1 The Highways Act, 1925 

(Bengal Act, III of 1925) 

[24 th September, 1925] 

An act to provide for the better maintenance and control of Government roads in 

2 Bangladesh. 

Whereas it is expedient to provide for the regulation and safety of traffic on Government 

roads in 2 Bangladesh for the prevention of obstruction and encroachments, and of 

nuisances on or near such roads, for the preservation of such roads, and for the 

temporary closing of such roads for repairs or other works, or for public purposes.

It is hereby enacted as follows: 

1. Short title, extent and commencement.-(1) This Act may be called the 4 Highways 

Act, 1925. 

5 (2) It extends to the whole of 2 Bangladesh. 

(3) It shall come into force on such date 6 as the 7 Government may, by notification in the 

8 Official Gazette direct.

2. Definition. In this Act, unless their is anything repugnant in the subject or context- 

“Government road” means a road vested in 1 the Government or under the control and 

administration of the 2 Works Department of the 3 [Government] and includes- 

(a) 

(b) 

the slop, berm borrow-pits and side drains of any such road; 

all lands and embankment, vested in, or under the control and administration 

of, the said 2 Woprks Department and attached to a Government road. 

(c) all bridges, culverts or causeways built on or across any Government road; 

and 

(d) all fences and posts on any Government road or on any land attached to a 

Government road, and all roadside trees on such land;

3. Temporary closing of Government road,- The 3 [Government] or any officer 

empowered by the 3 [Government] in this behalf may, by public notice, displayed in a 

conspicuous portion of the road, declare any Government road or part thereof to be 

closed temporarily for the purpose of repairing such road, or for the purpose of 

constructing any sewer, drain, culvert, or bridge or for any other similar public purpose; 

Provided that the 3 [Government] or any officer empowered by the 3 [Government] in this 

behalf shall , before declaring any such road or part thereof to be closed, be bound, where 

possible, to provide other reasonably sufficient means of access to holdings adjacent to 

such road or part, if no such means of access already exist : 

Provide also that where there is a stretch of road over half a mile in length , the road or 

part thereof closed at any one time shall not exceed half a mile in length and that where 

possible in such closed parts, an alternative route shall be provided.

[ 1 3A. Resumption by Government of control of roads placed under local 

authorities.- The 2 Government may, at any time by notification withdraw any 

Government road from the control and administration of any local authority under which 

it may have been placed by or under any law and resume the control and administration 

thereof itself; and thereupon the right of control and administration of the local authority 

in respect of such road shall cease.] 

4. Power to make rules.- (1) 2 The [Government] 3 [may after previous publication, make] 

rules.- 

(i) for the regulation and safety of traffic on Government roads; 3a (ia) “for the 

regulation of construction work within ten meters of such Government roads called 

National High Ways and Regional Highways.” 

(ii) for the prevention of obstruction and encroachments and of nuisances on or near 

such roads; 

(iii) for the preservation of such roads; and 

(iv) for the temporary closing of such roads for repair or other works, or for the 

purposes specifically set forth in section 3.

5. Penalties.- In making any rule under this Act, the 2 Government may direct that a 

breach thereof shall be punishable with a fine which may extend to “ 5a ten thousand 5 taka 

and a continuing breach shall be punishable with simple imprisonment for a period of six 

months and also a further fine not exceeding one hundred taka 5 ” for every day after the 

date of the first conviction during which the offender provided to have persisted in the 

offence.

S.R.O No. 63/2001. In exerciser of the power conferred by section 4 of the 

Highways Act, 1925 (Act, III of 1925) the Government is pleased to make the 

following Rules, which is pre-published vide Notification S.R.O No. 313- 

Law/2000, Dated 16 th October, 2000 corresponding 1 st kartik, 1407 BS as per 

requirement of section 4 of that Act, namely- 

1. Title of Rules. – These Rules may be called the Highways (Security, 

Protection and Restriction of Movement) Rules, 2001. 

2. Delimitation. – In this Rules unless there is anything repugnant in the 

subject of context- 

(a) “ Department” means the Road and Highways Department and for 

the purpose of these Rules, includes any employee of the 

Department of person authorized by the Department. 

(b) “ Authorized Point” means an access point to or exit point from any 

highway specified by the Department, and includes railway 

Passover, specified footpath for public or animals, or when any part 

of the highway is closed, the alternative road. 

(c) “ Act,” means the Highways Act, 1925 (Act III of 1925). 

(d) “ Driver” means driver of a motor vehicle. 

(e) “ Traffic sign” means any signal by electrical lamps, posts, pillars, 

instruction of information installed of erected to restrict movement 

of the highway. 

(f) “ Parking site” means any site specified by the Department for 

parking or stoppage of motor vehicles on the highway. 

(g) “ Person” includes statutory body, company, society, association or 

any other organization. 

(h) “Motor Vehicle” means a motor vehicle defined under section 2(27) 

of Motor vehicles Ordinance, 1983 (LV of 1983) and includes any 

other vehicle time to time specified by the Department as highways. 


(i) “Highway” means a Government road defined under section 2 of the 

Act and which is specified or declared by the Department. 

3. Declaration of road protection corridor. – The Department may declare 

the following area as road protection corridor of any highway, namely- 

(a) Area used by the public for movement. 

(b) Area marked as road divider of the highway. 

(c) Area determined by the department and open for use by cyclists, 

animals and pedestrians. 

(d) Parking site. 

(e) Any other area in or adjacent to a road as may be determined by the 

Department. 

4. Restriction of movement on the highway. – No person shall – 

(a) be a pedestrian on the place which is not authorized by the 

Department or take possession of any place on the highway, except 

for the purposes authorized under these rules. 

(b) drive or park any vehicle other than the motor vehicle. 

(c) drive a motor vehicle on the highway which is not capable of 

attaining or maintaining on a label road of a speed of 60 kilometers 

per hour. 

(d) park any motor vehicle at a place other than the parking site and in 

case of parking shall abide by the instruction issued by the 

department. 

(e) carry of accompany any animal in any vehicle other than a truck or 

similar vehicle or, being in charge of his animals, shall not cause to 

access or move or take possession of any place on the highway, 

except the place determined by the Department. 

(f) make a ‘U’ turn of “ one way road” or drive in any other direction 

other than the approved direction. 

5. To Follow authorized point and Traffic signs. – 

(1) No driver of a motor vehicle shall access to or exit from highway 

other than the authorized point. 

(2) On access to or exiting from highway or driving on the highway, 

the driver of a motor vehicles shall- 

(a) abide by the traffic signs. 

(b) cause to passover pedestrians, animals, birds and other transport, in 

accordance to traffic laws. 

(c) not exceed the label road speed instructed by the Department. 

6. Restriction on the use of highways by adjacent land owners or 

occupiers. – No owner or occupier of any land adjacent to the highway 


shall make, without written permission form the Department, any road 

accessing to the highway. 

7. Restriction on the stoppage of motor vehicles on the highways, etc. – A 

driver of a motor vehicle shall not stop at any place on the highway, except 

for the following places or events, namely- 

(a) parking site. 

(b) where, to avoid injury to a person or damage to property, he is 

found to bring his vehicles to a sudden stop. 

(c) where he is instructed to stop by traffic sign. 

(d) Where there is not such place nearby and the vehicle is so disable 

that it is impossible to avoid stop : Provided that to repair or 

remove the disabled motor vehicle from the place concerned other 

necessary motor vehicles on the highway may be stopped and the 

persons concerned may stay for the required time. 

(e) where, he is instructed by an employee of the Department of a 

member of the law enforcing agency, or in the event of any road 

accident or hue and cry to meet any emergency situation. 

8. Restriction of destructive use of highways, etc. – No person, without 

written permission form the Department, shall- 

(a) take possession or use any part of the slope, Berm, borrowpit of any 

highway. 

(b) construct or change any structure, dig of fill earth or cultivate or 

plant or undertake any works on or under any part of a highway or 

within ten meters of the highway. 

(c) deposit of place goods or materials on a highway. 

9. Matters to be observed during the development and repairmen of 

Highways. – To carry out the purpose of development, repairmen, 

reformation on similar works on any highway, an officer of the 

Department or any other person authorized by the Department may- 

(a) stop movement and use of the highway for a short period of time. 

(b) arrange to provide alternative way. 

(c) take any measure to meet all sorts of necessities for such purposes. 

10. Duties of the Department. – The Department shall specify authorized 

point including installation of traffic signs, one way road, parking sites on 

the highway and keep all the measures in order to implement the provision 

of these rules. 

11. Offence and penalty. – A person who vioefates rules 4, 5, 6, 7, 8 or 9 

commits an offence and shall be liable to pay a fine of taka ten thousand, 

and for continuity of violation shall be liable to simple imprisonment for a 


period not exceeding six months and pay a fine of taka one hundred for 

each day. 

12. Power to remove unauthorized motor vehicles, etc. – 

(1) Where it appears that an offence is committed under these Rules, 

any police or member of the law enforcing agency, may remove any 

vehicle, goods, animals, structure or any other things related to the 

offence from the highway. 

(2) For the purpose of sub-rule (1) any employee of the Department or 

person authorized by the Department, may request to the police or 

the member of the law enforcing agency for such removal and the 

police or the member of the law enforcing agency shall act 

accordingly. 

13. Publication of authentic English text. – The Government shall by 

notification in the Official Gazette, publish an authentic text of an 

authorized translation in English of these rules to be known as authorized 

English text. 

Provided that in the event of conflict between these rules and English text, 

these rules shall prevail.
