permitted unless there are very special circumstances which outweigh the<br />

presumption against it.<br />

2.7.3 Paragraph 87 states that “as <strong>with</strong> previous Green Belt policy, inappropriate<br />

development is, by definition, harmful to the Green Belt <strong>and</strong> should not be approved<br />

except in very special circumstances”. Paragraph 88 states that “When considering<br />

any planning application, local planning authorities should ensure that substantial<br />

weight is given to any harm to the Green Belt. ‘Very special circumstances’ will not<br />

exist unless the potential harm to the Green Belt by reason of inappropriateness,<br />

<strong>and</strong> any other harm, is clearly outweighed by other considerations”.<br />

2.7.4 NPPF <strong>and</strong> policy GB2 of the Local Plan set out the types of developments that are<br />

appropriate in principle in the Green Belt. Para 90 of the NPPF <strong>and</strong> criteria 7 of<br />

Policy GB2 of the Local Plan confirm that engineering operations are appropriate<br />

provided they maintain the openness of the Green Belt <strong>and</strong> do not conflict <strong>with</strong> the<br />

purposes of including l<strong>and</strong> <strong>with</strong>in it.<br />

2.7.5 Given the access would not affect the openness of the Green Belt it is considered to<br />

in accordance <strong>with</strong> the policies identified above. Furthermore, there is an extant<br />

planning permission for the element of the access located <strong>with</strong>in the Green<br />

Belt which is the same as that proposed under this application.<br />

2.7.6 The proposed scheme is therefore considered to be appropriate development <strong>with</strong>in<br />

the Green Belt as it accords GB2 (7) of the <strong>Selby</strong> <strong>District</strong> Local Plan <strong>and</strong> paragraph<br />

90 of the NPPF.<br />

2.8 Highway Safety<br />

2.8.1 Policies ENV1 (2), H6 (3), T1 <strong>and</strong> T2 of the Local Plan require development to<br />

ensure that there is no detrimental impact on the existing highway network or<br />

parking arrangements. These Local Plan policies should be afforded significant<br />

weight as they are broadly consistent <strong>with</strong> the aims of the NPPF. The proposed<br />

access is from Weedling Gate to the north of Station House. This access has been<br />

approved on four previous applications <strong>and</strong> is currently in use to serve the<br />

construction of the two dwellings. The private access, when completed, would<br />

incorporate a single passing place, two speed bumps <strong>and</strong> a refuse collection point<br />

close to the junction <strong>with</strong> Weedling Gate<br />

.<br />

2.8.2 No comments have been received from the Local Highway Authority; however they<br />

have previously commented on an identical point of access <strong>and</strong> raised no<br />

objections subject to conditions. The relevant conditions are contained <strong>with</strong>in<br />

the recommendation at the end of this report. The proposal is therefore<br />

considered to be acceptable in terms of highway safety <strong>and</strong> would accord <strong>with</strong><br />

Local Plan policies ENV (1) T1, T2 <strong>and</strong> H6 (3) in this respect.<br />

2.9 Residential Amenity <strong>and</strong> Pollution<br />

2.9.1 Policies ENV1 (1) <strong>and</strong> H6 (2) of the Local Plan require development to take account<br />

of the effect upon the amenity of adjoining occupiers. Significant weight should be<br />

attached to these policies as they are broadly consistent <strong>with</strong> the aims of the NPPF<br />

to protect residential amenity. The site is located between two dwellings, Station<br />

House, which is a two storey dwelling to the north <strong>and</strong> Wild Briar, which is a<br />
