2.19.2 Policy ENV1 (1) of the Local Plan states that in considering proposals<br />

the <strong>District</strong> Council will take account of “the effect upon the character of<br />

the area or the amenity of adjoining occupiers”<br />

2.19.3 Objectors have raised concerns in terms of the impact on existing<br />

residents as a result of the storey heights, st<strong>and</strong> offs, new roads <strong>and</strong> as<br />

a result of the impact arising during the construction of the site.<br />

Relationship to Existing Development (Heights <strong>and</strong> St<strong>and</strong> Offs)<br />

2.19.4 The submitted D&A includes sections <strong>and</strong> design approaches /<br />

assessment in terms of the relationship between surrounding existing<br />

development <strong>and</strong> the proposed scheme <strong>and</strong> the scale of development<br />

in terms of the mix of heights <strong>and</strong> storey numbers. In addition the<br />

Applicants have also outlined that they would accept <strong>with</strong>in the S106 a<br />

restriction, <strong>with</strong>in that part of the site to the rear of Carousel Walk, that<br />

development will not exceed two storeys in height. It is considered that<br />

it would be appropriate to condition this rather than include this in the<br />

Section 106 agreement.<br />

2.19.5 As noted earlier in this Report the submitted D&A can be linked to the<br />

subsequent reserved matters submissions. Given the proviso that the<br />

general approaches outlined in the D&A are acceptable <strong>and</strong> the ability<br />

to utilise a S106/ condition to limit the storey heights in relation to the<br />

adjoining existing residential then it is considered that in principle the<br />

scheme does result in an appropriate relationship to existing<br />

development <strong>and</strong> at the reserved matters stage further consideration<br />

can be made in terms of assessing siting.<br />

Noise / Nuisance from the New Roads<br />

2.19.6 Objectors have raised concerns that new roads <strong>with</strong>in the application<br />

scheme will result in an impact on the adjoining occupiers.<br />

2.19.7 The internal roads <strong>with</strong>in the development are not considered likely to<br />

result in a significant impact on the existing residents over that which<br />

would be expected when a site is developed for residential purposes as<br />

roads are not located immediately adjoining the boundary. As such the<br />

impact is not considered to be significant <strong>and</strong> does not warrant refusal<br />

of the scheme on noise / nuisance grounds from the new access roads.<br />

2.19.8 As such it is considered that the amenity of the existing occupants can<br />

be appropriately considered at the reserved matters stage <strong>and</strong> that as<br />

a result of the information in the D&A that any amenity impacts are not<br />

sufficient to warrant refusal of the application.<br />
