2nd <strong>Dhaka</strong>-<strong>Chittagong</strong> National Highway (Expressway)<br />

Request for Qualification Document<br />

8.1.16 The RHD shall qualify the Investors as Short-listed Investors who have passed<br />

all the tests <strong>of</strong> qualification criteria set out in this Request for Qualification<br />

(RFQ).<br />

8.1.17 The RHD reserves the right to contact <strong>and</strong> verify Investor’s information <strong>and</strong><br />

references for the purpose <strong>of</strong> short-listing.<br />

8.1.18 Failure <strong>of</strong> an Investor to submit the complete information as requested by the<br />

RHD in the Request for Qualification (RFQ) may lead to rejection <strong>of</strong> the<br />

Qualification Statement in its entirety.<br />

8.1.19 Investors should be aware that the RHD reserves the right to use <strong>and</strong> interpret<br />

the documentation it receives in accordance with its own judgment <strong>and</strong> its own<br />

methods to arrive at qualification selection, <strong>and</strong> to decide alone <strong>and</strong> without<br />

any potential Investor being entitled to any recourse, which Investor will be<br />

selected, if any, to receive the IFT.<br />

8.1.20 Experience <strong>and</strong> resources <strong>of</strong> subcontractors shall not be taken into account in<br />

determining the Investor’s compliance with the qualification criteria.<br />

8.1.21 The RHD may conditionally shortlist Investor(s) if the information <strong>and</strong><br />

document submitted do not materially affect the Investor’s assessment during<br />

Shortlisting/Qualification process. In such situation, the RHD will ask the<br />

respective Investor(s) to provide information <strong>and</strong> document before the<br />

purchase <strong>of</strong> Request for Proposal (RFP).<br />

8.2 Joint Venture<br />

8.2.1 The Investor can be a single entity or a group <strong>of</strong> entities (hereinafter referred<br />

to as joint venture), coming together to implement the Project;<br />

8.2.2 Members <strong>of</strong> joint venture shall nominate a member as “Lead Investor” <strong>and</strong><br />

once nominated shall not be cancelled or changed in any circumstances during<br />

project period;<br />

8.2.3 No change in the structure or composition <strong>of</strong> a joint venture shall be permitted<br />

between the submission <strong>of</strong> Proposal <strong>and</strong> the award <strong>of</strong> the contract. Any change<br />

in the composition <strong>of</strong> the joint venture in the above mentioned period shall<br />

lead to rejection <strong>of</strong> Proposal <strong>and</strong> the forfeiture <strong>of</strong> Tender Security;<br />
