If the development is appropriate, the application should be determined on its<br />

own merits.<br />

If the development is inappropriate, the presumption against inappropriate<br />

development in the Green Belt applies <strong>and</strong> the development should not be<br />

permitted unless there are very special circumstances which outweigh the<br />

presumption against it.<br />

2.7.7 Paragraph 87 states that “as <strong>with</strong> previous Green Belt policy, inappropriate<br />

development is, by definition, harmful to the Green Belt <strong>and</strong> should not be approved<br />

except in very special circumstances”. Paragraph 88 states that “When considering<br />

any planning application, local planning authorities should ensure that substantial<br />

weight is given to any harm to the Green Belt. ‘Very special circumstances’ will not<br />

exist unless the potential harm to the Green Belt by reason of inappropriateness,<br />

<strong>and</strong> any other harm, is clearly outweighed by other considerations”.<br />

2.7.8 Policy GB2 of the Local plan states that development <strong>with</strong>in the Green Belt will not<br />

be permitted except for the purposes listed in the policy, which includes the limited<br />

redevelopment, alteration <strong>and</strong> small scale extension of existing commercial<br />

premises which do not have a materially greater impact than the present use on the<br />

openness of the Green Belt. This approach conflicts <strong>with</strong> the contents of the NPPF<br />

<strong>and</strong> the NPPF should therefore be given greater weight.<br />

2.7.9 The NPPF states the following as an exception to the usual rule that new buildings<br />

in the Green Belt are inappropriate: ‘limited infilling or the partial or complete<br />

redevelopment of previously development sites (brownfield l<strong>and</strong>), whether<br />

redundant or in continuing use (excluding temporary buildings), which would not<br />

have a greater impact on the openness of the Green Belt <strong>and</strong> the purpose of<br />

including l<strong>and</strong> <strong>with</strong>in it than the existing development.<br />

2.7.10 The application site is located <strong>with</strong>in the wider Bypass Park Estate. It is previously<br />

developed l<strong>and</strong> <strong>and</strong> is currently in use for external storage <strong>and</strong> accommodates a<br />

number of structures.<br />

2.7.11 Given its location <strong>with</strong>in the wider industrial estate <strong>and</strong> that the development would<br />

improve the employment area by replacing temporary buildings <strong>with</strong> a more<br />

permanent structure <strong>and</strong> it would not have a greater impact upon the openness of<br />

the greenbelt over <strong>and</strong> above that of the existing industrial estate, it is considered<br />

that the development constitutes appropriate development <strong>with</strong>in the greenbelt.<br />

2.7.12 It is considered, therefore that the principle of the development is acceptable<br />

subject to compliance <strong>with</strong> all other relevant planning policies.<br />

2.8 Design, Layout <strong>and</strong> Scale<br />

2.8.1 Policy GB4 of the local plan states that proposals for development in the Green Belt<br />

will only be permitted where the scale, location, materials <strong>and</strong> design of any<br />

buildings or structure, or the laying out <strong>and</strong> use of l<strong>and</strong> would not detract from the<br />

open character <strong>and</strong> visual amenity of the green belt or the form <strong>and</strong> character of<br />

any settlement <strong>with</strong>in it.<br />
