PSERS will review the questionnaire and will let you know if you must create a Member Demographic Record for this employee. As a time-saver, information does not need to be submitted for employees who are clearly ineligible for membership. Waiving Membership When Employed Part-Time Any part-time employee (salaried, hourly, or per diem) may waive membership in PSERS within 30 days of starting employment. Full-time employees cannot waive membership. To qualify for the waiver, the part-time employee must - • Maintain one of the following types of Individual Retirement Account’s (IRA) as defined by section 408 in the Internal Revenue Code: Traditional IRA Roth IRA Simplified Employee Pension (SEP) Savings Incentive Match Plan for Employees of Small Employers (Simple) IRA and… • request a waiver within 30 days of starting employment. A waiver must be requested of each employer, using whatever method the employer has designated for this request. PSERS will send a Membership Waiver form directly to the employee. When the employee waives membership in PSERS, all future rights to benefits for that year are waived. In response to the employee’s waiver request, you must – • Verify that the employee has an Individual Retirement Account (IRA) and… • Submit a Member Contract Record for this employee, with Work Status set to “ACTIVW – Waiver Request.” See Member Contract Records – Changing Information for an Employee on page 58. Once you submit the Member Contract Record indicating the Waiver Request, you may discontinue reporting this employee in your monthly Work Reports. If the employee does NOT qualify for the waiver, PSERS will notify you. 20 EMPLOYER’S REFERENCE MANUAL FOR REPORTING
When a Member Contract Record is submitted showing the waiver request, PSERS will respond by – • Sending the employee a Welcome Waiver Packet containing detailed information about the waiver process and a PSERS Membership Waiver (PSRS-51) form. A copy of this form is shown below for reference. The employee must complete this form and return it directly to PSERS. Submission of the completed waiver is binding for the entire school year in which membership is being waived unless the employee becomes a full-time school employee.
