SECTION 12<br />

Agreement Format<br />

The terms and conditions should be reviewed very carefully to insure full responsiveness to this<br />

RFP. The anticipated Sample <strong>Purchasing</strong> Agreement will be, in form and substance, consistent with<br />

applicable <strong>University</strong> policy and regulations and State <strong>of</strong> <strong>Connecticut</strong> statutes and regulations<br />

regarding the creation and execution <strong>of</strong> such Agreement. The failure <strong>of</strong> any respondent to receive or<br />

examine any contract, document, form, addendum or to visit the sites and acquaint itself with<br />

conditions there-existing, will not relieve it <strong>of</strong> any obligation with respect to its proposal or any<br />

executed contract. The submission <strong>of</strong> a proposal shall be conclusive evidence and understanding <strong>of</strong> the<br />

<strong>University</strong>’s intent to incorporate such terms and conditions into the Agreement.<br />

Do not complete or sign this agreement! This document will only be completed and executed to<br />

the awarded firm(s) if it is deemed necessary by the <strong>Purchasing</strong> Agent.<br />

The <strong>University</strong> <strong>of</strong> <strong>Connecticut</strong> reserves the right to reject any proposal response that does not comply<br />

with the State’s contractual requirements. Proposals are subject to rejection in whole or in part if they<br />

limit or modify any <strong>of</strong> the terms and conditions and/or specifications <strong>of</strong> this RFP.<br />
