The NPPF <strong>and</strong> the accompanying Technical Guide provides guidance on<br />

wide variety of planning issues the following report is made in light of the<br />

guidance of the NPPF.<br />

<strong>Selby</strong> <strong>District</strong> Emerging Core Strategy to the Local Development<br />

Framework<br />

Annex 1 paragraph 216 of the NPPF states “From the day of publication,<br />

decision-takers may also give weight to relevant policies in emerging plans<br />

according to:<br />

• the stage of preparation of the emerging plan (the more advanced the<br />

preparation, the greater the weight that may be given);<br />

• the extent to which there are unresolved objections to relevant policies<br />

(the less significant the unresolved objections, the greater the weight<br />

that may be given); <strong>and</strong><br />

• the degree of consistency of the relevant policies in the emerging plan<br />

to the policies in this Framework (the closer the policies in the<br />

emerging plan to the policies in the Framework, the greater the weight<br />

that may be given).”<br />

The Council considers that the emerging <strong>Selby</strong> <strong>District</strong> Core Strategy has<br />

completed plan preparation <strong>and</strong> has reached a sufficient stage in the<br />

Examination process <strong>and</strong> has been assessed by the Council for NPPF<br />

compliance, to be given significant weight.<br />

However, in appeal decisions APP/N2739/A/12/21704789,<br />

APP/N2739/A/12/216889 <strong>and</strong> APP/N2739/A/12/2169003 the inspector<br />

considers that it would be inappropriate at this stage to give regard to the<br />

policies of the emerging core strategy. In Planning Law appeal decisions are<br />

a material consideration that in accordance <strong>with</strong> Section 38(6) of the Planning<br />

<strong>and</strong> Compulsory Act 2004 are to be taken into account in the determination of<br />

planning applications<br />

Taking account of the above appeal decisions it is considered until the Core<br />

Strategy has been through the 3 rd hearing of the Examination In Public<br />

(September 2012) that limited weight should be afforded to the policies of the<br />

emerging <strong>Selby</strong> <strong>District</strong> Core Strategy. A reassessment of weighting will be<br />

undertaken as the Core Strategy progresses through the statutory process.<br />
