FEDERAL TRANSIT ADMINISTRATION REQUIREMENTS<br />
FOR NON-CONSTRUCTION CONTRACTS<br />
1.0 GENERAL<br />
This Contract is subject to the terms <strong>of</strong> a financial assistance contract between the <strong>Santa</strong> <strong>Cruz</strong> Metropolitan Transit<br />
District and the Federal Transit Administration (FTA) <strong>of</strong> the United States Department <strong>of</strong> Transportation.<br />
2.0 INTEREST TO MEMBERS OF OR DELEGATES TO CONGRESS<br />
In accordance with 18 U.S.C. 431, no member <strong>of</strong>, nor delegates to, the Congress <strong>of</strong> the United States shall be<br />
admitted to a share or part <strong>of</strong> this Contract or to any benefit arising therefrom.<br />
3.0 INELIGIBLE CONTRACTORS<br />
Neither Contractor, subcontractor, nor any <strong>of</strong>ficer or controlling interest holder <strong>of</strong> Contractor or subcontractor, is<br />
currently, or has been previously, on any debarred bidders list maintained by the United States Government.<br />
4.0 EQUAL EMPLOYMENT OPPORTUNITY (Not applicable to contracts for standard commercial supplies<br />
and raw materials)<br />
In connection with the execution <strong>of</strong> this Contract, the Contractor shall not discriminate against any employee or<br />
application for employment because <strong>of</strong> race, religion, color, sex, age (40 or over), national origin, pregnancy,<br />
ancestry, marital status, medical condition, physical handicap, sexual orientation, or citizenship status. The<br />
Contractor shall take affirmative action to insure that applicants employed and that employees are treated during<br />
their employment, without regard to their race, religion, color, sex national origin, etc. Such actions shall include,<br />
but not be limited to the following: Employment, upgrading, demotion or transfer; recruitment or recruitment<br />
advertising; lay<strong>of</strong>f or termination; rates <strong>of</strong> pay or other forms <strong>of</strong> compensation; and, selection for training<br />
including apprenticeship. Contractor further agrees to insert a similar provision in all subcontracts, except<br />
subcontracts for standard commercial supplies or raw materials.<br />
5.0 TITLE VI CIVIL RIGHTS ACT OF 1964<br />
During the performance <strong>of</strong> this Contract, the Contractor, for itself, its assignees and successors in interest<br />
(hereinafter referred to as the "Contractor"), agrees as follows:<br />
5.1 Compliance with Regulations<br />
The Contractor shall comply with the Regulations relative to nondiscrimination in federally<br />
assisted programs <strong>of</strong> the Department <strong>of</strong> Transportation (hereinafter "DOT") Title 49, Code <strong>of</strong><br />
Federal Regulations, Part 21, as they may be amended from time to time (hereinafter referred to as<br />
the "Regulations"), which are herein incorporated by reference and made a part <strong>of</strong> this Contract.<br />
5.2 Nondiscrimination<br />
The Contractor, with regard to the work performed by it during the Contract, shall not discriminate<br />
on the grounds <strong>of</strong> race, religion, color, sex, age or national origin in the selection and retention <strong>of</strong><br />
subcontractors, including procurements <strong>of</strong> materials and leases <strong>of</strong> equipment. The Contractor<br />
shall not participate either directly or indirectly in the discrimination prohibited in Section 21.5 <strong>of</strong><br />
the Regulations, including employment practices when the Contract covers a program set forth in<br />
Appendix B <strong>of</strong> the regulations.<br />
