the Central District of California, defendant STACEY c. KOON, then<br />

a sergeant with the Los Angeles Police o·epartlnent, while acting<br />

· under- color- ·of· the laws of·· the state ·of · California, did· willfUJ.:l.y ····- ··<br />

permit other Los Angeles Police Officers in his presence and under<br />

his supervision, namely Laurence M. Powell, Timothy E. Wind, and<br />

<strong>The</strong>odore J. Briseno, unlawfully to strike with batons, kick, and<br />

stomp Rodney Glen King, an inhabitant of the state of California,<br />

while Rodney Glen King was in the custody of those <strong>officers</strong>, and<br />

did willfully fail to prevent this unlawful assault; resulting in<br />

bodily injury to Rodney Glen King, and thereby did willfully<br />

deprive Rodney Glen King of the right preserved and protected by<br />

the Constitution of the United States not to be deprived of liberty<br />

without due process of law, inclu~ing<br />
