The Planning Officer presented a report which has been referred to the<br />

Planning Committee as it is a Departure from the Development Plan as it is<br />

contrary to Policy H2A.<br />

The Planning Officer explained that the application sought full planning<br />

permission for the erection of a detached dwelling <strong>with</strong> detached double<br />

garage which would replace an extant consent for the erection of one dwelling<br />

<strong>and</strong> detached double garage on this plot.<br />

The Planning Officer explained that the development of the site for the<br />

erection of one dwelling would be considered acceptable in principle, despite<br />

the proposals not being in accordance <strong>with</strong> Policy H2A, limited weight should<br />

be attached to the non compliance <strong>with</strong> Policy H2A <strong>and</strong> significant weight<br />

should be attached to the clear fall back position in the form of the extant<br />

planning permission, the proposals not causing harm to the local area <strong>and</strong><br />

compliance <strong>with</strong> the NPPF <strong>and</strong> as such the proposals were considered<br />

acceptable in principle.<br />

The Committee debated the application <strong>and</strong> a vote was taken.<br />

RESOLVED:<br />

i) To receive <strong>and</strong> note the report.<br />

ii) To APPROVE the application subject to the conditions<br />

detailed at Paragraph 2.16 in the report.<br />

Location: Blue Bell Inn, 86 Main Street,<br />

Monk Fryston<br />

Proposal: Change of use of existing public house to<br />

single dwelling <strong>and</strong> erection of a single dwelling<br />

<strong>and</strong> double garage.<br />

The Planning Officer presented a report which has been referred to the due to<br />

the request of a Ward Councillor. The reasons given for this request were<br />

detailed in the report.<br />

The Planning Officer explained that the application sought planning consent<br />

for the change of use of the Public House in to a dwelling <strong>and</strong> the erection of<br />

a single dwelling <strong>and</strong> double garage to the rear of the site.<br />

The Planning Officer explained that the proposal was considered to be<br />

acceptable in principle <strong>and</strong> would accord <strong>with</strong> polices H2A <strong>and</strong> H6 of the<br />

<strong>Selby</strong> <strong>District</strong> Local Plan. It was explained that the proposal would sustain <strong>and</strong><br />

enhance an important building <strong>with</strong>in the Conservation Area which was<br />

supported by the NPPF. The Committee were informed that the proposal<br />

would not adversely affect the character of the area or the Conservation Area<br />

nor would the proposal significantly adversely affect the residential amenity of<br />

neighbouring properties. The Planning Officer explained that the proposal<br />

would not adversely affect Highway safety or effect protected species. It was<br />
