3.7.1 Prices quoted shall remain firm fixed for a twenty-four month period. Thereafter,<br />

prices may be subject to revision, at yearly intervals. Price changes will be accepted<br />

subject to the following conditions only:<br />

3.7.2 The proposal should include suggested procedures for dialog and agreement<br />

regarding the review <strong>of</strong> requested price increases in other similar mutual<br />

circumstances. After the initial period, the prices quoted in response to this<br />

Request for Proposal may be adjusted up or down in an amount not to exceed the<br />

Consumer Price Index (CPI), appropriate for the commodity, as published by the<br />

United States <strong>Department</strong> <strong>of</strong> Labor.<br />

3.7.3 Price changes shall be submitted in writing thirty (30) calendar days prior to the date<br />

the increase rate is allowed to become effective, acceptance <strong>of</strong> which shall be<br />

subject to the <strong>University</strong>’s receipt and approval <strong>of</strong> the written documentation<br />

requesting the changes. No retroactive increases will be allowed. Price escalation is<br />

permitted only once per term.<br />

3.7.4 Price changes approved by the <strong>University</strong> shall then remain firm for the term <strong>of</strong><br />

each successive extension.<br />

3.7.5 The prices quoted for each yearly period shall be firm except that the <strong>University</strong><br />

shall receive any reduction in prices that may occur during the contract period. The<br />

reduced prices shall apply on all shipments made on or after the date the reduced<br />

prices become effective.<br />

3.7.6 As the needs <strong>of</strong> the campus change regarding frequently purchased items and<br />

supplies, the <strong>University</strong> expects the successful bidder will monitor and apply the<br />

recurrent items to the core list so that the core list will change to reflect our buying<br />

patterns.<br />

3.8 Market Price Adjustments, Audits, and Best Price Guarantee<br />

a.) By submitting a proposal, the respondent understands and agrees that the <strong>University</strong><br />

will audit net prices for reasonableness <strong>of</strong> pricing. To determine reasonableness,<br />

contract prices will be compared with current market prices available from<br />

competitors. Price reviews will be performed periodically throughout the contract<br />

period.<br />

b.) If during the course <strong>of</strong> the contract and/or as a result <strong>of</strong> an audit, the prices <strong>of</strong><br />

contract items are discovered to be unreasonably higher than current market prices,<br />

the <strong>University</strong> reserves the right to require and receive price adjustments from the<br />

Contractor. All adjustments shall be made to bring prices in line with competitive<br />

pricing for such items in the marketplace.<br />

c.) A best price guarantee will be required. All sales and special pricing <strong>of</strong>fered to the<br />
