<strong>in</strong> <strong>in</strong> justice <strong>in</strong>stitutions and processes<br />

Although confidence <strong>in</strong> the justice system<br />

is slowly improv<strong>in</strong>g, there are still those<br />

who doubt its fairness, accessibility and<br />

treatment of victims and witnesses.<br />

Modernis<strong>in</strong>g the court and tribunal<br />

estate to reflect users’ needs, patterns<br />

of bus<strong>in</strong>ess and travel, and to take<br />

advantage of <strong>in</strong><strong>for</strong>mation technology<br />

will help give people more confidence<br />

<strong>in</strong>, and respect <strong>for</strong>, the justice system.<br />

Also important is improv<strong>in</strong>g people’s<br />

knowledge and experience of how<br />

<strong>in</strong>vestigat<strong>in</strong>g and sentenc<strong>in</strong>g decisions<br />

are made. Ensur<strong>in</strong>g that disputes are<br />

dealt with <strong>in</strong> the right <strong>for</strong>um, that judges<br />

have the right k<strong>in</strong>d of experience <strong>for</strong><br />

the case <strong>in</strong> hand, and that the judiciary<br />

is diverse, appo<strong>in</strong>ted on merit and well<br />

tra<strong>in</strong>ed, will help ma<strong>in</strong>ta<strong>in</strong> public respect<br />

<strong>for</strong> the legal process.<br />

Priority 9: Trans<strong>for</strong>m<strong>in</strong>g civil and<br />

adm<strong>in</strong>istrative justice<br />

Approach:<br />

• Re<strong>for</strong>m the courts and tribunal system<br />

to provide more access and options<br />

when resolv<strong>in</strong>g disputes.<br />

• Ensure that low value or straight<strong>for</strong>ward<br />

cases are dealt with at the appropriate<br />

level <strong>in</strong> the court system.<br />

• Modernis<strong>in</strong>g the court and tribunal estate<br />

to reflect users’ needs and harness new<br />

technology.<br />

• Introduce a unified structure <strong>for</strong> all<br />

<strong>Scottish</strong> tribunals to <strong>in</strong>crease efficiency,<br />

simplicity and cost-effectiveness.<br />

• Encourage self-representation by putt<strong>in</strong>g<br />

the user at the centre of an accessible<br />

and af<strong>for</strong>dable tribunal system.<br />
