1 The <strong>Highway</strong>s <strong>Act</strong>, 1925<br />

(Bengal <strong>Act</strong>, III of 1925)<br />

[24 th September, 1925]<br />

An act to provide for the better maintenance <strong>and</strong> control of Government roads in<br />

2 Bangladesh.<br />

Whereas it is expedient to provide for the regulation <strong>and</strong> safety of traffic on Government<br />

roads in 2 Bangladesh for the prevention of obstruction <strong>and</strong> encroachments, <strong>and</strong> of<br />

nuisances on or near such roads, for the preservation of such roads, <strong>and</strong> for the<br />

temporary closing of such roads for repairs or other works, or for public purposes.<br />

It is hereby enacted as follows:<br />

1. Short title, extent <strong>and</strong> commencement.-(1) This <strong>Act</strong> may be called the 4 <strong>Highway</strong>s<br />

<strong>Act</strong>, 1925.<br />

5 (2) It extends to the whole of 2 Bangladesh.<br />

(3) It shall come into force on such date 6 as the 7 Government may, by notification in the<br />

8 Official Gazette direct.<br />

2. Definition. In this <strong>Act</strong>, unless their is anything repugnant in the subject or context-<br />

“Government road” means a road vested in 1 the Government or under the control <strong>and</strong><br />

administration of the 2 Works <strong>Department</strong> of the 3 [Government] <strong>and</strong> includes-<br />

(a)<br />

(b)<br />

the slop, berm borrow-pits <strong>and</strong> side drains of any such road;<br />

all l<strong>and</strong>s <strong>and</strong> embankment, vested in, or under the control <strong>and</strong> administration<br />

of, the said 2 Woprks <strong>Department</strong> <strong>and</strong> attached to a Government road.<br />

(c) all bridges, culverts or causeways built on or across any Government road;<br />

<strong>and</strong><br />

(d) all fences <strong>and</strong> posts on any Government road or on any l<strong>and</strong> attached to a<br />

Government road, <strong>and</strong> all roadside trees on such l<strong>and</strong>;<br />

3. Temporary closing of Government road,- The 3 [Government] or any officer<br />

empowered by the 3 [Government] in this behalf may, by public notice, displayed in a<br />

conspicuous portion of the road, declare any Government road or part thereof to be<br />

closed temporarily for the purpose of repairing such road, or for the purpose of<br />

constructing any sewer, drain, culvert, or bridge or for any other similar public purpose;<br />

Provided that the 3 [Government] or any officer empowered by the 3 [Government] in this<br />

behalf shall , before declaring any such road or part thereof to be closed, be bound, where<br />

possible, to provide other reasonably sufficient means of access to holdings adjacent to<br />

such road or part, if no such means of access already exist :<br />

Provide also that where there is a stretch of road over half a mile in length , the road or<br />

part thereof closed at any one time shall not exceed half a mile in length <strong>and</strong> that where<br />

possible in such closed parts, an alternative route shall be provided.<br />

[ 1 3A. Resumption by Government of control of roads placed under local<br />

authorities.- The 2 Government may, at any time by notification withdraw any<br />

Government road from the control <strong>and</strong> administration of any local authority under which<br />

it may have been placed by or under any law <strong>and</strong> resume the control <strong>and</strong> administration<br />

thereof itself; <strong>and</strong> thereupon the right of control <strong>and</strong> administration of the local authority<br />

in respect of such road shall cease.]<br />

4. Power to make rules.- (1) 2 The [Government] 3 [may after previous publication, make]<br />

rules.-<br />

(i) for the regulation <strong>and</strong> safety of traffic on Government roads; 3a (ia) “for the<br />

regulation of construction work within ten meters of such Government roads called<br />

National High Ways <strong>and</strong> Regional <strong>Highway</strong>s.”<br />

(ii) for the prevention of obstruction <strong>and</strong> encroachments <strong>and</strong> of nuisances on or near<br />

such roads;<br />

(iii) for the preservation of such roads; <strong>and</strong><br />

(iv) for the temporary closing of such roads for repair or other works, or for the<br />

purposes specifically set forth in section 3.<br />

5. Penalties.- In making any rule under this <strong>Act</strong>, the 2 Government may direct that a<br />

breach thereof shall be punishable with a fine which may extend to “ 5a ten thous<strong>and</strong> 5 taka<br />

<strong>and</strong> a continuing breach shall be punishable with simple imprisonment for a period of six<br />

months <strong>and</strong> also a further fine not exceeding one hundred taka 5 ” for every day after the<br />

date of the first conviction during which the offender provided to have persisted in the<br />

offence.<br />

Ministry of Communication <strong>Roads</strong> <strong>and</strong> Railways Division Notification<br />

S.R.O No. 63/2001. In exerciser of the power conferred by section 4 of the<br />

<strong>Highway</strong>s <strong>Act</strong>, 1925 (<strong>Act</strong>, III of 1925) the Government is pleased to make the<br />

following Rules, which is pre-published vide Notification S.R.O No. 313-<br />

Law/2000, Dated 16 th October, 2000 corresponding 1 st kartik, 1407 BS as per<br />

requirement of section 4 of that <strong>Act</strong>, namely-<br />

1. Title of Rules. – These Rules may be called the <strong>Highway</strong>s (Security,<br />

Protection <strong>and</strong> Restriction of Movement) Rules, 2001.<br />

2. Delimitation. – In this Rules unless there is anything repugnant in the<br />

subject of context-<br />

(a) “ <strong>Department</strong>” means the Road <strong>and</strong> <strong>Highway</strong>s <strong>Department</strong> <strong>and</strong> for<br />

the purpose of these Rules, includes any employee of the<br />

<strong>Department</strong> of person authorized by the <strong>Department</strong>.<br />

(b) “ Authorized Point” means an access point to or exit point from any<br />

highway specified by the <strong>Department</strong>, <strong>and</strong> includes railway<br />

Passover, specified footpath for public or animals, or when any part<br />

of the highway is closed, the alternative road.<br />

(c) “ <strong>Act</strong>,” means the <strong>Highway</strong>s <strong>Act</strong>, 1925 (<strong>Act</strong> III of 1925).<br />

(d) “ Driver” means driver of a motor vehicle.<br />

(e) “ Traffic sign” means any signal by electrical lamps, posts, pillars,<br />

instruction of information installed of erected to restrict movement<br />

of the highway.<br />

(f) “ Parking site” means any site specified by the <strong>Department</strong> for<br />

parking or stoppage of motor vehicles on the highway.<br />

(g) “ Person” includes statutory body, company, society, association or<br />

any other organization.<br />

(h) “Motor Vehicle” means a motor vehicle defined under section 2(27)<br />

of Motor vehicles Ordinance, 1983 (LV of 1983) <strong>and</strong> includes any<br />

other vehicle time to time specified by the <strong>Department</strong> as highways.<br />

(i) “<strong>Highway</strong>” means a Government road defined under section 2 of the<br />

<strong>Act</strong> <strong>and</strong> which is specified or declared by the <strong>Department</strong>.<br />

3. Declaration of road protection corridor. – The <strong>Department</strong> may declare<br />

the following area as road protection corridor of any highway, namely-<br />

(a) Area used by the public for movement.<br />

(b) Area marked as road divider of the highway.<br />

(c) Area determined by the department <strong>and</strong> open for use by cyclists,<br />

animals <strong>and</strong> pedestrians.<br />

(d) Parking site.<br />

(e) Any other area in or adjacent to a road as may be determined by the<br />

<strong>Department</strong>.<br />

4. Restriction of movement on the highway. – No person shall –<br />

(a) be a pedestrian on the place which is not authorized by the<br />

<strong>Department</strong> or take possession of any place on the highway, except<br />

for the purposes authorized under these rules.<br />

(b) drive or park any vehicle other than the motor vehicle.<br />

(c) drive a motor vehicle on the highway which is not capable of<br />

attaining or maintaining on a label road of a speed of 60 kilometers<br />

per hour.<br />

(d) park any motor vehicle at a place other than the parking site <strong>and</strong> in<br />

case of parking shall abide by the instruction issued by the<br />

department.<br />

(e) carry of accompany any animal in any vehicle other than a truck or<br />

similar vehicle or, being in charge of his animals, shall not cause to<br />

access or move or take possession of any place on the highway,<br />

except the place determined by the <strong>Department</strong>.<br />

(f) make a ‘U’ turn of “ one way road” or drive in any other direction<br />

other than the approved direction.<br />

5. To Follow authorized point <strong>and</strong> Traffic signs. –<br />

(1) No driver of a motor vehicle shall access to or exit from highway<br />

other than the authorized point.<br />

(2) On access to or exiting from highway or driving on the highway,<br />

the driver of a motor vehicles shall-<br />

(a) abide by the traffic signs.<br />

(b) cause to passover pedestrians, animals, birds <strong>and</strong> other transport, in<br />

accordance to traffic laws.<br />

(c) not exceed the label road speed instructed by the <strong>Department</strong>.<br />

6. Restriction on the use of highways by adjacent l<strong>and</strong> owners or<br />

occupiers. – No owner or occupier of any l<strong>and</strong> adjacent to the highway<br />

shall make, without written permission form the <strong>Department</strong>, any road<br />

accessing to the highway.<br />

7. Restriction on the stoppage of motor vehicles on the highways, etc. – A<br />

driver of a motor vehicle shall not stop at any place on the highway, except<br />

for the following places or events, namely-<br />

(a) parking site.<br />

(b) where, to avoid injury to a person or damage to property, he is<br />

found to bring his vehicles to a sudden stop.<br />

(c) where he is instructed to stop by traffic sign.<br />

(d) Where there is not such place nearby <strong>and</strong> the vehicle is so disable<br />

that it is impossible to avoid stop : Provided that to repair or<br />

remove the disabled motor vehicle from the place concerned other<br />

necessary motor vehicles on the highway may be stopped <strong>and</strong> the<br />

persons concerned may stay for the required time.<br />

(e) where, he is instructed by an employee of the <strong>Department</strong> of a<br />

member of the law enforcing agency, or in the event of any road<br />

accident or hue <strong>and</strong> cry to meet any emergency situation.<br />

8. Restriction of destructive use of highways, etc. – No person, without<br />

written permission form the <strong>Department</strong>, shall-<br />

(a) take possession or use any part of the slope, Berm, borrowpit of any<br />

highway.<br />

(b) construct or change any structure, dig of fill earth or cultivate or<br />

plant or undertake any works on or under any part of a highway or<br />

within ten meters of the highway.<br />

(c) deposit of place goods or materials on a highway.<br />

9. Matters to be observed during the development <strong>and</strong> repairmen of<br />

<strong>Highway</strong>s. – To carry out the purpose of development, repairmen,<br />

reformation on similar works on any highway, an officer of the<br />

<strong>Department</strong> or any other person authorized by the <strong>Department</strong> may-<br />

(a) stop movement <strong>and</strong> use of the highway for a short period of time.<br />

(b) arrange to provide alternative way.<br />

(c) take any measure to meet all sorts of necessities for such purposes.<br />

10. Duties of the <strong>Department</strong>. – The <strong>Department</strong> shall specify authorized<br />

point including installation of traffic signs, one way road, parking sites on<br />

the highway <strong>and</strong> keep all the measures in order to implement the provision<br />

of these rules.<br />

11. Offence <strong>and</strong> penalty. – A person who vioefates rules 4, 5, 6, 7, 8 or 9<br />

commits an offence <strong>and</strong> shall be liable to pay a fine of taka ten thous<strong>and</strong>,<br />

<strong>and</strong> for continuity of violation shall be liable to simple imprisonment for a<br />

period not exceeding six months <strong>and</strong> pay a fine of taka one hundred for<br />

each day.<br />

12. Power to remove unauthorized motor vehicles, etc. –<br />

(1) Where it appears that an offence is committed under these Rules,<br />

any police or member of the law enforcing agency, may remove any<br />

vehicle, goods, animals, structure or any other things related to the<br />

offence from the highway.<br />

(2) For the purpose of sub-rule (1) any employee of the <strong>Department</strong> or<br />

person authorized by the <strong>Department</strong>, may request to the police or<br />

the member of the law enforcing agency for such removal <strong>and</strong> the<br />

police or the member of the law enforcing agency shall act<br />

accordingly.<br />

13. Publication of authentic English text. – The Government shall by<br />

notification in the Official Gazette, publish an authentic text of an<br />

authorized translation in English of these rules to be known as authorized<br />

English text.<br />

Provided that in the event of conflict between these rules <strong>and</strong> English text,<br />

these rules shall prevail.<br />
