1.0 SCOPE OF CERTIFICATION ASSESSMENT<br />

1.1 Introducti<strong>on</strong><br />

This certificati<strong>on</strong> assessment was c<strong>on</strong>ducted <strong>on</strong> the Pukin Grouping-Plantati<strong>on</strong> Management Unit (PMU) of IOI<br />

Corporati<strong>on</strong> Berhad, <strong>on</strong> the 8 to 11 December 2010, to assess if the organizati<strong>on</strong>‟s operati<strong>on</strong>s of the mill and its supply<br />

bases were in compliance against the RSPO Principles and Criteria (October 2007); Malaysian Nati<strong>on</strong>al Interpretati<strong>on</strong><br />

(MY-NI, November 2010) and RSPO Supply Chain Certificati<strong>on</strong> (November 2009) for POM.<br />

The plantati<strong>on</strong> management unit (PMU) or management unit is equivalent to a certificati<strong>on</strong> unit as defined in the RSPO<br />

Certificati<strong>on</strong> Systems Document. Each PMU c<strong>on</strong>sists of <strong>on</strong>e mill and its supply bases which are made up of estates<br />

owned by IOI Corporati<strong>on</strong> Berhad (IOI).<br />

1.2 Locati<strong>on</strong> (address, GPS and map)<br />

The PUKIN GROUPING-PMU c<strong>on</strong>sist of <strong>on</strong>e (1) palm oil mill namely Pukin <strong>Palm</strong> <strong>Oil</strong> Mill and four (4) estates i.e. Pukin,<br />

Shahzan 1, Shahzan 2 and Segamat estates. Details of the addresses and locati<strong>on</strong>s are as indicated in Table 1. The<br />

locati<strong>on</strong>, field and topography maps are detailed in Appendix C1 – C9.<br />

The 4 estates which are owned by IOI are the main sources of FFB to the POM at PUKIN GROUPING-PMU as indicated<br />

in Table 2.<br />

There were other estates owned by IOI, which also supplied FFB to the POM. These other supply bases have also been<br />

c<strong>on</strong>sidered in the overall assessment <strong>on</strong> PUKIN GROUPING-PMU and have been verified to be part of the Time Bound<br />

Plan committed by IOI for certificati<strong>on</strong>. (Refer to para.1.8)<br />

1.4 Date of plantings and cycle<br />

The 4 estates were developed between 1988 and 2006 and are mainly in the 1 st cycle of planting except for the Pukin<br />

estate which has started <strong>on</strong> some re-planting (2 nd cycle). The replanting at Pukin estate was d<strong>on</strong>e in stages from 2007 to<br />

2010 between 168 to 250 hectares annually. The age profile is as shown in Table 3.<br />

1.7 Time Bound Plan for Other Management Units<br />

IOI operates 12 palm oil mills and 77 oil palm estates throughout Malaysia and Ind<strong>on</strong>esia. The organizati<strong>on</strong> is a<br />

pi<strong>on</strong>eering member of RSPO and has been taking an active role in the RSPO certificati<strong>on</strong> processes since 2004.<br />

Currently, a significant number of its Plantati<strong>on</strong> Management Units (PMU) is undergoing the RSPO certificati<strong>on</strong> process in<br />

accordance with its time bound plan to achieve RSPO certificati<strong>on</strong> for all its PMUs by 2016. Details of the time bound plan<br />

as submitted by IOI are as per Appendix F.<br />

2.0 ASSESSMENT PROCESS<br />

2.1 Assessment Methodology, Programme and Site Visits<br />

Assessment methodology included physical site inspecti<strong>on</strong>s, observing relevant processes, including healthcare activities,<br />

interviewing the Mill Manager, Estate Managers, Executives, operati<strong>on</strong>al staff, foreign workers, female workers and their<br />

families, external stakeholders, including NGOs, review of documentati<strong>on</strong>, verificati<strong>on</strong> of records, communicati<strong>on</strong>s and<br />

m<strong>on</strong>itoring data. Checklist and questi<strong>on</strong>naires were widely used. Samples for assessment were taken <strong>on</strong> a random basis.<br />

Details of assessment programme are given in Appendix B.<br />

This report has been independently reviewed for c<strong>on</strong>formance with the RSPO certificati<strong>on</strong> system requirements and<br />

reviewed for its technical c<strong>on</strong>tent by the MICM Internal Review Panel.<br />

2.2 Date of next scheduled visit<br />

The next scheduled visit is the surveillance audit which will be carried out within 12 m<strong>on</strong>ths from the date of RSPO<br />

acceptance of this public summary report.<br />

2.3 Qualificati<strong>on</strong>s of the Lead Assessor and Assessment Team<br />

Competency details of the Lead Assessor and Assessment Team are given in Appendix A.<br />

2.5 Outline of how stakeholder c<strong>on</strong>sultati<strong>on</strong> was managed<br />

Stakeholder c<strong>on</strong>sultati<strong>on</strong>s began with notificati<strong>on</strong> of upcoming assessment through websites of RSPO, IOI and MICM. E-<br />

mails, facsimiles and letters of the same were sent to applicable stakeholders including government agencies and NGOs.<br />

Teleph<strong>on</strong>e enquiries were made and received prior to the actual assessment from a few stakeholders and were dealt with<br />

accordingly.<br />

During the assessment stakeholders were interviewed and their feedbacks were recorded. Am<strong>on</strong>g the stakeholders<br />

c<strong>on</strong>sulted were workers, employee c<strong>on</strong>sultative committee leaders and members, women representatives, government<br />

departments / agencies and NGOs.<br />

3.0 ASSESSMENT FINDINGS<br />

The PUKIN GROUPING-PMU has established a documented system explaining the<br />

mechanism for identifying, determining, reviewing and updating applicable legal and<br />

other requirements that the PMU has subscribed to.<br />

The legal register covering applicable local and internati<strong>on</strong>al laws and regulati<strong>on</strong>s<br />

were available at the mill with the Mill Manager and at each estate with the Estate<br />

Managers. The Mill and Estate Managers maintain the tracking for any changes in<br />

legal requirements. These were reviewed <strong>on</strong> yearly basis and updated (when<br />

necessary) with the compliance status indicated. The relevant legislati<strong>on</strong>s identified<br />

and listed were am<strong>on</strong>g others regarding safety and health, envir<strong>on</strong>mental<br />

management, polluti<strong>on</strong> management, chemical handling, usage and storage,<br />

schedule waste management. The Social Impact Assessments and Management<br />

Plans were made available at all the estates.<br />

During the site observati<strong>on</strong>s, interviews and records checking at the field and mill,<br />

there was sufficient evidence of compliance with the relevant laws, regulati<strong>on</strong>s, local<br />

and internati<strong>on</strong>al laws at that the POM and estates.<br />

However, the medical surveillance performed in the estates were not adequate<br />

as it did not cover all the workers involved in handling of chemicals as<br />

required by Regulati<strong>on</strong> 27 of OSH (USECHH) Regulati<strong>on</strong> 2000 and the<br />

recommendati<strong>on</strong> of the Chemical Hazards Risk Assessment (CHRA) report. In<br />

year 2009 till current in December 2010, the estates within the grouping did not<br />

send all workers who were exposed to chemicals for the annual medical<br />

surveillance by the Occupati<strong>on</strong>al & Health Dept. e.g. at the Segamat estate, in<br />

2009 - <strong>on</strong>ly 2 employees and in 2010 – <strong>on</strong>ly 6 employees out of a total of 43<br />

workers were medically examined.<br />

The right to use the land can be dem<strong>on</strong>strated, and is not legitimately c<strong>on</strong>tested by local<br />

communities with dem<strong>on</strong>strable rights.<br />

The palm oil mill (POM) is located at the Pukin Estate. The estate lands were<br />

planted with oil palm trees since 1988 and the 1990‟s.<br />

There has been no recorded dispute over the ownership of the land. Legal boundary<br />

markers were sighted and maintained al<strong>on</strong>g the perimeters of estate lands which<br />

were mapped with a 1 - meter differential Global Positi<strong>on</strong>ing System (GPS).<br />

there was no dispute from the local villages. Letters of c<strong>on</strong>sent to use the access<br />

roads at the estates, as right of way has been produced during the assessment.<br />

annual budget for FFB, CPO, PKO, OER and KER with projecti<strong>on</strong>s for the next 5<br />

A financial management system was sighted to m<strong>on</strong>itor the actual performance<br />

results <strong>on</strong> a daily, m<strong>on</strong>thly and annual basis. Reports by PUKIN GROUPING - PMU<br />

to the IOI management <strong>on</strong> the producti<strong>on</strong> performance and the OER as a measure<br />

of producti<strong>on</strong> efficiency were evidenced.<br />

Replanting programs had been implemented at the Pukin estate in year 2007 for<br />

about 629 ha. For the other estates, replanting was planned around year 2014<br />

<strong>on</strong>wards, over a 10 year period. The annual replanting percentages ranged from 5%<br />

to 10% of the total oil palm areas.<br />

Annual fertilizer applicati<strong>on</strong> program was m<strong>on</strong>itored and implemented according to<br />

the fertilizer recommendati<strong>on</strong>s as provided by the Agr<strong>on</strong>omist.<br />

Sampling of palm leaves for nutrient analysis was also carried out annually. Soil<br />

sampling was carried out as <strong>on</strong> 20% of the total fields each year and thus a single<br />

round of sampling were c<strong>on</strong>ducted <strong>on</strong> every field <strong>on</strong>ce in every 5 years.<br />

During field inspecti<strong>on</strong>s, mulching with EFB noted at planted areas. There was no<br />

evidence of any open burning.<br />

The dosages of dry POME applied was noted to be in accordance with the<br />

recommendati<strong>on</strong>s of the research centre of IOI, which was based <strong>on</strong> their analytical<br />

findings <strong>on</strong> POME utilizati<strong>on</strong>, to maintain the nutrient status and microbiological<br />

health of the soil.<br />

There was no peat soil area or fragile soils within the estates.<br />

Inspecti<strong>on</strong> at sites provided evidence that soil erosi<strong>on</strong> counter-measures were taken<br />

which included:<br />

Fr<strong>on</strong>d stacking was carried out at alternate inter-rows of oil palm planting. After each<br />

harvesting, the fr<strong>on</strong>ds were cut into two pieces and stacked at the alternate interrows<br />

without hindering the future harvesting and evacuati<strong>on</strong> of the crop. Inter-row<br />

maintenance was d<strong>on</strong>e through selective weeding to ensure that the „woodies‟ are<br />

removed and that <strong>on</strong>ly soft weeds are growing. Fr<strong>on</strong>ds were also stacked al<strong>on</strong>g lips<br />

of terraced areas and parallel to streams to minimize soil runoff. At the Pukin Estate,<br />

there were some hilly areas and based <strong>on</strong> the slope maps provided, about 26% of<br />

the slopes there were in excess of 8 degrees. Terrace planting was adopted at<br />

slopes which are more than 8 degrees. At slopes which were less than 8 degrees,<br />

the fr<strong>on</strong>ds were stacked al<strong>on</strong>g the c<strong>on</strong>tours of the slopes as part of preventi<strong>on</strong> of soil<br />

erosi<strong>on</strong> programme. Stop bunds were c<strong>on</strong>structed within the planting terraces<br />

Regular road and culvert maintenance was performed. Planting of „vetiver‟ grass and<br />

natural riverine plants was observed to minimize stream and river bank erosi<strong>on</strong> and<br />

to restore riparian areas and buffer z<strong>on</strong>es demarcated.<br />

However, it was noted at the Pukin estate (i.e. at PR10A), that leguminous<br />

cover has not been established at certain secti<strong>on</strong>s of the immature area, which<br />

should be established when the ground c<strong>on</strong>diti<strong>on</strong> was ready.<br />

IOI‟s policy <strong>on</strong> slope protecti<strong>on</strong> and river buffer-z<strong>on</strong>ing was available for inspecti<strong>on</strong><br />

and for public viewing.<br />

The PMU has identified appropriate buffer z<strong>on</strong>es al<strong>on</strong>g all natural waterways i.e.<br />

rivers and streams passing through the estates. Buffer z<strong>on</strong>e demarcati<strong>on</strong> was d<strong>on</strong>e<br />

in accordance with the Department of Irrigati<strong>on</strong> & Drainage (DID) directives and no<br />

spraying or manuring activities were performed within the demarcati<strong>on</strong> z<strong>on</strong>es.<br />

Appropriate markings and signages were found to be placed. The estates have<br />

Envir<strong>on</strong>mental management plans to maintain the buffer z<strong>on</strong>es. The workers were<br />

trained and informed to avoid spraying of agro-chemicals at the buffer z<strong>on</strong>es.<br />

The POM had m<strong>on</strong>itored and c<strong>on</strong>trolled discharges to waterways with installati<strong>on</strong> of<br />

silt traps to reduce suspended solids and c<strong>on</strong>taminants to meet the DOE limits. Daily<br />

checks for leakages were observed <strong>on</strong> the POME which was channeled to the<br />

Effluent Treatment P<strong>on</strong>ds (ETP) for dislodging. Water and treated POME samples<br />

were taken weekly and sent to external laboratories for analysis.<br />

Estate river water analysis was carried out at every 6 m<strong>on</strong>ths interval. For the<br />

adjacent river that supplies to the mill, it was d<strong>on</strong>e <strong>on</strong> a 3 m<strong>on</strong>ths interval. Rainfall<br />

data was maintained daily and annual rainfall recorded range from 3500mm to<br />

5000mm. Water Management Plans were available and m<strong>on</strong>itoring d<strong>on</strong>e <strong>on</strong> the<br />

water usage at the mills. On average, the water usage at the mill was about 1.3<br />

t<strong>on</strong>ne / t<strong>on</strong>ne FFB processed and efforts being made to gradually reduce the usage.<br />

The m<strong>on</strong>itoring of the effluent quality at the POM was noted to be d<strong>on</strong>e with m<strong>on</strong>thly<br />

analysis results submitted by an independent laboratory. The results were noted to<br />

be within the specificati<strong>on</strong>s and limits permitted.<br />

The water management plan d<strong>on</strong>e in October 2010 was approved and authorized by<br />

the senior management pers<strong>on</strong>nel of the grouping. The raw water intake(s) points<br />

used for treating water for human c<strong>on</strong>sumpti<strong>on</strong> in the estates, except Segamat<br />

Estate (which was using the state government water), had not been adequately<br />

secured and not adequately tested, based <strong>on</strong> the Ministry of Health (MOH),<br />

Malaysia‟s requirements or any other equivalent requirements. The n<strong>on</strong>compliance<br />

issued were as follows:<br />

Raw water intake points at Pukin POM’s pump house noted to be<br />

unsecured and lack of SOP <strong>on</strong> the safety and health precauti<strong>on</strong>s including<br />

appropriate signage(s).<br />

Tube well’s water used for human c<strong>on</strong>sumpti<strong>on</strong> located at Shahzan 1<br />

estate noted to be potentially exposed to pesticide spraying and raw water<br />

samples from the tube well must be tested periodically for pesticide based<br />

<strong>on</strong> MOH or equivalent requirements. The tube well area not secured and<br />

warning signage(s) / safety & health precauti<strong>on</strong>s were not available /<br />

displayed during audit time.<br />

Pests, diseases, weeds and invasive introduced species are effectively managed using appropriate<br />

Integrated Pest Management (IPM) techniques.<br />

PUKIN GROUPING-PMU had adopted the IOI group policy and Internal<br />

Envir<strong>on</strong>mental Management & M<strong>on</strong>itoring Plan <strong>on</strong> IPM system which was made<br />

available.<br />

Inspecti<strong>on</strong> at site observed the following:<br />

Parasitoid host and beneficial predator plants such as Tunera subulata, Cassia<br />

cobanensis and Antig<strong>on</strong><strong>on</strong> leptopus had been planted at some stretches al<strong>on</strong>g the<br />

access roads within the estates. M<strong>on</strong>itoring and records of areas where pesticides<br />

were being used and the usage per hectare basis were maintained. There was<br />

evidence of studies and m<strong>on</strong>itoring d<strong>on</strong>e by the IOI-operating units <strong>on</strong> the IPM<br />

system adopted by them such as the detecti<strong>on</strong> of pest infestati<strong>on</strong> as per the FAO<br />

guidelines and census taking.<br />

Barn owls were used as part of natural c<strong>on</strong>trol for rats and barn owl boxes<br />

were erected. However, it was observed that the number of barn owl boxes in<br />

the estates was below the target set by the company (i.e. 1 box to 15 hectare).<br />

The level required should be reviewed and be set in accordance with the<br />

m<strong>on</strong>itoring d<strong>on</strong>e <strong>on</strong> the rat bait dosages at the estates and severity of the<br />

situati<strong>on</strong>.<br />

Criteri<strong>on</strong> 4.6<br />

Agrochemicals are used in a way that does not endanger health or the envir<strong>on</strong>ment. There is no<br />

prophylactic use of pesticides, except in specific situati<strong>on</strong>s identified in nati<strong>on</strong>al Best Practice<br />

guidelines. Where agrochemicals are used that are categorised as World Health Organizati<strong>on</strong> Type<br />

1A or 1B, or are listed by the Stockholm or Rotterdam C<strong>on</strong>venti<strong>on</strong>s, growers are actively seeking<br />

to identify alternatives, and this is documented.<br />

The estates have procedures for the use of agrochemicals for pest c<strong>on</strong>trol which<br />

stipulated the use of <strong>on</strong>ly pesticides officially registered under Secti<strong>on</strong> 53A of the<br />

Pesticide Act (1974); and in accordance with OSH (USECHH) Regulati<strong>on</strong>s (2000).<br />

Pesticides storage was noted to be in accordance with the Occupati<strong>on</strong>al Safety and<br />

Health Act 1994 (Act 514) and Chemical Health and Risk Assessment (CHRA)<br />

recommendati<strong>on</strong>s.<br />

Inspecti<strong>on</strong> at sites observed that pesticides were kept under lock and key. Empty<br />

c<strong>on</strong>tainers disposed off in accordance with the DOE requirements. Informati<strong>on</strong><br />

regarding the chemicals and their usage, hazard and general names were displayed<br />

in the Nati<strong>on</strong>al Language (i.e. Bahasa Malaysia) and translated for the<br />

understanding of the foreign workers.<br />

The annual medical checkup carried out for pesticides operators were not<br />

adequate at the estates.(see NCR # 1)<br />

No pregnant or breastfeeding women were assigned to work with pesticides.<br />

Paraquat usage is minimum and restricted to use as a catalyst with other approved<br />

herbicides as part of weed management e.g. every two spray round of paraquat is<br />

followed by <strong>on</strong>e of Glyphosate. The paraquat was used to clear weeds around young<br />

palms as it <strong>on</strong>ly desiccates weed shoots and has no residual effect in the soil. This<br />

program was used to keep a c<strong>on</strong>trolled presence of soft weeds and the removal of<br />

noxious weeds. IOI‟s management had issued a directive in September 2010 for all<br />

its estates to phase out the use of paraquat by 31 st December 2011.<br />

However, as there was no ‘Fuller’s earth’ available in all the clinics at the<br />

estates and no alternative was prepared in case of an emergency, an<br />

observati<strong>on</strong> was issued. We were given to understand that that all the medical<br />

assistants‟ in-charge of the clinics was knowledgeable <strong>on</strong> how to prepare instant<br />

antidotes from the clays available from the surroundings of the estates.<br />

No aerial applicati<strong>on</strong> of agrochemicals had been carried out. There was no testing of<br />

chemical residues in CPO as there were no requests made from the buyers. Daily<br />

records of pesticides usage were maintained.<br />

Criteri<strong>on</strong> 4.7<br />

An occupati<strong>on</strong>al health and safety plan is documented effectively communicated and<br />

implemented.<br />

The Occupati<strong>on</strong>al Safety and Health (OSH) Policy were displayed at the POM and<br />

all the estates. The Occupati<strong>on</strong>al Safety and Health (OSH) Plan established have<br />

included the establishment of escape routes and locati<strong>on</strong>s of the firefighting<br />

equipment at the sites covered. Each estate and mill had identified and assessed<br />

their respective hazards and risks as per established procedures. Acti<strong>on</strong>s and<br />

precauti<strong>on</strong>s established to address the identified risks.<br />

All operati<strong>on</strong>s where health and safety is an issue have been assessed and<br />

procedures and acti<strong>on</strong>s are documented and implemented to address the identified<br />

issues. Each procedure was supported with documented tasks and task elements<br />

and all possible risks assessed. All precauti<strong>on</strong>s attached to products are observed<br />

and applied to the workers.<br />

The training records had indicated that workers involved in the operati<strong>on</strong>s have been<br />

trained in the OSH policy, programs and in safe working practices. Pesticide<br />

sprayers and fruit cutters selected at random at the estates were interviewed and<br />

they were able to dem<strong>on</strong>strate the correct safety precauti<strong>on</strong>s required. Adequate<br />

and appropriate PPE were available to labourers at the place of work to cover all<br />

potentially hazardous operati<strong>on</strong>s, such as pesticide applicati<strong>on</strong>, chemical storage /<br />

handling, land preparati<strong>on</strong> and harvesting.<br />

The resp<strong>on</strong>sible pers<strong>on</strong>s (i.e. mandores / field supervisors), c<strong>on</strong>ductors and store<br />

supervisor) were identified.<br />

There were records of regular meetings between the resp<strong>on</strong>sible pers<strong>on</strong> and<br />

workers where c<strong>on</strong>cerns of all parties about health, safety and welfare were briefed<br />

and discussed.<br />

Records detailing the occurrence and issues raised were properly maintained.<br />

Meeting minutes were available.<br />

Accident and Emergency procedures and First Aid procedures are present and<br />

instructi<strong>on</strong>s are clearly understood by all workers. Accident procedures are also<br />

operatives trained in First Aid are present in both field and other operati<strong>on</strong>s and first<br />

aid equipment are available at worksites. Sighted a list of sites where all First Aids<br />

boxes are placed.<br />

Records of accidents are kept and reviewed m<strong>on</strong>thly. Fire Drills had been c<strong>on</strong>ducted<br />

at each site (Mill and Estates) with records observed in resp<strong>on</strong>se to potential<br />

emergency.<br />

All workers (including the Ind<strong>on</strong>esian foreign workers) were covered by the worker‟s<br />

compensati<strong>on</strong> scheme. Calculati<strong>on</strong> <strong>on</strong> Lost Time Accident was maintained.<br />

Workplaces, machinery, equipment, transportati<strong>on</strong> vehicles were maintained to<br />

ensure safety and without undue risk to health. Chemical, physical and biological<br />

substances and agents were stored under c<strong>on</strong>trolled c<strong>on</strong>diti<strong>on</strong>s. A safe and healthy<br />

working envir<strong>on</strong>ment was provided for the workers regardless of whether they are<br />

estate full time employees or c<strong>on</strong>tract workers.<br />

Good Agriculture Practice (GAP) and Chemical Health Risk Assessment (CHRA)<br />

were am<strong>on</strong>g the references used in maintaining the safe working envir<strong>on</strong>ment for<br />

the employees.<br />

Field inspecti<strong>on</strong> at Pukin estate (i.e. PM 06A) observed circle spraying with<br />

Supreshade 41 (Glyphosate) + 2.4-D Amine (herbicide) and workers wearing<br />

appropriate PPE. Signboards indicated spraying of herbicides in progress and the<br />

harvesting supervisor (mandore) also carried the First Aid Box during supervisi<strong>on</strong> at<br />

the field.<br />

Safety matters are briefed at the morning muster and „<strong>on</strong>-the job‟ training is given.<br />

respective estates under PUKIN GROUPING-PMU by the IOI Sustainability Team<br />

which is from IOI Research Centre at Batang Melaka, Negeri Sembilan, Malaysia.<br />

The findings of the assessment had included the identificati<strong>on</strong> of impacts that<br />

requires changes in current practices. The report also includes acti<strong>on</strong> plans and<br />

recommendati<strong>on</strong>s in order to mitigate negative effects and promote positive <strong>on</strong>es. A<br />

were targeted by the assessment team in this study. Management acti<strong>on</strong> plans<br />

addressing issues raised which was m<strong>on</strong>itored and projected to be reviewed<br />

annually. During the assessment, it was noted that internal EIA report had included<br />

the stakeholder c<strong>on</strong>sultati<strong>on</strong> with external stakeholders i.e. the Land Department /<br />

Office, DOE etc. Interviews signed by respective officers were also available as part<br />

of document evidence of internal EIA.<br />

Criteri<strong>on</strong> 5.2<br />

The status of rare, threatened or endangered species and high c<strong>on</strong>servati<strong>on</strong> value habitats, if any,<br />

that exist in the plantati<strong>on</strong> or that could be affected by plantati<strong>on</strong> or mill management, shall be<br />

identified and their c<strong>on</strong>servati<strong>on</strong> taken into account in management plans and operati<strong>on</strong>s.<br />

Initial-R2020/10-1 The HCV assessment report(s) have indicated that there were no ERT / protected<br />

species at the external HCVs (forest land) at the areas covered by PUKIN<br />

GROUPING-PMU estates. The collated informati<strong>on</strong> has included the planted area<br />

itself and relevant forest land boundary c<strong>on</strong>siderati<strong>on</strong>s such as the boundary of the<br />

Forest Land adjacent to the Pukin estate, Shahzan 1 & 2 estates.<br />

However a minor CAR issued at the Shahzan 1&2 Estates for not identifying<br />

and c<strong>on</strong>sidering the three p<strong>on</strong>ds and a Chinese (Taoist) shrine for their<br />

potential HCV status in their assessment report prepared <strong>on</strong> 1 st October 2010.<br />

The HCV assessment reports can be enhanced by having more photographs<br />

of species identified during the assessments performed. The HCV report dated<br />

1 st October 2010 should also identify as many comm<strong>on</strong> species i.e. mammals,<br />

birds and fishes found in the estate(s) envir<strong>on</strong>ment e.g. egrets, her<strong>on</strong>s and<br />

l<strong>on</strong>g tail macaque. Cooperati<strong>on</strong> with the forestry/Land department to gather<br />

informati<strong>on</strong> <strong>on</strong> the animal species near the forest land boundaries. Knowledge<br />

of species i.e. ERT at the boundaries with Forest Land could significantly<br />

affect c<strong>on</strong>servati<strong>on</strong> status (e.g. IUCN status) then that was noted in the report.<br />

HCV biodiversity areas / forests type 6 e.g. church, temples, shrines, surau /<br />

mosques, cemetery etc has been appropriately identified for PUKIN<br />

GROUPING-PMU estates and mill based <strong>on</strong> the assessment report dated 1 st<br />

October 2010. However, the HCV(s) actual boundaries, dimensi<strong>on</strong>s / hectarage<br />

and the latitude & l<strong>on</strong>gitude (where not determined yet) could be further<br />

defined for future reference.<br />

Generally the HCV assessment team has indicated more clearly the informati<strong>on</strong><br />

gathering process <strong>on</strong> HCV habitats (including ERT(s) or otherwise ) and the<br />

stakeholder(s) c<strong>on</strong>sultati<strong>on</strong>s d<strong>on</strong>e with relevant government departments, research<br />

institutes, interested NGOs and any additi<strong>on</strong>al field survey work to be d<strong>on</strong>e in the<br />

future will be based <strong>on</strong> the current findings dated 1 st October 2010.<br />

There were isolated reported case(s) of incursi<strong>on</strong> by wild boars. However no major<br />

damage to property and plantati<strong>on</strong> was reported. No other incursi<strong>on</strong>s i.e. elephants<br />

reported ever since the implementati<strong>on</strong> of RSPO for the PUKIN GROUPING-PMU<br />

estates.<br />

Legal requirements relating to the protecti<strong>on</strong> of the species or habitat were met such<br />

as reporting the matter to the authorities such as reports made to the local Land<br />

Department.<br />

The relevant estate(s) management has undertaken appropriate measures to c<strong>on</strong>trol<br />

any illegal or inappropriate hunting, fishing or collecting activities within PUKIN<br />

GROUPING-PMU. IOI has “no hunting” policy and appropriate signage were<br />

prominently displayed to c<strong>on</strong>vey this policy especially at the forest land boundary<br />

areas.<br />

Scheduled Waste such as „spent hydraulic oil‟ (SW 305) were properly stored and<br />

labeled with sec<strong>on</strong>dary c<strong>on</strong>tainment noted at the major scheduled waste storage<br />

areas. The schedule waste storage area had restricted access to authorized<br />

pers<strong>on</strong>nel <strong>on</strong>ly. Seventh Schedule informati<strong>on</strong> generally available and adhered to at<br />

PUKIN GROUPING-PMU.<br />

Recycling bins of three different color codes were available in the POM, workers<br />

quarters/ line site(s) and estates and were used for solid waste segregati<strong>on</strong> and<br />

recycling.<br />

The solid waste management at the dumpsite / „landfill‟ has signage i.e. <strong>on</strong> Health,<br />

Safety and Envir<strong>on</strong>ment rules that are required at the current designated<br />

landfill/dumpsite(s).<br />

steam turbine and boiler where palm fiber and shell were used as fuel. Diesel<br />

generators were <strong>on</strong> standby basis to support the operati<strong>on</strong> in the event of boiler /<br />

Under the PUKIN GROUPING-PMU, the respective Social Impact Assessment<br />

reports and Management plans at all the estates and mill was specific and<br />

individually documented by the Sustainability Team of IOI e.g. Social Impact<br />

Assessment and Management Acti<strong>on</strong> Plans, Pukin Estate dated 30 July 2010 for<br />

July 2010 – June 2015, was evidenced.<br />

Stakeholder c<strong>on</strong>sultati<strong>on</strong> meetings with the local communities and employees <strong>on</strong> the<br />

assessment were performed by the Estate managers with their Social Liais<strong>on</strong><br />

Officers. Employee representati<strong>on</strong> was through the Employees C<strong>on</strong>sultative Council<br />

(ECC) which has representati<strong>on</strong> from the different levels of workers who are elected<br />

by the workers. In all estates in IOI Pukin POM grouping an Employees C<strong>on</strong>sultative<br />

Committee (ECC) was formed. Members in the ECC include representatives from<br />

manures‟ group, sprayers‟ group, harvesters‟ group, FFB checkers‟ group, general<br />

workers‟ group, loaders‟ group. In Segamat Estate, the Nati<strong>on</strong>al Uni<strong>on</strong> of Plantati<strong>on</strong><br />

Workers (NUPW) representative was also involved.<br />

In all estates a dedicated Gender Committee was formed to deal with gender related<br />

issues. Members in the committees c<strong>on</strong>sist of all women staff and workers in the<br />

estates. Participati<strong>on</strong> from their official representatives expressed their views freely<br />

with records of meeting attendance and minutes of meeting being available.<br />

Stakeholder c<strong>on</strong>sultati<strong>on</strong>s were c<strong>on</strong>ducted in all estates and the results of the<br />

c<strong>on</strong>sultati<strong>on</strong> are incorporated into the SIA. Acti<strong>on</strong>s had been taken to address the<br />

issues raised during the c<strong>on</strong>sultati<strong>on</strong>s e.g. plans have been developed to install a<br />

water tank <strong>on</strong> higher ground to tackle the low water pressure at Pukin Estate. In the<br />

interim water is supplied to workers‟ quarters using the portable water tanks.<br />

External stakeholder c<strong>on</strong>sultati<strong>on</strong>s were c<strong>on</strong>ducted in all estates in the IOI - Pukin<br />

PMU grouping, i.e. held between July and October 2010.<br />

The c<strong>on</strong>sultati<strong>on</strong>s were attended by a wide range of stakeholders including<br />

government agencies such as the Forestry Dept., local businesses and neighboring<br />

estates. At the Segamat Estate, representatives from the villages surrounding the<br />

estate were also noted to be in attendance. Records of meeting with stakeholders<br />

indicated discussi<strong>on</strong>s held were generally <strong>on</strong> matters pertaining to access roads and<br />

use rights, working c<strong>on</strong>diti<strong>on</strong>s, cultural/festival activities, health facilities and other<br />

community c<strong>on</strong>cerns. Generally the issues raised during the c<strong>on</strong>sultati<strong>on</strong>s were<br />

acted up<strong>on</strong> such as the maintenance of the football field located within the boundary<br />

of Segamat Estate, for the recreati<strong>on</strong>al use of the neighboring villagers‟. A time table<br />

of activities identified was sighted with time frame <strong>on</strong> implementati<strong>on</strong> plans. Site<br />

inspecti<strong>on</strong> carried out c<strong>on</strong>firmed that the implementati<strong>on</strong>s were in progress.<br />

and/or millers, local communities and other affected or interested parties.<br />

communicati<strong>on</strong> and c<strong>on</strong>sultati<strong>on</strong> when dealing with relevant parties, e.g. its workers,<br />

government agencies, c<strong>on</strong>tractors, neighboring plantati<strong>on</strong>s by pers<strong>on</strong>al invitati<strong>on</strong> to<br />

attend the internal and external stakeholder‟s c<strong>on</strong>sultati<strong>on</strong> meetings such as the<br />

issue of disc<strong>on</strong>tentment am<strong>on</strong>g workers in August 2010 <strong>on</strong> payment rates for FFB in<br />

the Shahzan 1 estate was discussed between the estate management and workers<br />

representatives which were resolved with a revisi<strong>on</strong> made to payment rates. List of<br />

stakeholders are updated and records of meeting were maintained.<br />

There is a mutually agreed and documented system for dealing with complaints and grievances,<br />

which is implemented and accepted by all parties.<br />

procedures which were adequately implemented. Complaints and Grievances<br />

logbook were sighted in all estates in the grouping. Alternatively complaints and<br />

grievances were also filed through their respective ECC representatives. The<br />

resp<strong>on</strong>se time the complaints and grievances which were filed were found to be<br />

prompt i.e. within 5 days depending <strong>on</strong> the nature of the complaints.<br />

Basic daily rate for all employees in IOI Pukin POM grouping estates has met the<br />

industry minimum standards with an extra pay for statutory fringe benefits for their<br />

employees and the employees of sub-c<strong>on</strong>tractors. The estate managements also<br />

provide free housing and treated water supply, fix electricity rate per m<strong>on</strong>th, medical<br />

facilities, community halls, mosques and welfare amenities which help in providing<br />

sufficient and decent living for the staff and workers.<br />

However the workers’ c<strong>on</strong>tract / job offer letter i.e. ‘Surat Tawaran Bekerja<br />

Sebagai Pekerja Ladang’, used in all the estates in the grouping did not reflect<br />

the current practice adopted by the grouping. Some paragraphs required<br />

revisi<strong>on</strong>s in the c<strong>on</strong>tract such as the ‘removal of levy deducti<strong>on</strong> from foreign<br />

workers’ pay, ‘basic daily wage rate’ and the ‘authorized pers<strong>on</strong>nel’ signing<br />

the c<strong>on</strong>tract. There was a revised standard workers’ c<strong>on</strong>tract in 2008 at the<br />

Pukin POM which had not been c<strong>on</strong>sistently used.<br />

Mr Jumat Majid (JM) has over 13 years work experience in the agriculture sector. He has successfully completed the<br />

IRCA accredited Lead Auditor course in ISO 9001:2008 and RSPO P&C MY-NI Lead Assessor course. He has also<br />

successfully completed training programs in Organic Agriculture Development and had performed organic agriculture<br />

Group of Plantati<strong>on</strong>s and MICM verificati<strong>on</strong>. (Refer to RSPO Certificati<strong>on</strong> Systems document, para. 4.2.4)<br />

In the course of finalizing the report for IOI Pukin, there was feedback received through the RSPO Secretariate via the<br />

public announcement uploaded at the RSPO website <strong>on</strong> 26 th September 2011 in which RSPO had decided to suspend<br />

the new RSPO certificati<strong>on</strong>s for the IOI Group under the following circumstances as extracted:<br />

Breach of RSPO Code of C<strong>on</strong>duct 2.3 & Certificati<strong>on</strong> Systems 4.2.4 (c)<br />

Historical: On March 30th, 2011, a formal letter was sent to IOI Research Centre and IOI Corporati<strong>on</strong> Berhad (IOI) <strong>on</strong><br />

complaints raised by several N<strong>on</strong> Governmental Organizati<strong>on</strong>s namely Migros, Friends of the Earth and Grassroots as<br />

well as the local community of L<strong>on</strong>g Teran Kanan in Sarawak.<br />

The statement indicated that the RSPO Grievance Panel has taken several measures against IOI for breaching two core<br />

membership mandates and obligati<strong>on</strong>s:<br />

1. RSPO‟s Code of C<strong>on</strong>duct 2.3: members will commit to open and transparent engagement with interested parties<br />

and actively seek resoluti<strong>on</strong> of c<strong>on</strong>flict<br />

2. RSPO‟s Certificati<strong>on</strong> Systems 4.2.4 (c): Organizati<strong>on</strong>s with more than <strong>on</strong>e management unit and/or that have a<br />

c<strong>on</strong>trolling holding in more than <strong>on</strong>e aut<strong>on</strong>omous company will be permitted to certify individual management<br />

units and/or subsidiary companies <strong>on</strong>ly if there are no significant land c<strong>on</strong>flicts, no replacement of primary forest<br />

or any area c<strong>on</strong>taining HCVs since November 2005, no labour disputes that are not being resolved through an<br />

agreed process and no evidence of n<strong>on</strong>-compliance with law in any of the n<strong>on</strong>-certified holdings.<br />

The measures announced in the public announcement <strong>on</strong> March 31th 2011 included:<br />

1. The suspensi<strong>on</strong> of the current and <strong>on</strong>going certificati<strong>on</strong> process of all IOI group‟s activities with effect from date<br />

of announcement.<br />

2. The provisi<strong>on</strong> of 28 days to the IOI group to revert with an acceptable soluti<strong>on</strong> to these matters, which preferably<br />

should be mutually agreed by parties involved.<br />

3. The stipulati<strong>on</strong> to IOI to publish a statement <strong>on</strong> this matter <strong>on</strong> their corporate website.<br />

The suspensi<strong>on</strong> was related to the cases of dispute as follows:<br />

Case 1 - Dispute With The L<strong>on</strong>g Teran Community In Sarawak, Malaysia:<br />

Up<strong>on</strong> review of reports including discussi<strong>on</strong>s and deliberati<strong>on</strong>, the RSPO is pleased to announce that both IOI<br />

Corporati<strong>on</strong> Berhad (IOI) and the complainants are now committed to the process of mediati<strong>on</strong> as a means to resolve the<br />

dispute. Despite having taken some time due to the complexity of the matter, the RSPO views this as a positive progress<br />

in the right directi<strong>on</strong>. The lifting of the current suspensi<strong>on</strong> of new certificati<strong>on</strong> for IOI will be dependent <strong>on</strong> the progress<br />

attained by both parties c<strong>on</strong>cerned as a result of the mediati<strong>on</strong> process.<br />

Case 2 - Dispute In Ketapang District, Kalimantan, Ind<strong>on</strong>esia:<br />

Up<strong>on</strong> diligent review of the documents submitted to the RSPO, it is c<strong>on</strong>cluded that the c<strong>on</strong>cerns with regards to drained<br />

peat land <strong>on</strong> wildlife habitat and clearing of HCV of primary forests have not been proven.<br />

However, IOI has accepted that some of the procedural requirements by the RSPO with regards to the permits for new<br />

plantings were not adequately complied with. In line with this, IOI has arrived at an agreement with RSPO in committing to<br />

improvements in operati<strong>on</strong>al procedures, as well as to comply with all RSPO requirements moving forward.<br />

Lifting of Suspensi<strong>on</strong> for New Certificati<strong>on</strong>s for IOI Group:<br />

On 8 May 2012, following an announcement made by RSPO, an interim lifting suspensi<strong>on</strong> for the new certificati<strong>on</strong>s for IOI<br />

Group (except for IOI estates in the state of Sarawak) valid for a period of 6 m<strong>on</strong>ths. See links below for details and<br />

c<strong>on</strong>diti<strong>on</strong>s in the communicati<strong>on</strong> from RSPO to IOI and related parties dated 3 May 2012:<br />

Appendix G: Supply Chain Requirements which are applicable to CPO Mills<br />

1. Documented procedures<br />

Requirements<br />

1.1 The facility shall have written procedures and/or work instructi<strong>on</strong>s to ensure the<br />

implementati<strong>on</strong> of all the elements specified. This shall include at minimum the<br />

following:<br />

implementati<strong>on</strong> of these requirements and compliance with all applicable<br />

requirements. This pers<strong>on</strong> shall be able to dem<strong>on</strong>strate awareness of the facility‟s<br />

procedures for the implementati<strong>on</strong> of this standard.<br />

2. Purchasing and goods in<br />

2.1 The facility shall ensure that purchases of RSPO certified palm oil and palm oil<br />

products are in compliance with the following:<br />

a)The facility shall have documentati<strong>on</strong> that dem<strong>on</strong>strates that purchases are made<br />

to the material category agreed with their supplier (IP, SG, MB) (e.g. specified in<br />

purchase orders, c<strong>on</strong>tracts, material specificati<strong>on</strong>s)The facility receiving RSPO<br />

certified oil palm products shall ensure that the products are verified as being RSPO<br />

certified. For facilities that are required to announce and c<strong>on</strong>firm trades in the RSPO<br />

IT System (all facilities up the final refinery) this shall include making Shipping<br />

Announcements and Shipping C<strong>on</strong>firmati<strong>on</strong>s in the RSPO IT System <strong>on</strong> the level of<br />

each shipment.<br />

b) A check of the validity of the Supply Chain Certificati<strong>on</strong> of suppliers is required for<br />

all facilities that are SCCS certified. This shall be checked via the list of RSPO<br />

Supply Chain Certified facilities <strong>on</strong> the RSPO website www.rspo.org or the RSPO IT<br />

System within a reas<strong>on</strong>able timeframe.<br />

2.2 The facility shall have a mechanism in place for handling n<strong>on</strong>-c<strong>on</strong>forming<br />

material/documents. This mechanism should also be used to take appropriate steps<br />

when the Supply Chain certificati<strong>on</strong> of a supplier is found to be invalid.<br />

3. Outsourcing activities<br />

3.1. In cases where an operati<strong>on</strong> seeking or holding certificati<strong>on</strong> outsources activities<br />

to independent third parties (e.g. subc<strong>on</strong>tractors for storage, transport or other<br />

outsourced activities), the operati<strong>on</strong> seeking or holding certificati<strong>on</strong> shall ensure that<br />

the independent third party complies with the intent and requirements of the RSPO<br />

Supply Chain Standard (This requirement should not apply to outsourced storage<br />

facilities where the management of the mass balance and instructi<strong>on</strong>s for tank<br />

movements are c<strong>on</strong>trolled by the organizati<strong>on</strong> (not the tank farm manager).<br />

3.2. Facilities which wish to include outsourcing within the scope of their RSPO<br />

Supply Chain certificate shall ensure the following:<br />

a) The facility has legal ownership of all input material to be included in outsourced<br />

b) The facility does not relinquish legal ownership of the materials during outsourced<br />

processing;<br />

c) The facility has an agreement or c<strong>on</strong>tract covering the outsourced process with<br />

each c<strong>on</strong>tractor through either a signed and enforceable agreement with the<br />

subc<strong>on</strong>tractor. The <strong>on</strong>us is <strong>on</strong> the facility to ensure that certificati<strong>on</strong> bodies have<br />

access to the outsourcing c<strong>on</strong>tractor or operati<strong>on</strong> if an audit is deemed necessary.<br />

d) The facility has a documented c<strong>on</strong>trol system with explicit procedures for the<br />

outsourced process which are shared with the relevant c<strong>on</strong>tractor.<br />

e) The facility seeking or holding certificati<strong>on</strong> shall furthermore ensure (e.g. through<br />

c<strong>on</strong>tractual arrangements) that independent third parties engaged, provide<br />

unrestricted access to their respective operati<strong>on</strong>s, systems, and any and all<br />

informati<strong>on</strong> to certificati<strong>on</strong> bodies that are duly approved by the RSPO when this is<br />

announced in advance.<br />

3.3. The facility shall record the names and c<strong>on</strong>tact details of all c<strong>on</strong>tractors used for<br />

the processing or producti<strong>on</strong> of RSPO certified materials.<br />

3.4. The facility shall inform its certificati<strong>on</strong> body about the names and c<strong>on</strong>tact details<br />

of any new c<strong>on</strong>tractor used for the processing or producti<strong>on</strong> of RSPO certified<br />

materials.<br />

4. Sales and goods out<br />

4.1. The facility shall ensure that all sales invoices or relevant documents, e.g.<br />

delivery notes, shipping documents and specificati<strong>on</strong> documentati<strong>on</strong>, issued for<br />

5. Registrati<strong>on</strong><br />

5.1. Supply chain actors who take legal ownership and physically handle RSPO<br />

Certified <strong>Sustainable</strong> oil palm products and who are part of the supply chain of<br />

RSPO Certified <strong>Sustainable</strong> oil palm products before and up to the (final) refinery<br />

need to register their transacti<strong>on</strong> in the RSPO IT System up<strong>on</strong> the moment of<br />

physical shipment (At present, it is not yet possible to enter palm kernel product<br />

requirements of the Supply Chain Certificati<strong>on</strong> Systems.<br />

6.3. The facility shall keep records of the training provided to staff in relati<strong>on</strong> to<br />

implementati<strong>on</strong> of these requirements.<br />

7. Claims<br />

7.1. The facility shall <strong>on</strong>ly make claims regarding the use of or support of RSPO<br />

certified oil palm products that are in compliance with the RSPO Rules for<br />
