2.11 Conclusion<br />

2.11.1 The proposal relates an amended private access road layout which includes the<br />

removal of part of the railway embank <strong>and</strong> 6 trees <strong>and</strong> the installation of a<br />

package sewer treatment. A similar access road has already been granted<br />

consent <strong>and</strong> is extant.<br />

2.11.2 The proposal is considered to be appropriate development in the Green Belt, <strong>and</strong><br />

the loss of the trees <strong>and</strong> embankment are considered to be acceptable <strong>and</strong> would<br />

not result in an unacceptable impact on ecology. The replacement trees <strong>and</strong> hedge<br />

would ensure that the proposal would not adversely affect the visual amenity of the<br />

Locally Important L<strong>and</strong>scape Area. In addition the revised access would not result<br />

in an unacceptable impact on the amenity of neighbouring residents <strong>and</strong> is<br />

considered acceptable in terms of highway safety.<br />

2.11.3 The proposal is therefore considered to be in accordance <strong>with</strong> policies of the<br />

development plan <strong>and</strong> there are no other material considerations that are of<br />

significant weight to warrant refusal of planning permission. Planning Permission is<br />

therefore recommended subject to conditions.<br />

2.12 Recommendation<br />

This application is recommended to be APPROVED subject to the following<br />

conditions:<br />

01. The development for which permission is hereby granted shall be begun<br />

<strong>with</strong>in a period of three years from the date of this permission.<br />

Reason:<br />

In order to comply <strong>with</strong> the provisions of Section 51 of the Planning <strong>and</strong> Compulsory<br />

Purchase Act 2004.<br />

02. Prior to the commencement of any other part of the development the access<br />

to the site shall be set out <strong>and</strong> constructed in accordance <strong>with</strong> the published<br />

specification of the Local Highway Authority <strong>and</strong> the following requirements:<br />

i) The crossing of the highway verge shall be constructed in accordance <strong>with</strong> the<br />

approved details <strong>and</strong>/or St<strong>and</strong>ard Detail number E6c.<br />

ii) Any gates or barriers shall be erected a minimum distance of 6 metres back from<br />

the carriageway of the existing highway <strong>and</strong> shall not be able to swing over the<br />

existing or proposed highway.<br />

iii) Provision shall be made to prevent surface water from the site discharging onto<br />

the existing or proposed highway in accordance <strong>with</strong> the specification of the<br />

Local Highway Authority.<br />

All works shall accord <strong>with</strong> the approved details.<br />

Reason - In order to ensure a satisfactory means of access to the site from the<br />

public highway in the interests of highway safety.<br />

03. Prior to the commencement of the development the 30mph / national speed limit<br />

sign <strong>and</strong> the 30mph road marking shall be relocated in accordance <strong>with</strong> a scheme<br />
