Dear Friend,<br />

Thank you for taking the time to read this annual report—a year in the life <strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong><br />

<strong>of</strong> <strong>America</strong>.<br />

Perhaps you are one <strong>of</strong> those wonderful people I meet across the nation who will ask me,<br />

“How can I support our veterans?”<br />

Whether it’s the school janitor from my hometown <strong>of</strong> Woodward, Oklahoma, or the CEO <strong>of</strong> a<br />

multibillion dollar company in the Big Apple, my answer to this question is the same: Please make<br />

it your mission to help empower the lives <strong>of</strong> paralyzed veterans and their families. Give these brave<br />

men and women a helping hand to lead full, independent, and productive lives.<br />

Help us ensure that those who have worn the uniform and have been seriously injured have all they need to<br />

fully live the lives they deserve—and receive what they need most: care, benefits, and jobs.<br />

Let’s focus on just one <strong>of</strong> those needs: jobs. The national unemployment rate for veterans with severe<br />

disabilities is a shocking 85 percent. <strong>Paralyzed</strong> <strong>Veterans</strong> aims to turn this appalling statistic around—and,<br />

through our vocational rehabilitation program, as you will see in the pages <strong>of</strong> this report, we are helping<br />

our veterans get a fair shot at the <strong>America</strong>n Dream, a good job at a good company.<br />

My pledge to you is that <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> will always be here to help empower our heroes<br />

with disabilities—not just to live, but to live with dignity, enjoying the things they fought for: freedom and<br />

independence.<br />

We’ll do this by fighting for and securing quality VA health care and ample benefits and by helping them<br />

get back into life through adaptive sports. We’ll strive to make progress on the ground-breaking <strong>America</strong>ns<br />

with Disabilities Act to make <strong>America</strong> more barrier-free for wheelchair users. And we’ll invest in the<br />

development <strong>of</strong> new treatments and cures for paralysis. With your support, we will do all<br />

Lisa Level vividly remembers the day she knew something<br />

was seriously wrong with her husband, Chester.<br />

(In August 2009) Chester had been helping a friend ro<strong>of</strong><br />

a house. He came home, and I said, “You look like you<br />

had a stroke.” He was stammering, just not himself. So I<br />

took him to the hospital.<br />

At the hospital, doctors confirmed what the Levels had<br />

suspected for a while: the 55-year-old Oklahoma City truck<br />

driver and veteran <strong>of</strong> the U.S. Navy had amyotrophic lateral<br />

sclerosis (ALS), more commonly known as Lou Gehrig’s<br />

disease.<br />

The doctor said, “Everything looks like he has Lou<br />

Gehrig’s.” He kept Chester in the hospital and did<br />

a needle test where he stuck his face, arm, and legs.<br />

That was when they confirmed it was Lou Gehrig’s.<br />

In the year or so since he was diagnosed with ALS, Chester<br />

has gotten progressively worse.<br />

He’s got muscle deterioration. He’s choking on his food. You<br />

can’t understand him when he’s talking. And he sleeps an<br />

awful lot. He’s not able to be as active as he used to be. He<br />

loses his balance when he walks. But the neurologist told me<br />

to let him stay as active as he can.<br />

ALS, a progressive degenerative neurological disease,<br />

disproportionately affects veterans. Some studies show<br />

that veterans are twice as likely as those who never served<br />

in the military to get the disease. ALS is a deadly disease.<br />

Except in rare instances, it is fatal.<br />

Two years ago the Department <strong>of</strong> <strong>Veterans</strong> Affairs (VA) began<br />

compensating veterans with ALS who had served at least 90<br />

days, and since then <strong>Paralyzed</strong> <strong>Veterans</strong> has contacted more<br />

than 4,000 ALS veterans or their families to ensure they know<br />

about the ruling and to assist with claims.<br />

Since the onset <strong>of</strong> this aggressive disease, the Levels have<br />

also had to confront red tape at VA, a difficult and painful<br />

fight—until Shawn Tracy, a <strong>Paralyzed</strong> <strong>Veterans</strong>’ national<br />

service <strong>of</strong>ficer, and Regina Presley, senior secretary, in<br />

Oklahoma City, began to assist them.<br />

I can’t really emphasize how much help Shawn has been.<br />

Shawn is a paraplegic himself; he has a heart <strong>of</strong> gold.<br />

I never would have gotten my husband’s speech device<br />

without him. Shawn kept on them at the VA: He said,<br />

“This patient needs this device now because I’m listening to<br />

this patient, and I can barely understand him.”<br />

Shawn has intervened on a lot <strong>of</strong> things. Without him we<br />

would have had no idea how to get started. He helped<br />

me get a housing grant so we could have a bedroom and<br />

bathroom added on to the house. The old part <strong>of</strong> the<br />

house was so tiny we couldn’t get the wheelchair through.<br />

The grant was for $67,000. It makes it possible for Chester<br />

to maneuver around.<br />

Shawn helped us get a grant for a car with a lift. We took<br />

the passenger seat out and put a turning chair in there.<br />

Between the lift, the seat, and the installation, the cost was<br />

$18,000. The VA gave us a grant to pay for it, but they<br />

kept putting it <strong>of</strong>f and putting it <strong>of</strong>f. Shawn went and<br />

talked to someone in the VA, and it was taken care <strong>of</strong> after<br />

that.<br />

But the Levels’ struggles were not over; a VA doctor interpreted<br />

Chester’s reaction to a medication as incompetence.<br />

The medicine tired Chester and made him<br />

groggy. But declaring him incompetent meant Lisa could<br />

not readily access her husband’s veterans benefit funds.<br />

It also meant that she had to go to a VA facility anytime<br />

she wanted to spend some <strong>of</strong> his money on him, even on<br />

such items as clothing. It took six months before she was<br />

able to get the declaration overturned with the assistance<br />

<strong>of</strong> Shawn, who wrote a letter on the Levels’ behalf, clearly<br />

outlining the situation and the doctor’s error.<br />

The letter had the desired impact. The doctor’s declaration<br />

was reversed.<br />

Shawn and Regina are very fine people. They have helped<br />

me a lot. I wouldn’t have known what to do. I love them<br />

and they’ve been real helpful to me. If I need anything they<br />

help me get it. If I had to give them a grade, I’d give them<br />

an A+.<br />

I spent the first four years <strong>of</strong> my career in the Marine<br />

Corps. Then I went to college. I joined the Army in 2002<br />

after college. In October 2009 I was deployed<br />

to Afghanistan.<br />

Capt. Eric Lorence was stationed in Kandahar, where he<br />

was training Afghani soldiers. On March 12, 2010, he was<br />

on patrol when his truck hit a roadside bomb containing<br />

about 300 pounds <strong>of</strong> explosives. The explosion partially<br />

severed his spine.<br />

It killed my gunner. My buddy got his face smashed in.<br />

I remember waking up and I knew my back was broken.<br />

I don’t remember anything after that. I woke up at Walter<br />

Reed.<br />

Following a few weeks at Walter Reed Army Medical<br />

Center in Washington, DC, Eric was flown to the VA<br />

medical center in Minneapolis.<br />

Even though he was months away from being discharged<br />

from the Army, <strong>Paralyzed</strong> <strong>Veterans</strong> immediately began<br />

helping Eric maneuver the difficult terrain <strong>of</strong> the Department<br />

<strong>of</strong> <strong>Veterans</strong> Affairs and to receive the benefits to<br />

which he is entitled.<br />

I got to Minnesota on the 7th <strong>of</strong> April. A couple<br />

<strong>of</strong> days later <strong>Paralyzed</strong> <strong>Veterans</strong> was assisting<br />

me with benefits.<br />

When I got to the spinal cord injury (SCI) center in<br />

Minneapolis, the only function I had was to wiggle my<br />

toes. Through extensive rehabilitative therapy and<br />

determination, I was able to regain 60 percent <strong>of</strong> function<br />

in my left leg and 30 percent <strong>of</strong> function in my right leg.<br />

Because I am an incomplete paraplegic, I am now to the<br />

point where I can ambulate with a walker; however, I<br />

cannot go to the restroom on my own and rely on a “selfcath”<br />

and bowel program.<br />

With Eric focusing on recovery, <strong>Paralyzed</strong> <strong>Veterans</strong><br />

focused on his benefits. Jason Stephenson, a <strong>Paralyzed</strong><br />

<strong>Veterans</strong>’ benefits pr<strong>of</strong>essional in Minnesota, said Eric<br />

wasn’t aware that, although still on active duty, there were<br />

benefits to which he was entitled, including having adaptive<br />

equipment added to two vehicles and going through hand<br />

control training—all provided by VA.<br />

Jason acted as the liaison with VA, working directly with<br />

the chief <strong>of</strong> prosthetics to ensure that both vehicles<br />

were adapted in a timely fashion. Jason, along with Tami<br />

Anderson, national service <strong>of</strong>ficer, also informed Eric <strong>of</strong><br />

his eligibility for a specially adapted housing grant and<br />

assisted with filing the papers and follow-up to ensure<br />

that he received it.<br />

They helped me obtain the adaptive housing grant. The<br />

grant pays $63,000 and will help me do the modifications<br />

for my house—install hand railings, build a ramp, and<br />

things like that. Jason did all the paperwork and helped<br />

me file for the grant. I didn’t have to do anything. PVA just<br />

stepped in and helped me.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> is very, very knowledgeable. If I have<br />

any questions about benefits and they don’t know the<br />

answer, they are very helpful in tracking it down. They<br />

follow up with me. They are very proactive.<br />

I plan to get involved with them and help other veterans<br />

out as much as they’ve helped me out.<br />

the lowest-income veterans.<br />

They rely on Social Security<br />

and veteran pensions. They<br />

are also probably the highestend<br />

users <strong>of</strong> the VA health-care<br />

systems. Copayments presented<br />

a significant financial burden<br />

for them. We saw this as a real<br />

problem affecting the quality <strong>of</strong><br />

life <strong>of</strong> our members. As a result<br />

<strong>of</strong> this newly enacted law, they<br />

may not be able to eat steaks,<br />

but they won’t have to skip<br />

meals.”<br />

Seriously disabled veterans have<br />

the highest rate <strong>of</strong> unemployment<br />

among former members <strong>of</strong> the<br />

armed forces. Many <strong>of</strong> them live<br />

right at or below the poverty line.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> continually<br />

explores ways to ease their<br />

fought for by our Government<br />

Many <strong>of</strong> the nation’s paralyzed veterans live on the fringes<br />

<strong>of</strong> poverty. They struggle to survive on Social Security<br />

income and veterans pension checks. Each month some<br />

must make difficult financial choices, such as either<br />

paying the rent or buying badly needed medication. Such<br />

was the case for Ron Hoskins, a 60-year-old veteran who<br />

lives in Parkesburg, Pennsylvania.<br />

I use the VA for all my health care. I was spending $100 to<br />

$120 a month easily just for copays and to see the doctor.<br />

It was $15 (copayment) for each medication. To see a<br />

specialist was $50 more. If you failed to pay your copay,<br />

the government would automatically take it out <strong>of</strong> your<br />

Social Security.<br />

In recent months, however, life has become a little easier<br />

for Ron and many <strong>Paralyzed</strong> <strong>Veterans</strong>’ members with<br />

the May 2010 passage <strong>of</strong> a law eliminating medical<br />

copayments for catastrophically disabled veterans. The<br />

Caregivers and <strong>Veterans</strong> Omnibus Health Services Act<br />

<strong>of</strong> 2010, among other things, prohibits the Department<br />

<strong>of</strong> <strong>Veterans</strong> Affairs from requiring copayments for VA<br />

medical care or medication, and applies to veterans<br />

whose disabilities are not service connected.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> worked with allies in both chambers <strong>of</strong><br />

Congress for more than five years to get this bill passed.<br />

In addition to leaning heavily on Members <strong>of</strong> Congress,<br />

our leaders took a grassroots approach, enlisting our<br />

34 chapters around the country and encouraging our<br />

members to make sure Congress heard their voices<br />

as well.<br />

For years, most disabled veterans whose injuries or<br />

ailments had no direct connection to their years in military<br />

service spent on average more than $100 monthly on<br />

copayments for medication and other direct health-care<br />

benefits. For the most severely injured, who require<br />

dozens <strong>of</strong> medications and multiple monthly visits to VA<br />

medical centers, annual health-care expenses sometimes<br />

climbed as high as $1,000.<br />

As <strong>Paralyzed</strong> <strong>Veterans</strong> had anticipated, the new law<br />

had an immediate and significant positive impact on<br />

approximately 10,000 veterans, like Ron.<br />

Before this law I was barely able to make ends meet. I’d buy<br />

fewer groceries and drive less. I’d skip meals.<br />

The nature <strong>of</strong> his disability makes it impossible for Ron<br />

to hold a job.<br />

After I was injured, it was me against the world for awhile.<br />

I went back to school and got my associate’s degree in<br />

mechanical design. I tried to go to work but my body<br />

wouldn’t let me.<br />

I am paralyzed from the waist down. My body is slowly<br />

deteriorating. I have severe tendonitis in both shoulders<br />

and a rotator cuff tear in my right shoulder. I have a tear<br />

in the tendon <strong>of</strong> the bicep that hooks the bicep to the<br />

shoulder bone. It snapped. I have bone spurs all over<br />

the place. I have osteoporosis and arthritis. I have had<br />

two kidney stone operations. Now I can’t take any <strong>of</strong><br />

the calcium to keep up my bone structure because the<br />

medicine that would help me build bone strength could<br />

cause kidney stones. I’ve got a lot wrong with me.<br />

My only income is my Social Security check that pays me<br />

$1,737 a month. My rent alone is $1,000 a month.<br />

Having the cash formerly used for copayments back in his<br />

pocket has improved Hoskins’ life in many ways, including<br />

having enough to keep groceries in the house and even to<br />

spoil his grandkids with occasional gifts.<br />

I always chose medicine over food. Skipping a meal here<br />

and there and not eating right is not good.<br />

Until this law I did not have the ability to put any money<br />

aside for my grandsons for Christmas. It was difficult.<br />

Those days were hard, monetarily hard. I didn’t feel like I<br />

was measuring up for my grandkids. I felt I was letting them<br />

down and my son, too.<br />

It’s a relief mentally that I am able to do something for them<br />

now. My mood is better in that respect. My middle grandson<br />

plays football. He’s in the 10th grade on the junior varsity<br />

team. I was recently able to get him the cleats he needed.<br />

If it wasn’t for <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong>, I don’t<br />

know where I’d be right now. I’m just so glad I don’t have<br />

to make copays anymore.<br />

Until recently, the prevailing wisdom in the medical<br />

community held that paralysis from spinal cord injury or<br />

disease (SCI/D) was irreversible and functional restoration<br />

was impossible. But doctors Stephen Waxman and Jeffery<br />

Kocsis at Yale University are leading a multi-disciplinary<br />

team <strong>of</strong> neurologists and neuroscientists who are<br />

challenging that thinking and paving the way for a major<br />

medical breakthrough.<br />

These groundbreaking studies are being supported<br />

by funding from <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> at the<br />

Center for Neuroscience and Regeneration Research,<br />

a collaboration among <strong>Paralyzed</strong> <strong>Veterans</strong>, Yale University,<br />

and the Department <strong>of</strong> <strong>Veterans</strong> Affairs. Waxman and<br />

Kocsis are the director and associate director, respectively,<br />

<strong>of</strong> the Yale Center.<br />

Reversing paralysis caused by spinal cord injury has been a<br />

priority <strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong> since its founding more than<br />

60 years ago, and we have provided more than<br />

$4 million to the Yale Center for such research.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> has been absolutely essential to<br />

research on spinal cord injury,” Waxman said. “It is<br />

largely a testament to the organization that the idea <strong>of</strong> a<br />

cure for spinal cord injury has been transformed from an<br />

impossibility into an achievable goal. <strong>Paralyzed</strong> <strong>Veterans</strong><br />

has been a major player in this remarkable transformation.<br />

Ten to 15 years ago I couldn’t talk to a lay audience and<br />

use the word “cure.” Now I can confidently use the word<br />

“cure.” Nobody can give you a firm timeline. But things<br />

have changed in important ways.<br />

Research teams led by Waxman and Kocsis have<br />

discovered that injury to the protective coating <strong>of</strong> nerve<br />

cells is a major contributor to paralysis in the aftermath <strong>of</strong><br />

a spinal cord injury. They are now investigating ways to<br />

restore nerve function in areas where this protective layer<br />

has been bruised or stripped altogether. For example, they<br />

are exploring the ability <strong>of</strong> transplanted cells to produce new<br />

myelin insulation, which will facilitate conduction along spinal<br />

cord axons after injury. The researchers have discovered<br />

that some nerve fibers remodel themselves after the loss<br />

<strong>of</strong> the insulation. They insert tiny molecular batteries called<br />

“sodium channels” in their membranes so they can convey<br />

information even in the absence <strong>of</strong> insulating myelin.<br />

Many people with SCI/D suffer chronic pain, and pain<br />

studies are another focus at the Yale Center. Scientists<br />

have discovered a protein molecule, NaV1.7, that is a<br />

major contributor to pain after injury to the nervous system.<br />

Individuals genetically predisposed to mutations that<br />

cause NaV1.7 to be overactive suffer from severe chronic<br />

pain. This happens even when there is no painful stimulus.<br />

Scientists are now working to develop medications that<br />

will turn <strong>of</strong>f NaV1.7. They hope this will result in new, more<br />

effective medications for pain after spinal cord and nerve<br />

injury.<br />

We can now target the culprit cells and molecules in a very<br />

precise, very specific way. We have a set <strong>of</strong> techniques that<br />

15 years ago were unimaginable or considered science<br />

fiction, and this is important because if you want to make a<br />

new medication, we can use these new methods to act in a<br />

very precise way on specific target molecules.<br />

Recent discoveries at the Yale Center are also challenging<br />

the assumption that tissue in the central nervous system<br />

is incapable <strong>of</strong> regeneration. One discovery stems from an<br />

observation that some nerve cells survive at the site <strong>of</strong> injury.<br />

Yale researchers report that this is true even in patients with<br />

no function below the injury. These surviving nerve cells are<br />

bruised, however, and are at risk <strong>of</strong> dying through a process<br />

called “secondary injury.” Saving these cells is crucial to<br />

restoring function, so researchers at the Yale Center are<br />

dissecting the molecules that cause secondary injury in the<br />

hope <strong>of</strong> learning how they can inhibit these molecules and<br />

thus ensure survival <strong>of</strong> at-risk nerve cells.<br />

Researchers have also been studying glial cells, whose<br />

functions include providing support for nerve cells. Glial<br />

cells outnumber nerve cells 10 to 1 and play nutritive and<br />

cleaning roles.<br />

It is known that a glial scar forms and interferes with<br />

regeneration <strong>of</strong> nerve cells following a spinal cord injury.<br />

This scar is therefore thought to hamper recovery. So<br />

scientists at the Yale Center are testing the hypothesis that<br />

inhibiting the development <strong>of</strong> the glial scar may provide a<br />

way to facilitate regeneration that will improve functional<br />

recovery.<br />

A great deal <strong>of</strong> this work has made possible by <strong>Paralyzed</strong><br />

<strong>Veterans</strong>’ 21 years <strong>of</strong> funding and support, celebrated in<br />

2009 when a new research wing was opened.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> is a wonderful and unique<br />

group. In addition to the financial support they provide for<br />

research at Yale and the grants provided to other scientists<br />

through their Research and Education Foundations,<br />

they have been pioneers in terms <strong>of</strong> legislative work and<br />

advocacy. They’ve been a beacon <strong>of</strong> support for people<br />

with disabilities in general. We are immensely proud <strong>of</strong> our<br />

partnership with <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong>.<br />

Within the next five years, wheelchair users with severely<br />

limited hand function, as occurs in high-level spinal cord<br />

injury, will be able to quickly and more easily perform tasks<br />

that most <strong>of</strong> us take for granted: getting dressed, cooking<br />

dinner, putting away dishes, grocery shopping. Thanks<br />

to a futuristic robotic wheelchair known as “PerMMA,”<br />

individuals who have struggled with the simple activities<br />

<strong>of</strong> everyday living will become more independent and<br />

empowered.<br />

PerMMA, Personal Mobility and Manipulation Appliance,<br />

is an electric-powered wheelchair with robotic arms that<br />

can be manipulated by the user or remotely through<br />

the Internet. It enables people with mobility and upper<br />

extremity disabilities to perform tasks that ordinarily<br />

require the assistance <strong>of</strong> others. Popular Science<br />

magazine recently named PerMMA one <strong>of</strong> the 10 most<br />

promising robots.<br />

The wheelchair is the brainchild <strong>of</strong> researchers at HERL,<br />

the Human Engineering Research Laboratories, which has<br />

been supported by <strong>Paralyzed</strong> <strong>Veterans</strong> since its inception.<br />

HERL is a joint program <strong>of</strong> the University <strong>of</strong> Pittsburgh and<br />

the U.S. Department <strong>of</strong> <strong>Veterans</strong> Affairs (VA) Rehabilitation<br />

Research and Development Service. Dr. Rory Cooper,<br />

director <strong>of</strong> HERL and <strong>Paralyzed</strong> <strong>Veterans</strong>’ member, says<br />

the wheelchair will enable users to be more independent.<br />

The objective <strong>of</strong> PerMMA is to combine manipulation and<br />

mobility assistance with perception and decision making<br />

wherever a person goes. PerMMA combines mobility,<br />

bimanual robotic manipulation, machine perception,<br />

path planning, controls, and user interface. No<br />

devices <strong>of</strong> this nature currently exist. For many people<br />

with disabilities, essential tasks, such as dressing,<br />

shopping, and food preparation, require the assistance<br />

<strong>of</strong> an attendant. PerMMA aims to address these needs,<br />

thus reducing or eliminating the need for caregiver<br />

assistance.<br />

For nearly two decades, with substantial funding<br />

from the <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> Research<br />

Foundation, HERL has developed an array <strong>of</strong><br />

assistive technologies that have improved the lives<br />

<strong>of</strong> thousands <strong>of</strong> disabled veterans with disabilities<br />

and other people with disabilities.<br />

Cooper credits <strong>Paralyzed</strong> <strong>Veterans</strong>, which has provided<br />

funding <strong>of</strong> $450,000 in the past five years alone, for<br />

much <strong>of</strong> the program’s success. In fact,<br />

in 2010 <strong>Paralyzed</strong> <strong>Veterans</strong> received the University<br />

<strong>of</strong> Pittsburgh’s Philanthropist Award.<br />

We’ve had a great relationship for nearly 20 years now.<br />

Federal funds are <strong>of</strong>ten very restrictive. <strong>Paralyzed</strong><br />

<strong>Veterans</strong> funding allows us to complement federal funds<br />

in order to accomplish research goals. The impact <strong>of</strong><br />

this research is probably as large as any in the country or<br />

the world.<br />

Indeed, HERL is a world-renowned leader in research<br />

and development for increasing mobility and function for<br />

people with disabilities.<br />

PerMMA is just one <strong>of</strong> scores <strong>of</strong> mobility devices that<br />

scientists at HERL have developed. HERL currently<br />

has about 50 ongoing studies, at least six patents<br />

in review, and is the recipient <strong>of</strong> several technology<br />

transfer grants. Cooper stresses the role <strong>Paralyzed</strong><br />

<strong>Veterans</strong> has played in making these accomplishments<br />

possible, beginning with launching his career in assistive<br />

technology.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> provided funding<br />

for my pilot research projects. Now they are helping<br />

me launch other people’s careers and have been very<br />

helpful in supporting young undergrads and postdocs.<br />

I would be willing to bet that our research has affected<br />

nearly every member <strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong> through<br />

improvements in wheelchairs through ergonomics<br />

and training pr<strong>of</strong>essionals to fit people for ultralight<br />

wheelchairs.<br />

Cooper, who was injured while in the Army, added<br />

that <strong>Paralyzed</strong> <strong>Veterans</strong> members are very supportive<br />

and are a key reason for the success <strong>of</strong> HERL’s research<br />

projects.<br />

A lot <strong>of</strong> members participate in our research projects. We<br />

have had between 200 and 300 participate this year.<br />

A lot <strong>of</strong> them not only participate but help guide us in<br />

what our research topics should be. So we actively solicit<br />

ideas from them and their families.<br />

We’re very focused on improving the long-term health<br />

and quality <strong>of</strong> life <strong>of</strong> paralyzed veterans. We’ve also<br />

helped VA set policy for prosthetics in recreation,<br />

wheelchair, and other technology. I would argue that<br />

HERL has touched everybody that uses a wheelchair in<br />

the United States.<br />

In the 13 years since he was first diagnosed with multiple<br />

sclerosis (MS), U.S. Air Force veteran Alfred Harrison has<br />

learned to cope with pain as a constant companion. MS<br />

is a degenerative disease that affects the brain and spinal<br />

cord, leading to diminished use <strong>of</strong> extremities, paralysis,<br />

and pain.<br />

I have learned not to complain about it, but I am<br />

in pain all the time. When I have an episode, it feels<br />

like someone is stabbing me in the spine and I’m being<br />

electrocuted at the same time. Then I have this sensation<br />

in my legs and it feels like my feet are on fire.<br />

I’m usually down for two to three weeks. I ambulate with<br />

a cane, but I need a wheelchair to go long distances.<br />

Aquatic therapy and acupuncture have helped the pain<br />

and, motivated by the expenses <strong>of</strong> his youngest child’s<br />

college education, Alfred wanted to go back to work.<br />

A part-time, unpaid minister, he hasn’t held a paying<br />

job in years. And he knew that going back to work in this<br />

economy would be difficult. So he turned to <strong>Paralyzed</strong><br />

<strong>Veterans</strong>.<br />

Joan Haskins, the vocational rehabilitation counselor<br />

for job placement in Long Beach, was in contact with me<br />

every single day. I was always sending her jobs and telling<br />

her I needed Schedule A forms. I would email the positions<br />

I was interested in to her and within a matter <strong>of</strong> hours<br />

she would have the Schedule A letters back to me. She<br />

is really good at what she does. She’s very attentive and<br />

very meticulous about following up to ensure that you get<br />

a position or get a job.<br />

In less than three months <strong>of</strong> working with Joan, Alfred<br />

landed a job as a supply tech at an Air Force commissary.<br />

They are great advocates, <strong>Paralyzed</strong> <strong>Veterans</strong>.<br />

I don’t know how many vets I have sent to them. I’m<br />

a member <strong>of</strong> all the veterans organizations but in my<br />

opinion <strong>Paralyzed</strong> <strong>Veterans</strong> by far is the best organization<br />

I’ve seen out <strong>of</strong> all them as far as being an advocate<br />

for veterans.<br />

SAVIKA WILLIAMS | T-11 | ARMY<br />

Not all service-connected injuries occur in combat.<br />

Some occur during service in foreign theaters during what<br />

would seem to be routine experiences.<br />

While serving as a logistics specialist in Korea in 2002,<br />

Savika Williams went to an emergency room with severe<br />

stomach pains. She was examined and given a shot for the<br />

pain, and waited to be discharged.<br />

It was getting late. I said I needed to go home and they<br />

told me I had to wait to be discharged. I got up to use<br />

the bathroom and just fell on the floor. I couldn’t walk; I<br />

couldn’t use the bathroom. They really don’t know what<br />

happened.<br />

Her spinal cord injury is classified as T-11. The exact<br />

diagnosis is still unknown. All Savika knows is that her<br />

military career and hopes for a college education ended at<br />

that moment.<br />

Basically when I was 18 (the military) was the only option<br />

I had because I had no money for college.<br />

No matter where or how a spinal cord injury is incurred,<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> ensures that our veterans injured in<br />

service to our country receive all the benefits to which they<br />

are entitled.<br />

Savika received care at the Augusta Spinal Cord Injury<br />

Center, where she met one <strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong>’ top<br />

service <strong>of</strong>ficers, the late Chuck Izzett, and others who<br />

quickly made sure she knew she was not alone.<br />

Everybody came to me and I am really thankful for that. I<br />

didn’t have to leave the hospital. Chuck was making sure<br />

I was getting everything, telling me I was eligible for ‘this,<br />

this, and this.’ Everything was really, really smooth.<br />

Chuck explained to Savika her eligibility for adaptive<br />

equipment, hand controls for automobile, adaptive housing,<br />

clothing; as she says “the whole nine yards.” Chuck made<br />

sure all necessary paperwork was filed and followed up to<br />

ensure VA granted her benefits in a timely manner.<br />

He helped me out with a lot <strong>of</strong> stuff. Everyone was<br />

absolutely helpful.<br />

Chuck helped secure a $50,000 specially adapted<br />

housing grant, which Savika used as a downpayment on<br />

a home in Groveton, Georgia—one that is 100 percent<br />

wheelchair accessible—where she is raising her daughter,<br />

Daija, and hoping one day to get her education.<br />

I can’t sit up for too long and can’t stand for too long, but I<br />

want to go to school and be a role model for my daughter,<br />

so she can see I’m doing it, too.<br />

Savika wants to study psychology, and says she would<br />

“love to” use that degree in counseling for people with<br />

disabilities. <strong>Paralyzed</strong> <strong>Veterans</strong> will continue to assist<br />

her with VA claims and benefits and help her achieve<br />

all her goals.<br />

KEVIN KROGH | DOUBLE AMPUTEE | AIR FORCE<br />

A March 2007 car accident ended Kevin Krogh’s<br />

ambitions for a career in the Air Force. He suffered<br />

broken bones in the upper and lower body and is now<br />

a double amputee above the knees.<br />

I couldn’t believe it happened. I couldn’t imagine a future<br />

for myself. I had no idea what I was going to do. I just<br />

hated my life and didn’t know what I was going to do.<br />

But after a year, through physical therapy, sheer<br />

determination, and his prosthetic legs, Kevin was able<br />

to walk again.<br />

I can walk. I can run. I can swim. I can do everything I<br />

want to do. It’s helping me tremendously. I run a couple<br />

<strong>of</strong> times a week. I use my walking legs every day. I ride<br />

bikes a lot, too. When I started walking on my own, the<br />

injured soldiers started to look up to me and I felt I had<br />

a good future.<br />

Kevin is now enrolled in college and has 12 credits under<br />

his belt. He’s not sure what he wants to study but is<br />

reasonably certain he wants to work with young people,<br />

perhaps as a counselor.<br />

Though he is not paralyzed, Kevin is receiving help in<br />

his search for full-time employment from the <strong>Paralyzed</strong><br />

<strong>Veterans</strong> Vocational Rehabilitation Center in San Antonio.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> is devoted to advancing the interests<br />

<strong>of</strong> all seriously wounded veterans who face an extremely<br />

competitive job market after discharge from the military.<br />

Vocational rehabilitation job counselors help them prepare<br />

for the workplace, assisting with résumé development,<br />

making contacts with hiring managers in the communities<br />

in which they live, and connecting them to the right<br />

job opportunities.<br />

Keisha Wright, vocational rehabilitation counselor in San<br />

Antonio, has been helping Kevin shape his future through<br />

counseling and by exposing him to career options he’d<br />

never considered. Kevin is one <strong>of</strong> about 80 veterans in<br />

Keisha’s caseload. In the past two years, she’s helped<br />

more than a dozen find gainful employment.<br />

Keisha helped to place Kevin in a volunteer counselor<br />

position at a Boys and Girls Club so he can explore<br />

his interests in counseling and working with young<br />

people. There’s a good chance this will turn into<br />

a full-time position.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> has been able to assist me in finding<br />

help when I needed to go back to school. It has helped me<br />

find a college and financial aid. It’s helping me find contacts<br />

around my hometown for jobs.<br />

An active, sporting lifestyle is <strong>of</strong>ten considered lost<br />

forever after spinal cord injury. <strong>Paralyzed</strong> <strong>Veterans</strong>’<br />

Sports and Recreation program to helps our members<br />

and all veterans with a disability get back into life.<br />

The National <strong>Veterans</strong> Wheelchair Games, Bass Tour,<br />

Trapshoot Circuit, Billiards Circuit, Bowling Circuit,<br />

adaptive scuba, and the new PVA Racing Team<br />

demonstrate the many and varied activities in which<br />

they can participate, and <strong>of</strong>ten may act as a springboard<br />

to other more physically challenging sports, such as<br />

kayaking, rock climbing, and rugby.<br />

Sports have therapeutic benefits on physical, mental,<br />

and social well-being. In addition, people with spinal<br />

cord injury are prone to secondary conditions that<br />

can be very serious, such as bladder infections, and<br />

they can be more prone to depression. Sports and<br />

recreational activities can help alleviate these.<br />

For the newly injured veteran, adjustment can be<br />

difficult, but participation in sports has been proven to<br />

play a positive role in the transition to life with paralysis.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong>’ Sports and Recreation program<br />

continues its outreach to veterans <strong>of</strong> Operation Enduring<br />

Freedom and Operation Iraqi Freedom (OEF/OIF). We<br />

<strong>of</strong>fer support and information about our programs,<br />

starting while service members not yet separated from<br />

the military are recovering at Walter Reed Army Medical<br />

Center and the National Naval Medical Center. We <strong>of</strong>fer<br />

support and information about our programs, starting<br />

even as service members are recovering at Walter<br />

Reed Army Medical Center and the National Naval<br />

Medical Center, as well as at VA medical centers and<br />

DOD hospitals. Our 34 chapters play a significant role<br />

in raising awareness <strong>of</strong> our programs and outreach to<br />

paralyzed veterans in their communities.<br />

Also in 2010 <strong>Paralyzed</strong> <strong>Veterans</strong> took 15 individuals<br />

who were recuperating at Walter Reed to Florida for a<br />

week <strong>of</strong> <strong>of</strong>fshore fishing. The activity gets them to begin<br />

to focus on what they can accomplish going forward.<br />

Getting out in a boat, participating with other individuals<br />

in wheelchairs, and starting to realize their abilities builds<br />

confidence that they can use going forward in their daily<br />

lives and getting back into society.<br />

In addition, 19 OEF/OIF veterans participated in<br />

the NVWG, cosponsored with the Department <strong>of</strong><br />

<strong>Veterans</strong> Affairs. With competition in 17 events for all<br />

levels <strong>of</strong> ability, the NVWG <strong>of</strong>fers the newly injured the<br />

opportunity to feel the thrill <strong>of</strong> competition, a sense <strong>of</strong><br />

accomplishment, and a renewed faith in their abilities.<br />

JOSEPH BEIMFOHR | DOUBLE AMPUTEE | ARMY<br />

In 2005 Staff Sgt. Joseph Beimfohr and his unit from the<br />

2nd Battalion 34th Armor Regiment in Iraq were patrolling<br />

when they came upon some wires linked to multiple<br />

improvised explosive devices, or IEDs. They managed to<br />

disarm several devices, but as they attempted to trace<br />

the wires to a possible hiding place <strong>of</strong> insurgents, one <strong>of</strong><br />

the soldiers walked into the “kill zone” and the insurgents<br />

detonated the explosives; he was killed instantly. Beimfohr<br />

lost his right leg and half <strong>of</strong> his left. He was immediately<br />

flown to Germany.<br />

I stayed there for a couple <strong>of</strong> days. Then I came to Walter<br />

Reed. I was in a medically induced coma for eight days. The<br />

first thing that came to my mind when I woke up was that I<br />

was lucky to be alive. When I passed out, I didn’t know if I<br />

was going to wake up or die. I was so severely injured. I was<br />

in rehab for a year. I spent three months in the hospital and<br />

the other nine months I was going through therapy.<br />

Before the explosion, the 33-year-old Beimfohr had been<br />

very athletic. He’d tried a variety <strong>of</strong> sports: cycling, which<br />

hadn’t particularly excited him, and baseball, which by<br />

his own admission, he wasn’t good at. Mostly he loved<br />

playing soccer. After being injured he began to think<br />

about cycling again.<br />

It wasn’t until I got out <strong>of</strong> the Army that I started thinking<br />

about handcycling. I was focused on my therapy. I got<br />

involved with handcycling through an organization<br />

for people with disabilities. I wanted to be more<br />

competitive, and so I linked up with <strong>Paralyzed</strong> <strong>Veterans</strong>.<br />

I’ve been racing ever since.<br />

The <strong>Paralyzed</strong> <strong>Veterans</strong> Racing Team is a new<br />

handcycling program developed not just for recreation,<br />

but to emphasize exercise and fitness as a focus for our<br />

members and other veterans with catastrophic injuries.<br />

I may do three or four races over three or four days. Our<br />

season is year-round. We race all over the country. Being<br />

partnered with <strong>Paralyzed</strong> <strong>Veterans</strong> has made me more<br />

competitive and a better cyclist. The level <strong>of</strong> people we<br />

compete with is the best in the country.<br />

The members <strong>of</strong> the team train 60 to 80 miles a week.<br />

Races range from 7 to 14 miles and up to 38 miles for a<br />

road race. Beimfohr said he loves the sport for what it does<br />

for his psyche and his health, having been diagnosed with<br />

diabetes a few years ago.<br />

I take my insulin shot one time a week if that. All that<br />

exercise helps keep the diabetes in check. That’s the thing<br />

with guys in wheelchairs: if they are not active they can gain<br />

weight really quickly. There’s a ton <strong>of</strong> problems that comes<br />

with that, so we’ve got to do something. <strong>Paralyzed</strong> <strong>Veterans</strong><br />

has been great. They sponsor a lot <strong>of</strong> different wheelchair<br />

adaptive sports, and I think they’re doing a great job.<br />

Outdoor therapy areas are vital to rehabilitation and<br />

improved patient outcomes—particularly for spinal cord<br />

injured individuals, whose stays at an SCI center average<br />

between 40 and 60 days. These spaces not only provide<br />

opportunities for recreational activity, outdoor space for<br />

physical therapy, and inviting gathering places for visiting<br />

families, but also <strong>of</strong>fer opportunities for patients to engage<br />

themselves, such as tending plants or growing vegetables,<br />

and relieve the tedium.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong>’ architects work directly with<br />

representatives from the Department <strong>of</strong> <strong>Veterans</strong> Affairs<br />

on issues relating to the renovation and construction <strong>of</strong><br />

spinal cord injury centers, and help write VA guidelines for<br />

building these centers. <strong>Paralyzed</strong> <strong>Veterans</strong> has also been<br />

a strong advocate for outdoor space improvements at VA<br />

SCI centers and additional options to motivate patients to<br />

get outside.<br />

In part because <strong>of</strong> this advocacy, VA is currently building or<br />

renovating a record number <strong>of</strong> outdoor therapy areas at new<br />

or existing spinal cord injury centers. These recreation areas<br />

will be more elaborate, some with sports amenities, family<br />

areas, and extensive natural gardens. Many will have space<br />

for patients to engage in horticulture therapy.<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> is the only veterans service organization<br />

with a staff <strong>of</strong> pr<strong>of</strong>essional architects, and their expertise<br />

is essential for the successful design and construction <strong>of</strong><br />

all aspects <strong>of</strong> an SCI center. “The basis <strong>of</strong> our advocacy<br />

is simple: what’s in the best interest <strong>of</strong> the patient?” Mark<br />

Lichter, director <strong>of</strong> Architecture, said.<br />

These outdoor areas provide a much needed respite from<br />

being in the hospital. “It helps the patients psychologically,”<br />

he added. “In one project, VA is working on different kinds <strong>of</strong><br />

outdoor space, like a meditation garden. In another they are<br />

thinking about building an amphitheater. These spaces are<br />

really expanding in their roles.”<br />

In Tampa, VA is rebuilding the outdoor yard to better<br />

accommodate the needs <strong>of</strong> patients and make it more<br />

usable. With limited accessibility, little shade, and<br />

recreational features that were not being used, it was<br />

time for a makeover. The new courtyard design features a<br />

basketball half court, more shade trees and green areas,<br />

and canopies. Architects from <strong>Paralyzed</strong> <strong>Veterans</strong>, as part<br />

<strong>of</strong> the design committee, pushed for these features.<br />

“We are the only ones assessing real-life situations and<br />

sending that information back to VA,” Lichter noted. “We<br />

use lessons learned from the design and construction <strong>of</strong><br />

facilities, as well as conduct post-occupancy evaluations<br />

one to two years after a new facility has been occupied.<br />

We are really the only patient advocates at the table when<br />

a design team plans a new SCI center.<br />

“SCI veterans will spend so much time in and out <strong>of</strong> these<br />

facilities. By advocating for them, it really has an important<br />

impact on the rest <strong>of</strong> their lives.”<br />

older in long-term-care facilities is projected to balloon<br />

by more than 1.2 million in the next two years.<br />

MEDICAL SERVICES AND HEALTH POLICY<br />

LONG-TERM-CARE NEEDS<br />

The number <strong>of</strong> veterans with spinal cord injury or disease<br />

(SCI/D) is soaring thanks in part to medical advances and<br />

care that make near-normal life expectancy possible. But<br />

the increasing life expectancy raises another set <strong>of</strong> issues.<br />

“At the same time, secondary complications in these<br />

veterans are very complex and costly to VA, and VA is not<br />

prepared to address that,” Lana McKenzie, associate<br />

executive director <strong>of</strong> Medical Services and Health Policy,<br />

said. “Future needs will be for more long-term-care facilities<br />

so that these veterans are not relegated to veterans’<br />

homes or nursing homes where they cannot receive the<br />

specialized care they need.”<br />

The enrollment <strong>of</strong> all veterans who are 85 years and older<br />

in long-term-care facilities is projected to balloon by more<br />

than 1.2 million in the next two years. These veterans,<br />

particularly those with spinal cord injuries, represent a<br />

steadily growing demand for VA long-term care.<br />

Our Medical Services team is watching these numbers<br />

closely and is leading the campaign for more longterm-care<br />

facilities to address the needs <strong>of</strong> this growing<br />

population. Last year our Medical Services team made 38<br />

site visits. They checked out every VA-operated SCI center,<br />

many long-term-care facilities, and some outpatient SCI<br />

clinics, investigating such things as staffing shortages that<br />

lead to delays in care.<br />

These visits are fact-finding and problem-solving tours.<br />

But they are also part <strong>of</strong> a strategy on the part <strong>of</strong> <strong>Paralyzed</strong><br />

<strong>Veterans</strong> to push for more long-term care facilities and<br />

additional SCI centers to address this growing need.<br />

“Although primary and hospital care has grown significantly<br />

in recent years, VA extended-care and long-term-care<br />

programs have not,” McKenzie said. “<strong>Veterans</strong> have been<br />

put at risk by these shortages and <strong>of</strong>ten have no alternative<br />

other than institutional care.<br />

“With our continued oversight and advocacy we hope to<br />

end these shortages and ensure our SCI/D veterans who<br />

need long-term care a place within the VA system where<br />

they can get the specialty care they need from people<br />

trained in spinal cord medicine.”<br />

NURSE-PATIENT RATIOS<br />

Persistent advocacy over the past several years by our<br />

Medical Sciences staff paid <strong>of</strong>f in 2010 with a change<br />

in how the Department <strong>of</strong> <strong>Veterans</strong> Affairs calculates<br />

its nurse-patient ratio. Using data it collected monthly,<br />

Medical Services was able to demonstrate the inequity<br />

in the formula and propose a new ratio to increase<br />

bedside nurse staffing.<br />

Not all nurses in a VA medical center work directly with<br />

patients. For years, nursing personnel, such as administrators,<br />

supervisors, and mangers, have been factored<br />

into this ratio. But now the calculation is based strictly on<br />

patient needs and the number <strong>of</strong> bedside nurses. The<br />

new formula will significantly improve the quality <strong>of</strong> care for<br />

veterans seeking care in spinal cord units. “Advocating for<br />

an increase in the number <strong>of</strong> staff and increased quality go<br />

hand in hand,” McKenzie said.<br />

A low percentage <strong>of</strong> registered nurses increases the risk<br />

for SCI/D veterans to have secondary complications, such<br />

as urinary tract infections, pneumonia, shock, or upper<br />

gastrointestinal bleeding. It also increases the probability <strong>of</strong><br />

lengthier hospital stays.<br />

“SCI/D patients are prone to all <strong>of</strong> these adverse outcomes<br />

because <strong>of</strong> the catastrophic nature <strong>of</strong> their condition,”<br />

McKenzie said. “A 50 percent RN staff in the SCI/D service<br />

is crucial in promoting optimal outcomes. This nursing<br />

shortage is manifested in the fact that VA facilities have<br />

begun to restrict admissions to SCI/D wards. Reports <strong>of</strong><br />

bed consolidations or closures have been received due to<br />

nursing shortages. Such situations create a severe compromise<br />

<strong>of</strong> patient safety and continue to stress the need to<br />

enhance the nurse recruitment and retention programs.”<br />

Individuals with spinal cord injury are vulnerable to infections<br />

and secondary ailments. They require a heightened level <strong>of</strong><br />

care from medical pr<strong>of</strong>essionals who have been trained in<br />

dealing with their specific needs. Without access to these<br />

specialists, paralyzed veterans face life-threatening risks.<br />

Nearly 200 paralyzed veterans in Hawaii, Guam, and Samoa<br />

find themselves in this situation. With no spinal cord unit in<br />

the VA medical center in Honolulu, they must travel up to<br />

2,200 miles for their annual screenings, a six-hour plane ride<br />

that <strong>of</strong>ten taxes their strength and can affect their health.<br />

Many <strong>of</strong> these veterans, discouraged by the difficult,<br />

lengthy travel, postpone evaluations, and many do not<br />

go at all—<strong>of</strong>tentimes a costly decision. The annual<br />

evaluation is essential for monitoring health and<br />

diagnosing and preventing secondary complications,<br />

such as urinary tract infections, chronic pain, pressure<br />

ulcers, and heart problems.<br />

“When you get to the SCI center, you’re an inpatient. (The<br />

specialists) all come to you at one time and complete their<br />

treatment before discharging you,” said Hen-Min Hiu.<br />

“The downside to Palo Alto (the closest VA SCI center)<br />

is you go in for your annual and they might find some<br />

problem and you may end up staying for weeks. At least in<br />

Hawaii I would still be near my family, my home.”<br />

In response to this situation, our Medical Services team is<br />

consulting with VA about ways to raise the level <strong>of</strong> care for<br />

SCI individuals throughout the Pacific. In 2010, Medical<br />

Services conducted a fact-finding and education tour<br />

at Tripler Army Base and the Pacific Islands Health Care<br />

System, where these veterans receive routine care. The<br />

tour revealed a lack <strong>of</strong> specialized caregivers, as well as a<br />

clinic not ideally designed for the wheelchair user. <strong>Paralyzed</strong><br />

<strong>Veterans</strong> made recommendations for improved accessibility<br />

and is working out details with VA for training at the SCI<br />

center in Palo Alto, California, for the staff at the VA medical<br />

center as well as Tripler.<br />

Said Warren Dastrup, who lives in Kauai, “The care<br />

I get at the SCI center at Palo Alto is every bit as good<br />

as the care I received at the Rehabilitation Institute <strong>of</strong><br />

Chicago. To have that level <strong>of</strong> care close to home would<br />

be wonderful.”<br />

An SCI-trained staff can mean the difference between<br />

life and death. For example, autonomic dysreflexia (AD),<br />

characterized by increased blood pressure, intense<br />

headache, pr<strong>of</strong>use sweating, and flushing <strong>of</strong> the skin,<br />

is <strong>of</strong>ten unrecognized by clinicians inexperienced<br />

in SCI medicine, and this can have life-threatening<br />

consequences. “We, unfortunately, have already seen this<br />

in two cases in the area,” said Lana McKenzie, associate<br />

executive director, Medical Services and Health Policy. “A<br />

veteran showed up at the emergency room complaining <strong>of</strong><br />

severe headache and was told to wait. He went into shock<br />

and is now fighting for his life.<br />

“We are working as hard as possible to ensure this does not<br />

happen again.”<br />

Medical Services is aggressively advocating for VA to put<br />

in place a full complement <strong>of</strong> physicians and nurses with<br />

training and experience specific to SCI/D. Once in place,<br />

the need for these veterans to take lengthy—and <strong>of</strong>ten<br />

painful—annual trips to California will be eliminated.<br />

Ensuring <strong>Veterans</strong> Get<br />

Their Day in Court<br />

Since the passage <strong>of</strong> the <strong>Veterans</strong> Judicial Review Act in<br />

1988, <strong>Paralyzed</strong> <strong>Veterans</strong> has recognized the importance<br />

<strong>of</strong> employing experienced lawyers to represent its members<br />

and other veterans before the federal courts having<br />

jurisdiction over claims for veterans benefits. The U.S.<br />

Supreme Court, which is one such court, issued a decision<br />

in March 2011 in a case in which we participated for years<br />

as an amicus or “friend <strong>of</strong> the court.”<br />

Henderson v. Shinseki examined whether equitable tolling,<br />

essentially a legal concept allowing a case to go forward,<br />

as a matter <strong>of</strong> fairness, after a deadline has been missed,<br />

should apply when veterans file late appeals, <strong>of</strong>ten as a<br />

result <strong>of</strong> a disability, to the U.S. Court <strong>of</strong> Appeals for <strong>Veterans</strong><br />

Claims (<strong>Veterans</strong> Court).<br />

Korean War veteran David Henderson, who had been<br />

diagnosed with a service-connected psychiatric disability,<br />

sought additional benefits from the Department <strong>of</strong> <strong>Veterans</strong><br />

Affairs as his health deteriorated, but he was denied. In<br />

2005, he unknowingly filed a late appeal with the <strong>Veterans</strong><br />

Court—his disability prevented him from understanding the<br />

deadline. Citing to Supreme Court precedent, the <strong>Veterans</strong><br />

Court found that no exceptions could be made to a late<br />

appeal and dismissed Mr. Henderson’s appeal. The ruling<br />

meant that veterans who are hospitalized or psychiatrically<br />

disabled must act within the specified time period, even if VA<br />

took years to decide their claims. It also meant that veterans<br />

who rely upon VA for help or who misdirect their appeal<br />

documents to VA may lose the right to appeal if VA does not<br />

forward the documents to the court in time.<br />

Henderson appealed to the U.S. Court <strong>of</strong> Appeals for the<br />

Federal Circuit, but that court upheld the <strong>Veterans</strong> Court<br />

decision. Mr. Henderson then sought and received review<br />

by the U.S. Supreme Court. <strong>Paralyzed</strong> <strong>Veterans</strong> filed amicus<br />

briefs in support <strong>of</strong> Mr. Henderson throughout these appeals.<br />

In a victory for all veterans with disabilities, in March<br />

2011, the Supreme Court held that procedures in cases<br />

involving veterans’ disabilities were different from ordinary<br />

civil litigation and warranted different treatment because<br />

Congress did not intend that strict rules regarding<br />

deadlines and their harsh consequences apply to an<br />

appeal to a specialized court created to review VA<br />

decisions denying benefits. The Supreme Court’s holding<br />

and analysis <strong>of</strong> the law tracked many <strong>of</strong> the arguments<br />

made by <strong>Paralyzed</strong> <strong>Veterans</strong> in its amicus brief.<br />

Mr. Henderson passed away just before the Supreme<br />

Court heard his case, but the substitution <strong>of</strong> his wife before<br />

the Court permitted the Court to issue this important<br />

precedential decision.<br />

“<strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> can be proud <strong>of</strong> its<br />

commitment to continue to play a major role in the<br />

development <strong>of</strong> this area <strong>of</strong> the law and the resulting<br />

benefits to all veterans,” said Bill Mailander, <strong>Paralyzed</strong><br />

<strong>Veterans</strong>’ general counsel.<br />

PROVIDING PRO BONO REPRESENTATION<br />

The rights <strong>of</strong> veterans in all spheres are the bedrock <strong>of</strong><br />

our work at <strong>Paralyzed</strong> <strong>Veterans</strong>. We play a leading role<br />

in the <strong>Veterans</strong> Consortium Pro Bono Program, which<br />

recruits, trains, and mentors volunteer lawyers who agree<br />

to represent veterans free <strong>of</strong> charge at the <strong>Veterans</strong> Court.<br />

Mr. Henderson was represented at the initial appellate<br />

stages by a Consortium attorney, who then passed<br />

the representation to more senior lawyers in that firm’s<br />

Supreme Court litigation group.<br />

Each year the Consortium trains between 200 and<br />

250 lawyers who are interested in learning more about<br />

veterans’ issues and who wish to represent veterans in<br />

this federal court. To date, more than 3,000 veterans have<br />

been helped by volunteer lawyers. <strong>Paralyzed</strong> <strong>Veterans</strong>’<br />

attorneys have mentored hundreds <strong>of</strong> these volunteer<br />

lawyers, and we are proud <strong>of</strong> our nearly 20-year history<br />

with the Pro Bono Program, which since its founding has<br />

provided more than $55 million in legal services for the men<br />

and women who have given so much in the service <strong>of</strong> our<br />

country.<br />

LEVERAGING THE NATIONWIDE LEGAL COMMUNITY<br />

The <strong>Veterans</strong> Court is not the only place attorneys can assist<br />

veterans. <strong>Paralyzed</strong> <strong>Veterans</strong> has found that the private<br />

bar across the country has shown a tremendous interest<br />

in helping veterans obtain their VA benefits. Many lawyers<br />

who would like to help, though, have found a lack <strong>of</strong> readily<br />

available training that they need to effectively represent<br />

veterans. In an effort to make training widely available<br />

and the learning experience easier and more accessible,<br />

<strong>Paralyzed</strong> <strong>Veterans</strong>’ Office <strong>of</strong> General Counsel is developing<br />

a web-based series <strong>of</strong> training materials for pro bono<br />

lawyers who want to represent veterans before VA.<br />

“We’re going to develop training materials that are easy<br />

and convenient to use,” Mailander said. “The legal<br />

community is very interested in this training. I expect it to be<br />

online within the next year.”<br />

<strong>Paralyzed</strong> <strong>Veterans</strong>’ attorneys has been active in providing<br />

veterans law for the legal community many years, and<br />

these web-based materials are simply the newest effort<br />

to meet the community’s needs for more accessible<br />

programs. For example, <strong>Paralyzed</strong> <strong>Veterans</strong> has a training<br />

DVD available through the <strong>America</strong>n Bar Association.<br />

This DVD, made in conjunction with the law firm Howrey,<br />

provides pro bono counsel with the necessary information<br />

to receive accreditation from VA so that they may represent<br />

veterans before the agency. <strong>Paralyzed</strong> <strong>Veterans</strong> is the only<br />

veterans service organization that creates and provides<br />

this kind <strong>of</strong> training, which we consider critical to ensuring<br />

that all veterans have access to representation.<br />

Richard Hoover, editor <strong>of</strong> PN and Sports ‘N Spokes,<br />

is a U.S. Air Force pilot and Vietnam veteran. A member<br />

<strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong> since the early 1970s, he served<br />

as <strong>Paralyzed</strong> <strong>Veterans</strong>’ president from 1984–1986.<br />

After longtime editor Cliff Crase passed away in 2007,<br />

Mr. Hoover was asked to step in as acting editor and<br />

in 2009, he accepted the position full time. In this<br />

Q&A he shares his views on and vision for <strong>Paralyzed</strong><br />

<strong>Veterans</strong>’ publications.<br />

As a long-time member <strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong><br />

receiving PN (a member benefit), and now the editor,<br />

what strikes you as the one constant over the years?<br />

The one constant theme <strong>of</strong> PN, formerly Paraplegia<br />

News, since its inception has been the effort to<br />

provide information <strong>of</strong> value to the members <strong>of</strong><br />

<strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong>. Despite the evolution<br />

<strong>of</strong> the magazine since its beginning in the 1940s as a<br />

mimeographed group <strong>of</strong> pages stapled together to the<br />

sophisticated, graphic-intensive publication that we have<br />

today, the consistent thrust <strong>of</strong> articles has been to provide<br />

information to <strong>Paralyzed</strong> <strong>Veterans</strong>’ members that makes<br />

life easier for them. It is important to remember that<br />

despite the broad range <strong>of</strong> material in the magazine—<br />

from architectural design to the latest information<br />

on veterans benefits—PN is the <strong>of</strong>ficial publication<br />

<strong>of</strong> <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong>. Each issue has an<br />

editorial from the president, which permits him to stay in<br />

touch with the members <strong>of</strong> the organization and inform<br />

them <strong>of</strong> his and the organization’s priorities and areas<br />

<strong>of</strong> interest. So it is not surprising that our focus in PN is<br />

primarily on paralyzed veterans.<br />

How are PN and Sports ’N Spokes growing and<br />

changing to keep up not only with changing<br />

technologies but with the changing demographics<br />

<strong>of</strong> our membership, serving both the older veteran as<br />

well as younger veterans <strong>of</strong> recent service?<br />

The staff <strong>of</strong> PN and its sister publication Sports ’N Spokes<br />

recognize the changing demographics <strong>of</strong> our membership<br />

and paralyzed veterans in general. While differences in<br />

the members in their 20s and those in their 60s may make<br />

creating the magazine articles challenging, it is no different<br />

from serving veterans and the disabled population from<br />

WWII, Korea, Vietnam, and now the Gulf conflict periods<br />

simultaneously. The one significant change is that with<br />

the work <strong>Paralyzed</strong> <strong>Veterans</strong> has done in the area <strong>of</strong><br />

accessibility, we see all people with disabilities demanding<br />

greater access to activities that were only dreamed <strong>of</strong><br />

in the 1940s, ’50s, and ’60s. Consequently, we have<br />

increased our focus in both magazines in reporting on new<br />

technologies available to all demographic segments <strong>of</strong> our<br />

readership. This is one <strong>of</strong> the reasons we see an increase in<br />

activities, such as hunting, fishing, water skiing, etc., and<br />

our advertisers provide information on the availability <strong>of</strong><br />

new developments to aid in those activities.<br />

PN and Sports ’N Spokes serve the entire spinal<br />

cord injury and dysfunction (SCI/D) communities,<br />

but many people may not know that. What aspects<br />

<strong>of</strong> both magazines would be most <strong>of</strong> interest to<br />

nonveterans with SCI/D?<br />

Despite the focus on veterans in PN, most <strong>of</strong> the material<br />

in each edition—whether dealing with air travel,<br />

accessibility law, financial advice, etc.—is valuable<br />

whether or not a person is a veteran. While PN was<br />

created for paralyzed veterans, we realized early on that<br />

many <strong>of</strong> the issues that were <strong>of</strong> interest to veterans were<br />

also <strong>of</strong> interest to all people with disabilities—whether<br />

dealing with air travel, accessibility law, health care,<br />

financial advice, and so on. Sports ’N Spokes was founded<br />

with a broader vision toward the SCI/D community<br />

throughout the world.<br />

ADDRESS LABEL<br />

Anecdotally, what types <strong>of</strong> things do people say they<br />

enjoy most about the magazines?<br />

Two <strong>of</strong> the areas <strong>of</strong> significant interest that recently<br />

generated responses above normal were challenges in air<br />

travel for people with a disability, and the availability<br />

<strong>of</strong> nonformulary medications from the Department<br />

<strong>of</strong> <strong>Veterans</strong> Affairs for veterans needing unique drugs.<br />

Normally, the responses from readers are to thank us<br />

for providing information that was not otherwise<br />

available to them.<br />

What can readers expect from PN and Sports ’N<br />

Spokes in the years ahead?<br />

Both publications are undergoing continual change.<br />

We are currently working to update the titles and content<br />

<strong>of</strong> some <strong>of</strong> the sections that are included in each edition<br />

<strong>of</strong> PN. We are hopeful that we can develop a section on<br />

national legislation affecting veterans and others with<br />

disabilities. We are working on redesigning the cover and<br />

content <strong>of</strong> Sports ’N Spokes this year also. Last year we<br />

developed an Internet version <strong>of</strong> Sports ’N Spokes. The<br />

site is widely followed throughout the world because<br />

it has a unique ability to allow content to be translated<br />

into over 40 languages. We will be working on the same<br />

capability for PN this coming year. The latest technology<br />

we are looking at is making the publications available on<br />

some <strong>of</strong> the smaller electronic devices, such as the iPad and<br />

the more sophisticated cell phones. Electronic media are<br />

very important and the most widely used communication<br />

device <strong>of</strong> the younger generation. It does necessitate a<br />

change in writing approach because the Internet is more<br />

graphic intensive and less textual in nature. That is a talent<br />

we at PVA Publications are developing as we become more<br />

familiar and comfortable with new media.<br />

Mark Pitzen says he wants to do whatever he can do to<br />

make sure our injured troops who return home are not<br />

forgotten, which is why he been a supporter <strong>of</strong> <strong>Paralyzed</strong><br />

<strong>Veterans</strong> <strong>of</strong> <strong>America</strong> for the past 20 years.<br />

As an ammunition logistics assistance representative<br />

(LAR), Pitzen provides support services to our troops<br />

on the battlefield by ensuring that the ammunition<br />

used both in training and war-fighting environments<br />

functions properly.<br />

Pitzen says that working so closely with soldiers and other<br />

military personnel on the front lines made him realize what<br />

our soldiers and all service members go through and<br />

endure, and he wanted to find a way to give back.<br />

Working with soldiers firsthand in a combat environment<br />

really opened my eyes to all that they do every day to<br />

protect our freedoms. They make the ultimate sacrifice—<br />

putting their lives on the line, which people tend to forget<br />

once these soldiers return home injured.<br />

Pitzen, a former Peace Corps volunteer, has worked for<br />

the past 10 years as a Joint Munitions Command LAR<br />

assigned to the Armed Forces Support Battalion at Ft.<br />

Stewart, Georgia. Previously, he was a quality assurance<br />

specialist-ammunition surveillance stationed at various<br />

locations for 23 years. As a DOD civilian, his position<br />

currently requires him to deploy with the Army every six<br />

months to Southwest Asia. To date, he has completed nine<br />

consecutive deployments.<br />

People see the news, which <strong>of</strong>ten focuses on those who are<br />

killed in the line <strong>of</strong> duty, but we should not forget about<br />

the wounded who come back home and are not only<br />

physically injured, but emotionally and mentally injured<br />

as well.<br />

Donating to <strong>Paralyzed</strong> <strong>Veterans</strong> is Mark Pitzen’s way <strong>of</strong><br />

remembering the injured and making sure they get the<br />

support and help that they need.<br />

Perhaps in no year in recent memory has “loyal” more accurately described you.<br />

Everywhere around us we see the signs <strong>of</strong> the economic downturn, and, sadly, paralyzed veterans are some<br />

<strong>of</strong> the hardest hit. We thank you for continuing to remember our veterans and support them with your<br />

gifts. Indeed, we had a record year for donations in 2010, while most nonpr<strong>of</strong>its struggled. We realize<br />

that such overwhelming support is the result <strong>of</strong> your appreciation <strong>of</strong> our mission to help our nation’s<br />

catastrophically injured veterans, and your confidence allows us to continue to serve our nation’s heroes<br />

from the moment they return home throughout their lifetimes.<br />

You can be assured that we recognize the significance <strong>of</strong> each and every gift, especially in the current<br />

to invest every possible cent in programs that benefit our nation’s paralyzed veterans, and I am proud to<br />

Let me emphasize the importance <strong>of</strong> fiscal responsibility. <strong>Paralyzed</strong> <strong>Veterans</strong> <strong>of</strong> <strong>America</strong> has a long<br />

history <strong>of</strong> good stewardship. We have a strong system <strong>of</strong> internal controls, supported by an active board<br />

<strong>of</strong> directors and a very thorough external audit team. In addition, very much like a public company,<br />

<strong>Paralyzed</strong> <strong>Veterans</strong> has an audit committee that oversees its accounting and financial reporting processes.<br />

It is my responsibility, and one I take very seriously, to maintain a strict system <strong>of</strong> controls to ensure the<br />

reliability <strong>of</strong> our financial reporting. As a result <strong>of</strong> these procedures and our commitment to limit overhead<br />

Micros<strong>of</strong>t and the platinum-selling recording group O.A.R. are two household name brands to sign up for <strong>Paralyzed</strong><br />

<strong>Veterans</strong> <strong>of</strong> <strong>America</strong>’s Mission: ABLE campaign, which kicked <strong>of</strong>f a year ago.<br />

The campaign is a full-on effort by <strong>Paralyzed</strong> <strong>Veterans</strong> to enlist every single citizen, community, and company to help<br />

our heroes help themselves—to ensure that those who have worn the uniform and have been seriously injured have<br />

what they need to fully live the lives they deserve and receive what they need most: care, benefits, and jobs.<br />

Micros<strong>of</strong>t made <strong>Paralyzed</strong> <strong>Veterans</strong> the focus <strong>of</strong> its website on <strong>Veterans</strong> Day and O.A.R. donated the proceeds <strong>of</strong><br />

its fan-cowritten song, “Light Switch Sky” to the organization. The popular band also recorded a special television<br />

and radio public service announcement campaign for <strong>Paralyzed</strong> <strong>Veterans</strong>, getting the message about our work<br />

out to millions.<br />

Why Mission: ABLE? Let’s focus on just one <strong>of</strong> those needs: jobs. The national unemployment rate for veterans with<br />

severe disabilities is a shocking 85 percent. Through Mission: ABLE, we aim to turn this appalling statistic around—<br />

and, through our vocational rehabilitation program, help our veterans get a fair shot at the <strong>America</strong>n Dream: a good<br />

job at a good company.<br />
