality or initiative through unsubstantiated requirements to conform to certain<br />

development forms or styles.<br />

2.7.3 Paragraph 64 of the NPPF states that permission should be refused for<br />

development of poor design that fails to take the opportunities available for<br />

improving the character <strong>and</strong> quality of an area <strong>and</strong> the way it functions.<br />

2.7.4 <strong>Selby</strong> <strong>District</strong> Local Plan Policy ENV1(1) requires development to take account of<br />

the effect upon the character of the area, <strong>with</strong> ENV1(4) requiring the st<strong>and</strong>ard of<br />

layout, design <strong>and</strong> materials to respect the site <strong>and</strong> its surroundings. Policy H6(1)<br />

also requires development to ensure it is of a scale <strong>and</strong> design appropriate to the<br />

form <strong>and</strong> character of the settlement <strong>and</strong> immediate locality <strong>with</strong> point 5 of Policy<br />

H6 advising that development should not constitute an unacceptable form of<br />

backl<strong>and</strong> or t<strong>and</strong>em development. Significant weight should be attached to these<br />

policies as they are broadly consistent <strong>with</strong> the NPPF.<br />

2.7.5 The proposed development seeks consent to erect four, two storey dwellings,<br />

together <strong>with</strong> a detached garage for each unit. The proposed dwellings, which<br />

would be constructed using materials to be agreed <strong>with</strong> the local planning authority,<br />

would have a similar character <strong>and</strong> form to the new build units that occupy the l<strong>and</strong><br />

to the north <strong>and</strong> east of the application site on Manor Court.<br />

2.7.6 The application site has direct access from Caudle Hill, however the proposed<br />

dwellings would be set behind the frontage development along Caudle Hill <strong>and</strong><br />

consequently the development would constitute backl<strong>and</strong> development. Having<br />

regard to the street pattern in the vicinity of the application site, where numerous<br />

dwellings are sited in positions where they have no direct relationship <strong>with</strong> the<br />

street, it is not considered that the introduction of further dwellings behind the<br />

building line on Caudle Hill would be detrimental to the character of the area.<br />

2.7.8 Having regard to the fact that the majority of dwellings in the locality are two storeys<br />

in height it is considered that the scale <strong>and</strong> massing of the proposed dwellings is<br />

appropriate. It is also considered that the design detail of the units is acceptable<br />

given their resemblance to the units on Manor Court which they would be viewed in<br />

context <strong>with</strong> <strong>and</strong> given that the units would have limited visibly from public vantage<br />

points.<br />
